Case # 11-06 A Public Hearing on the petition of Fay Homes, LLC, who seeks a Variance, Special Permit, Modification of a Special Permit (ZBA Case # 11-01) under Sections 5.0 / 6.3.2 / 6.3.3 of the zoning bylaws in order to construct 8 single-stall garages with habitable space above the garages on the property located at 10+ Pierce Street in Reading, MA. Attorney Chris Cole represented the Applicant, Bill Johnson. He said they were appearing before the Board solely on the issue of lot coverage. The lot coverage following the proposed construction will be 37% due to the addition of the garages. They have allocated a spot for snow and trash storage. He said the design would not affect any of the neighbors or the drainage. The Building Inspector said they went though site plan review with the CPDC and received approval but the increase in lot coverage must be addressed. Attorney Coleman reviewed the artistic renderings for the Board as well as the site plans and pointed out the changes made to them. Mr. Johnson explained the retaining walls that would be built and what trees would be removed. Mr. Redfern reviewed the lot coverage and said the revised proposed layout is a decrease in lot coverage as compared to existing conditions and therefore, will be a decrease in non-conformity. Roberta Sullivan of the Historical Commission said they had no problems with the project. Tim Hildreth Of 20 Pierce Street voiced his approval of the project. Phil Chevrie had some questions for the Applicant. ZBA Meeting, May 19, 2011 The Chairman said the Board should vote on this case as a modification. On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals granted the Applicant a minor modification to the original Special Permit for case # 11-01 granted under Section 6.3.2 and 6.3.3 of the zoning bylaws in order to construct eight residential condominium units with associated attached. garages and habitable but unenclosed living spaces above the garages, as depicted on the referenced Site Development of Land noted as Revision No. 4, dated April 22, 2011. Vote was 4-0-0 (Petschek, Redfern, Cataldo, Caouette). Case # 11-07 A Public Hearing on the petition of Philip & Maureen Imbrescia who seek a Special Permit under Sections 6.3.8.1b (A) & (B) of the zoning bylaws in order to demolish a non-conforming dwelling on a non-conforming lot, and to construct a new single family dwelling as per plans submitted on the property located at 12 Winter Street in Reading, MA. Attorney Lou Izzy represented Philip & Maureen Imbrescia, the buyers, as well as the Pratt family who are the owners. They want to tear down the existing dwelling and to construct a new four-bedroom home. The front and side yard setbacks will be increased from what is there and will decrease these presently non-conforming areas. He presented letters from neighbors in favor of the project. The Building Inspector said this is a typical teardown and rebuild. The Board did not have any major concerns with the proposed construction and determined that the proposed structure will be substantially less detrimental than the existing structure. Virginia Adams of the Historical Commission said this property is not on the historical list but does have some historic interest as it was once part of the original organ factory on Pierce Street. The Historical Commission would like to encourage the new owners to perhaps keep the original block of the house intact. On a motion by Damase Caouette, seconded by Kristin Cataldo, the Zoning Board of Appeals granted the Applicants a Special Permit under Section 6.3.8. Lb of the Zoning bylaws in order to demolish the existing non-conforming dwelling and to construct a new single family dwelling on a non-conforming lot at 12 Winter Street in Reading, MA. This Special permit is conditioned upon the following: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. The Petitioner's final construction plans for the new structure shall be submitted to the Building Inspector, along with the as-built foundation plan(s), prior to the issuance of a Building Permit. As-built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. Vote was 4-0-0 (Petschek, Redfern, Cataldo, Caouette). Other Business Discussion of M.G.L. c. 40A, sec. 11 "Permit Extension Act" The Board discussed this new permit extension act and how it would affect decisions made by the Board. And how it has already affected a prior decision when an extension for a building permit was granted by the Building Inspector shortly before the permit expired but then the work was not done in the allotted time period. Town Counsel deemed it qualified under the Permit Extension Act. Minutes On a motion by Robert Redfern, seconded by Kristin Cataldo, the Zoning Board of Appeals approved the minutes of April 7, 2011. Vote was 4-0-0 (Petschek, Redfern, Cataldo, Caouette). Adjournment: On a motion by Kristin Cataldo, seconded by Robert Redfern, the Zoning Board of Appeals adjourned the meeting.
