These operations may include Cops in Shops, underage stings/compliance checks, party patrols, and surveillance patrols. An overview of each type of operation is described below: Cops in Shops© - This operation typically consists of one undercover officer who works inside the store while a second officer is positioned outside the establishment to apprehend adults that procure alcohol for youths. Cops in Shops® places the focus on the perpetrators - minors that try to purchase alcohol illegally and adults that try to purchase alcohol illegally for minors. Signs are placed in stores prior to the operation to notify patrons of the possible presence of undercover officers. Underage stings/compliance checks- Underage, young adults under the direction of Reading Police will come into local businesses during the year to try to buy alcoholic beverages. Police officers will be working with these youths. Businesses where sales to underage buyers occur will be referred to the local licensing authority for administrative action. Additionally, a criminal complaint may be filed at Woburn District Court for staff caught selling alcohol to underage buyers. Reports on compliance check operations become public data under State law, meaning that the identity of businesses checked and the outcome of each check can be obtained and published by the news media. Party patrols- Enforcement activities will be implemented by Reading Police to prevent and safely disperse underage drinking parties to reduce underage alcohol use and problems. Potential criminal offenses that may be identified during party patrols may include but are hot limited to: protective' custody, minor in possession, open container, driving under the influence, and/or procuring alcohol for a minor. For criminal offenses, a criminal complaint maybe filed at Woburn District Court or Lowell Juvenile Court. Surveillance patrols- Reading Police will monitor locations throughout the community to gather information on potential underage drinking violations' These locations may include local sporting events, town conservation land, parking areas, and other areas identified as "hot spots". The Reading Police Department believes that by conducting a variety of programs that target both the access and use of alcohol by underage individuals;. it will help to avoid the problems that come with underage drinking, it is less expensive and easier to prevent youth access to alcohol than to investigate the motor vehicle crashes, fights, and other crime that underage drinking promotes. Communities that have reduced the availability of alcohol to underage drinkers have experienced fewer crashes and fewer crimes. Preventing underage drinking is everyone's responsibility! Planning/Coordination with RCASA and Town Staff: ® Officers met in May to be trained on the new "TIP411 text a tip" program. The program will increase info sharing between local residents and police. Residents may submit a tip via text or through the web. The program will launch in July 2011. ® Sgt. Det. Segalla and Erica McNamara participated in the mandatory grant training offered by the Highway Safety Division to ensure all operations would be conducted properly. ® The Annual Press Release announcing the 2011 Compliance Checks was submitted to the media. ® RCASA conducted TIPS (Responsible Beverage Service) training for Oye's staff on April 28, 2011. 5 staff passed. 1 staff member failed. The results were forwarded to the town manager and Oye's Manager. The TIPs Program allows participants that fail to re-take the class within. 6 months of their class. The program requires that participants get a 70 or above to pass the exam. ® RCASA conducted TIPs training for Wine Bunker staff in January 2011. All staff passed. ® RCASA conducted TIPs training for VFW staff in December 2010. 2 staff failed. The Town Manager conducted annual visits to the licenses in late fall of 2010. He let managers know that TIPs training was available through RCASA. I was working with Sgt Det. Segalla and Detective Halloran conducting alcohol compliance checks of all the restaurants 7 5.5n CASE#: D084218 .case#: READING POLICE DEPARTMENT INVESTIGATIVE ACTION REPORT 06/22/11. 23:13 PAGE: 2 NARRATIVE and lounges in Reading. At approximately 7:00 pm Sgt Det. Segalla, the Criminal Division Commander conducted a training for our under age operative, Kelly During the training she was photographed and given aportable breath test that registered 0.0. She was given $20.00 for the purpose of the compliance checks and left all other property secured in the police station. The training was completed at approximately 7:15 pm. Ms. was assigned to both Sgt. Segalla and myself. We conducted our first check at the Venetian Moon located at 680 Main Street. At 7:26 pm Ms. INgagM entered the establishment empty handed. At 7:27 pm she exited the establishment empty handed..She stated that an identification was requested by the clerk and she left the establishment. At 7:28 pm Ms. wow" entered Restorante Pavarotti located at 601 Main Street. At 7:30 pm she exited the establishment. She stated that an identification was requested by the bartender and she left the establishment. At 7:33 pm Ms. entered Bangkok Spice located.at 76.Haven Street. At 7:33pm Sgt. Segalla and I observed Ms. ORURO= sit down