HomeMy WebLinkAbout2010-05-25 Board of Selectmen PacketTown of Reading 16 Lowell Street 9: tCORpO~ w° Reading, MA 01867-2685 3NC FAX: (781) 942-9071 Email: townmanager@ci.reading.ma.us Website: www. readingma.gov TOWN MANAGER (781) 942-9043 MEMORANDUM TO: Board of Selectmen FROM: Peter Hechenbleikner DATE: May 14, 2010 RE: Selectmen's Meeting May 25, 2010 2a) The attached list details approximately 50 employees to receive a certificate for their work on the recent "boil water" water emergency in Reading. 2b) The attached two certificates of achievements recognize outstanding work done by Library personnel. 3a) The Town has received an award for supporting environmental health from the Massachusetts Environmental Health Association. 3b) Town Meeting under Article 24 authorized the granting of an easement for 767 Main Street to be tied into the sanitary sewer system. Town Counsel and the Town Engineer have worked on getting all plans, easement documents, and maintenance agreements put together for the Board's execution. The property owner is extremely anxious to move forward with the installation of this sewer line and will be at the meeting to receive the documents once they are signed and notarized, so they can be filed the next day with the Registrar of Deeds. 3c) Presentation of Draft Pavement Management Program - The Town Engineer will be present with the consultant to review with the Board of Selectmen the draft of the Pavement Management Program for fiscal year 2011+. 1 have asked the Town Engineer to prioritize Temple Street pavement as part of the plan, and the documents that you receive will reflect that. This•will of course still leave the question as to how/whether the curbing and sidewalk on Temple Street also gets accomplished. 3d) Discussion with Board of Health re: Outdoor Dining - The Board of Health will be in to talk about outdoor dining. The purpose of this discussion is to make sure the Board in their initiatives to encourage outdoor dining is on the same page as the Board of Health in their regulatory role regarding food service. Additionally, Chairman Tafoya asked that we review regulations for restaurants having windows open. Please see the attached material that Jean Delios received from Boston, Cambridge and Arlington which confirm the Town of Reading's approach to allowing this to take place. 3e) Rubbish Collection - Potential Extension of Existing Contract - The Public Works Director will be in to talk about our rubbish collection and recycling program evaluation and an alternative that exists for extension of the existing contract that has been requested by our current vendor. Inductees' contributions may be in the fields of public service, education, advocacy, mentoring, service to the profession or other areas. "Grantor"), having its usual place of business at Town Hall, 16 Lowell Street, Reading, MA 01867 and CRAIG M. BRANDT and JEAN BRANDT, husband and wife, of 767 Main Street, Reading, MA 01867 (hereinafter "the Grantees"), for themselves and their heirs, successors and assigns. WHEREAS, the septic system for the property located at 767 Main Street, Reading, MA (the "Property") failed a recent Title 5 inspection and was required to be upgraded; and WHEREAS, because the square footage of the Property does not accommodate the installation of a new septic system and as a result, the Property must be connected to the Town's municipal sewerage, system; and WHEREAS, direct access to the municipal sewerage system is not readily available to the Property and therefore, Town Meeting approved Article 24 at its May 3, 2010 Annual Town Meeting to authorize the grant of an easement for the benefit of the Property, which easement is to be located in and upon the adjacent Fire Station property located at 757 Main Street, Reading, which easement will allow the Brandts to access the municipal sewerage system by connecting to the existing sewer which serves the Fire Station; and WHEREAS, the existing sewer service is of sufficient size to accommodate sewerage flow from both the Fire Station and the Property; and WHEREAS, it is the intent of the parties to enter into this Agreement to memorialize the rights, duties and obligations of each party with respect to the costs associated with the maintenance of the sewer service: NOW, THEREFORE, for consideration of One Dollar ($1.00) and other good and valuable consideration paid, the receipt and sufficiency of which is hereby acknowledged, the Town and Brandts hereby agree as follows: 1. Subject to the terms and conditions hereof, the Town grants to Craig M. Brandt and Jean Brandt, husband and wife, as tenants by the entirety their successors and or assigns of 767 Main Street, Reading, Massachusetts (hereinafter "Grantees") a perpetual right and easement for sewer purposes on land located at 757 Main Street, Reading, Massachusetts (the "Easement Area") and shown as Sewer Easement Area 2,483 sq. ft. on a plan of land entitled "EASEMENT PLAN 767 MAIN STREET READING, MASSACHUSETTS", Prepared by LeBlanc Survey Associates, Inc. 161 Holten Street, Danvers, MA 01923 (978) 774-6012, dated February 25, 2010, Scale: I"=20', which plan is to be recorded herewith, together with the perpetual right and easement to enter upon said Easement Area, for any and all purposes connected with the proper maintenance, use, operation, improvement, repair and reconstruction of the sewer line. 101978143 2. The Grantor expressly reserves the right to pass and repass over the sewer easement area for access to its property. 