BY -LAW COMMITTEE MINUTES #128 <br />May 25, 1988 <br />Mers present: Ed Murphy, George Theophanis, Nils Nordberg, <br />Phil Pacino and Dolores Carroll. <br />7:35 Chairman Ed Murphy called the meeting to order in Room 16 of <br />Town Hall. <br />Minutes of meeting No. 127 were reviewed and amended as <br />follows: <br />In the last sentence of the next to last paragraph of the first <br />page, the word "by -law" should be "regulation." The second <br />last paragraph of page 2 should have included the words, "voted <br />to recommend by a vote of 3 -1." <br />Minutes accepted as corrected by a vote of 3 -0. <br />Nils Nordberg presented committee members with a copy of a <br />letter he had sent to the Moderator, Paul Dustin, regarding our <br />By -laws as they pertain to "Conduct of Town Meeting." <br />Upon recommendation of Ed Murphy, we commenced discussion of <br />the By -law codification with the following comments: <br />- Keep a record of issues we want to bring up such as Article <br />1 which governs Town Meeting. <br />- George Theophanis feels Town Meeting gives away too much <br />power with boards, general procedures of regulations and the <br />local operation of government in general. <br />- Issues - procedures for adopting and promulgating <br />regulations. <br />- Nils Nordberg believes the Moderator should have certain <br />freedom to maintain order and make rulings, which Town <br />Meeting can accept or reject. Needs further discussion. <br />- Discussion on augmenting the Charter provision on removal of <br />Town Meeting Members with a set of rules. Agreed to make <br />recommendations to Town Meeting. Can be builgY into By -law <br />to implement that provision. <br />- Ed Murphy read and the committee reviewed previous changes <br />made in Article 1. <br />- "Amendment" - no changes. Agreed to accept as is. <br />"Repeal" - Agreed to use first sentence of Andover's By -law <br />language, but deleate the word "heretofore adopted." Use <br />the second sentence of our By-Iiw; change the word "the" to <br />4W "these" and remove word "foregoing." <br />