at a table and a waitress walk up to her and speak to her. The waitress then walked away and several moments later returned to Ms. FAMMIMMI table with a l2oz.Bud Light bottle. At this time, we observed two waitresses speaking to Ms. ENERIM. At this time, we entered the restaurant..Ms. stated that she was served one 12oz Bud Light Bottle. She stated that the waitress served her the drink without requesting identification. She made a positive identification of the waitress by painting and stating "that's her, the waitress standing at the entrance to the kitchen." Ms. aglZanon returned to our vehicle while Sgt. Segalla and I approached the waitress. We identified ourselves as Reading Police Officers and asked to talk to her.in private. The waitress was identified as Ms. Paphada Pengma ( of Massachusetts. Ms. Pengma was made aware.of the operation and that she had sold alcohol to a minor without requesting identification. Ms. Pengma stated she did serve her and was sorry. Sgt. Segalla asked Ms. P'engma to speak with the restaurant manager. The manager was identified as Mr. Palarat Pattanesuan ( ) of Massachusetts. Mr. Pattanesuan was made aware of the operation and that the waitress had sold alcohol to a minor without requesting identification. Mr. Pattanesuan was advised by Sgt Segalla that a report of the incident will be forwarded to the local liquor licensing board for a hearing due to the violation. She stated that the clerk informed her that they no longer sell alcohol beverages. At 7:48 pm Ms.661001100 entered Cafe' Capri located at 355 Main Street. At 7:48 pm she exited the establishment. She stated that an identification was requested. by the bartender and she left the establishment. At 7:58 pm Ms.WEEREOUD entered Grumpy Doyle's Bar located at 530 Main Street.'At 7:59 pm she exited the establishment. She stated that an identification was requested by the bartender and she left the establishment. At 8:01 pm Ms entered Sam's Bistro located at 107 Main Street. At 8:02 pm she exited the establishment. She stated ''that an identification was' requested by the bartender and she left the establishment. At 8:15 pm she exited the establishment. She' stated that an identification was requested by the bartender and she left.the establishment. She stated that an identification was requested by the bartender and she left the establishment. At 8:18 pm Ms. entered Oye's Restaurant" ocated at 26 Walkers Brook Drive. After being served she stated the bartender took the $20.00 bill she produced and gave her $16.25 back. She stated that the bartender served her the drink without requesting identification. Ms. MIENJUP was brought to the entrance of the establishment by myself. She made a positive identification of the bartender by pointing and stating "that's him, the bartender with the bald head, glasses and black shirt standing inside the bar." Ms. returned to our vehicle while I approached the hostess. I identified myself as a Reading Police Officer and asked to talk to his manager. The manager was identified as Ms. Jian Qing Zheng ) of Massachusetts. Ms. Zheng then brought the bartender over to speak with me. He was identified as Mr. Wai Tung ) of Massachusetts. Mr. Tung. was made aware of the operation and that he had sold alcohol to a minor without requesting identification. Mr: Tung stated that the minor walked up to him, asked for a drink and that he thought she was sitting at a table and served her a Bud-Light. Ms. Zheng was advised by me that. a report of the incident will be forwarded to the local liquor licensing board for a hearing due to the violation. At 8:30 pm Ms. entered Bertucci's Restaurant located at 45 Walkers Brook Drive. At 8:31 pm she exited the establishment. She stated that an identification was requested by the bartender and she left the establishment. At 8:31 pm Ms. CEMNIEW entered Longhorns Grill located at 39 Walkers Brook Drive. At 8:32 pm she exited the establishment. She stated that an identif'icati'on was requested by the bartender and she left the establishment. At 8:37 pm Ms: QNEWS entered Mandarin Restaurant located at 296 Salem St. At 8:37 pm she exited the establishment. She stated that an identification was requested by the bartender. Our main objective that evening was to check to make sure that retail liquor stores, veteran's clubs, and fraternal organizations were not selling alcohol to minors under 21 years of age and checking for valid forms of identification. READING POLICE DEPARTMENT INVESTIGATIVE ACTION REPORT NARRATIVE At or around 7:00pm we started our operation. We used Michael QMKIMM dob as our underage operative to conduct the compliazice'checks . did so voluntarily. Before beginning, we conducted a brief training for 9INIEft in which he was photographed and administered a portable breath test to check his sobriety in which he registered a BAC of 0. 