3. Whenever it becomes necessary, for whatever reason, for the Grantees, their agents, servants or employees, to dig up, excavate or otherwise disturb the premises, doing no unnecessary damage to the premises; provided, however, that the Grantees shall, at their own cost and expense, restore said premises as nearly and as reasonably as possible and within a reasonable period of time, to their original condition. 4. The Grantees shall exercise their rights hereunder so as to minimize interference with the use and occupancy of the Property by the Town of Reading Fire Department. Similarly, the Grantor agrees that it shall not substantially interfere with the Grantees' rights hereunder. 5. The Grantees shall indemnify, -defend, and hold harmless the Grantor, its duly elected and appointed officers, and employees, from and against any and all actions, causes of action, suits, debts, claims, damages, complaints, expenses, demands, and liabilities whatsoever, including reasonable attorneys' fees, defense costs, and the like, arising out of or'resulting from, or in any way directly related. to the Grantees' activities in the Easement Area, including but not limited to the construction, and installation of the sewer line and related disruption caused thereby and failure to maintain the Easement Areas and the facilities installed therein in good order and condition except if the same was caused by the negligence, fault or misconduct of the Grantor, its officers servants or employees or third parties over whom the Grantee does not exercise control. 6. The Sewer Easement created by this conveyance shall exist for the sole benefit of the property located at 767 Main Street, Reading, Massachusetts. 7. The Sewer Easement Area shall be maintained and the sewer pipe located within said Easement Area shall be kept in good repair with the responsibility and cost of maintenance to be apportioned between the Grantor and the Grantees as follows: the Grantee shall be responsible for all costs associated with the maintenance of the Sewer Easement Area and the sewer pipe located within said Easement Area from the manhole connection to 767 Main Street, Reading, MA, meaning and intending to describe that portion of the pipe that solely services 767 Main Street, Reading, Massachusetts. 8. The Grantor and Grantee shall be responsible for all costs associated with the maintenance of the Sewer Easement Area and maintenance, repair or replacement of the sewer pipe and appurtenances located within said easement area from the manhole connection to Salem Street. The cost of said maintenance shall be apportioned between the two owners based upon each owner's percentage of flow to/from their respective property. Said percentage of flow shall be calculated based on the average water usage to their respective properties from the three years prior to the performance of the maintenance, repair or replacement of the sewer pipe and appurtenances.. 9. The.Grantor and the Grantees for themselves and their successors and assigns, hereby agree to maintain said easement in common with each other and agree to indemnify each other and save each other harmless from and against any loss, damage or liability arising out of their exercise of said right and easement: For Grantor's title, see deed recorded with the Middlesex South Registry of Deeds at Book 3273, Page 47. The gas company is only required to repave their trench; we cannot make them repave the entire street. We initially informed the gas company that any trench pavement installed during the winter would be considered temporary and would be required to be replaced with permanent pavement. In our push to get as much of the road surface repaved, the gas company offered to pay the Town the value of having the permanent pavement installed. We could then use the money to overlay the roadway ourselves. I met with the gas company two weeks ago regarding this and am still waiting to hear what that dollar amount is. In summary: best scenario the Town performs an overlay with gas company money, worst case the gas company repairs approximately half the roadway. While I understand with the warmer weather, residents are anxious about the possibility of having the street repaved, it is still early. We typically wait at least 6 months (preferably after a winter frost cycle) following utility installation before applying the permanent pavement. This is to insure most of the soil consolidation has occurred. Since waiting for a frost cycle would be unreasonably long, if the street is to receive an overlay it will most likely occur late summer early fall. I am trying to obtain a response from the gas company before the end of the week; I will forward additional information as soon as it is available. George J. Zambouras, P.E. But the Saturday evening Soup To Go ministry, however welcomed by the men and women who took comfort in the hot, home-cooked meals, was running afoul of public health laws. Not only was some of the food prepared in volunteers' homes, rather than a licensed kitchen, it was handed out without a permit. Health officials cracked down last month after nine homeless men who ate a church meal complained of gastrointestinal illness. Officials were enforcing a state law requiring that all charitable food programs be inspected and licensed by local health boards. For now, the church group cannot distribute hot food, although it will continue to hand out sandwiches and packaged food. Thomas Goodfellow, assistant commissioner of health at Boston's Inspectional Services Department, said restrictions are necessary to ensure that food provided to the homeless is safe. "The public has a right to know where the food is coming from," he said. "If you want to protect the public health, everyone has to follow the same rules. Donated food must come from a licensed kitchen." Advocates for the homeless and public health officials say the long standing rules are sensible protection against food-borne illnesses in a vulnerable population. But some parishioners are concerned that the government regulations, however well-meaning, block their efforts to feed the hungry, particularly at a time of growing need. The church's food program came to light last month, when nine men at the New England Center for Homeless Veterans complained of illness after eating chili distributed by the church group. State and local health officials were notified, and city inspectors determined the food had been served illegally. The shelter also passed a health inspection. Brian Gallant, Medfield's health agent, said the group has primarily distributed food prepared in the church kitchen, which is regularly inspected and has a permit. But volunteers were also handing out food prepared in individual homes, he said. The chili was prepared at the church, he said. "They are doing good work, and we're not trying to prevent them from doing it," Gallant said. "We just need to make sure everyone's protected." Gallant said he planned to meet with some of the volunteers and would stress sanitation provisions, such as wearing gloves and maintaining adequate temperature. Anita Barry, who directs the Infectious Disease Bureau at the Boston. Public Health Commission, said that the cause of the illnesses was not precisely determined but that at least some cases were probably food-related. "We should be able to work things out fairly quickly," he said. Davies said parishioners enjoy delivering the meals personally and have struck up relationships with many of the recipients. Donating nonperishable food to a soup kitchen or homeless shelter, he said, wouldn't be the same. Yet Davies said he appreciated the thinking behind the health regulations and the need to protect the homeless, who often have health problems that make them particularly susceptible to illnesses caused by contaminated food. "I understand where they are coming from," he said. Outside the veterans shelter yesterday, people said they missed the hot meals and said it was a shame officials interfered with a good thing. "When it's cold, it's.good to get a hot meal in your stomach," said Russell Ricks, a 58-year-old Army veteran who works part time as a dishwasher. "Chili, chicken soup - people looked forward to it. They are nice people. They bring clothes, toothpaste, even gifts at Christmas time." Ricks said the illnesses were not serious and that he doubted the church's food was to blame. A tall man with a gray beard and bad cough, Ricks said people appreciated the meals and were touched-by parishioners' kindness. People staying at the shelter, he said, are typically getting enough to eat and aren't desperate for the hot meals. But for those who live outside and come to the shelter for the Saturday meals, the food is pivotal. Other shelter residents said there is some risk in eating any perishable food, whether served at a restaurant or in one's home. "There's no guarantee," said one middle-aged man, who asked to remain anonymous. "If you go to a cookout, or get invited to someone's house, it's the same thing. Nothing's completely safe." But William Todd, a 60-year-old Air Force veteran who has stayed at the shelter for about a year, said he worries about donated food and likes to know where his meals came from. "I wouldn't trust that myself," he said of the church meals, saying he had never eaten one. In recent years, a number of US cities have passed ordinances restricting groups from sharing food with the homeless, advocates say. While some of these measures seek to deter the homeless from congregating, many are good-faith attempts to protect their health, they say. "There is not a consensus in the homeless community whether it's supportable to feed people on the street," said Neil Donovan, who directs the National Coalition for the Homeless in Washington, D.C. "But there is a consensus that safe public health practices need to extend to the homeless population." In Virginia a few years ago, plans to prohibit shelters from accepting home-cooked food were quickly overturned after sparking widespread resentment.