0. We explained to IsEfflEa what we expected of him and he was given $20 cash from the department to use. was, checked before going into the establishments to make sure he did not have any identification or money. His wallet was left in our cruiser during the operation. Over the course of the next four hours we sent Vdl~ into Busa's Liquors at 345 Main St, Square Liquors at 11 High St, Northside Liquors 150 Main St, and The Wine Shop at 676 Main St. He was instructed to attempt to purchase a six pack of bud light beer. The Wine Bunker at 1 General Way closed at.8pm and we were unable to perform the check. - At or around 7:54pm NOMEM entered the-Wine Shop at 676 Main St and took a six pack of bud light cans to the check out counter. He stated that the female clerk engaged him in conversation asking him if he was a "Reading cop". She then stated that she would "put the, beers in a bag so the Reading Police wouldn't see him with the beers in the open". He paid $6.49 for the beers in cash and left the store and reported immediately back to.us"° stated that she never asked him for any identification. Detectives Iapicca and Saunders along with ONMEMS went back into the store and pointed out the clerk who served him to them. She was identified by the Detectives as Judith Kelly dob IN01M 03 MA.'They informed Kelly of the compliance checks qINNEIN and she stated that she sold to him because @MEMEEM engaged her in conversation about beers and wine and it confused her. stated to us that he never had any conversation with Kelly.. Kelly admitted to the detectives that.she never asked •for any identification. We also sent into the Reading Overseas Veterans club at 575 Main St, Knights of Columbus 11 Sanborn St, and the American Legion Post at 37 Ash St. He was instructed to attempt to purchase a single bud light beer. We. were unable to perform a check at the Meadow Brook Country Club at.292 Grove St as it was closed for the evening. Once inside he proceeded to the bar and ordered a Budweiser beer. He was served by the male bartender and stated that he paid $2.50 and then walked out and reported to us that he was served. Detectives Saunders, Iapicca and I along with SNUMOMh went inside the Knight of Columbus. pointed out the male bartender to us who served him and left. We proceeded over to the bartender and identified ourselves as Reading Police Officers and why we were there. The bartender identified himself as John Ferguson dob MEM MA. Ferguson stated to us that he did not ask for any identification and he should have. Further he stated that IMMIJEW never paid for the beer. Once outside we asked IMENISM again if he paid for the beer and he stated that he did. At the end of the operation 's picture was taken again and he was administered another breath test which showed his BAC to be 0.0. He also gave us the remaining money back from the initial $20 which was $11.01; $6:49 for the six pack at the Wine Shop and $2.50 for the single beer at the K of C. Efforts to make them appear older should be avoided. 3) A photo of underage person should be taken and attached to the information requested in #6. 4) The underage person should not be carrying any identification when taking part in the sting. 5) The underage person should not carry any money with. them other than that given by the Town of Reading Detective or Police Officer supervising them. 6) The underage person shall sign a release form prior the starting participation in this program. The underage person and the Town of Reading Detective or Police Officer or any other law enforcement officer should also sign and date a copy of these guidelines. 7) Unless circumstances warrant, the underage person shall be given a B.A.C test at the beginning and at the conclusion of the investigation. They should be informed of this prior to beginning.the investigation. 8) The underage person shall enter the licensed premises under observation by a Town of.Reading Detective or Police Officer.and/or a law enforcement officer. 9) The underage person shall attempt to purchase an alcoholic beverage. They should attempt to purchase the same alcoholic berverage at each location. 10) At no time shall the underage person attempt to misrepresent their age or provide any identification. 11) If asked for identification, the underage person should leave the. establishment. 12) If served at any on-premise establishment, the underage person shall remain on the licensed premises for a period of time instructed by the Town of Reading Detective or Police Officer. They should then exit the licenses premises leaving the alcoholic beverage. If served at an off-premises establishment, the underage person shall carry the alcoholic beverage out to the Town of Reading Detective or Police Officer and/or law enforcement officer. 13) At no time, under any circumstances, shall the underage person consume any alcoholic beverage. 14) The safety and welfare of all underage participants will be of the utmost importance to the Town of Reading Detective or Police Officer and law enforcement personnel. Underage persons shall not be exposed to any unusual, unnecessary or unreasonable risk. 15) The underage person will not wear, exhibit or carry any Town of Reading or law enforcement identification or falsely represent themselves as an employee of the Reading Police Department or any other law enforcement unit while participating in this program. They shall not under any circumstances carry a weapon. 16) Town of Reading Detective or Police Officers and law enforcement personnel should only enter the premises to observe on an as needed basis when circumstances warrant. 17) A Reading Police Officer will enter the, licensed premises after the sting, and notify the manager on duty of said compliance check.
