Administrative matters
® 292, Tickets went out in the mail for having unlicensed, dogs. There are a total of 330
unlicensed dogs in Reading.
Finance
® Three months of meals tax equaling $74,680.92 is scheduled for payment by end
of June - this is well above our FY12 budget of $150,000 for the whole year.
Public Safety
*The RCASA Youth Crew is looking for additional 14 year old to 18 year old members.

Public Works
® MWRA water interconnection with Stoneham - work this fall - completed summer
2012.
® National Grid gas line work on 4 streets - notices have gone to abutters
Construction proiects
® Causeway Road - Trees have been removed; RMLD will be starting pole relocation
this week, DPW has completed drain installation. Still need to meet with
administrator on site to discuss wetland line for filling status.
® Haverhill Street Water Main Proiect - Will receive bids for project the last week in
July. Will forward final application to MWRA zero interest loan after bids (MWRA's
requested method)
® Sidewalk contract - Contractor to start tomorrow correcting 2 driveway aprons
from previous work. Will start Imagination Station curb and sidewalk relocation
following Con Com request for determination
® Roadway Paving - Contractor designing mix, should submit designs for review in 2
weeks. Expected roadway work to commence mid July
® Gas Company gas main installation - Vine Street area: should finish main line
installation this week. To start services the following week.
® Memorial Park Culvert - DPW to clean sediment end of July to the beginning of

A RESOLUTION
Concerning African American Revolutionary War Patriots of
Reading, Massachusetts and the Proposed National Liberty Memorial
Whereas, Senator Joseph Lieberman of Connecticut and Senator Charles Grassley of Iowa have introduced S. 883, the National Liberty
-
Memorial Act, in the U.S. Senate which would provide for the construction of an entirely citizen-funded National Liberty
Memorial to African Americans of the Revolutionary War at a location in the monumental core of Washington, D.C.; and
Whereas, from 1775 to 1783, an estimated 5,000 to 10,000 slaves and free African Americans served as soldiers, marines and patriots in the
Revolutionary War in addition to tens of thousands of men, women and children who provided civilian assistance, ran away from
slavery and petitioned courts and legislatures for freedom; and
Whereas, more than 1,570 African from 194 of 351 municipalities and all 14 counties of Massachusetts Americans served in the
Revolutionary War ; including 10 African American soldiers and patriots from Reading who participated in the struggle for
independence; and
Whereas, beginning in 1984, landmark legislation was approved by Congress, including Public Law 98-245 commemorating African
American patriotism and Public Laws 99-558 and 100-265 which authorize a national memorial and declare the history of
rn African Americans in the Revolutionary War to be of "preeminent historical and lasting significance to the nation."
Whereas, these efforts over 24 years helped propel the publication in 2008 of Forgotten Patriots, Afi-scan Americana and American Indiana
Patriots in the Revolutionary War, which contains the most extensive list so far of African Americans in the Revolutionary War,
Now, therefore, be it resolved that the Board of Selectmen of the Town of Reading, Massachusetts joins the National Mall Liberty Fund,
D.C, the congressional sponsors and the original cosponsors of the National Liberty Memorial Act, including Rep. Donald Payne
of New Jersey and Rep. Frank Wolf of Virginia, and those. who applaud the decision of Congress and President Reagan in 1988 to
authorize a memorial commemorating these African American patriots at a site between the Washington Monument and Lincoln
Memorial

Section 3 .10 -Licenses for Utilizing Public Sidewalks for Outdoor IDinine
The Board of Selectmen desires to encourage restaurants to provide outdoor dining on
public sidewalks in the downtown area of Reading in a safe and orderly manner. These
regulations are adopted pursuant to Section 5.2.1 of the General Bylaws of the Town of Reading,
which provides in part that "No person shall place or cause to be placed any obstruction in any
street, public place or private way in the Town without permission of the Board of Selectmen...."
Outdoor dining on private property may be permitted in addition to or in lieu of outdoor
dining on a public sidewalk, upon site plan approval by the Community Planning and
Development Commission. This policy addresses only outdoor dining on public sidewalks.
The following regulations shall apply for licenses for utilizing public sidewalks for
.outdoor dining, or "Outdoor Dining Licenses":
Application
1. Each application will be dealt with on a case by case basis. These guidelines are not
intended. to be a full list of issues to be dealt with by the Board but are guidelines to the
Applicant.
2. Applications for Outdoor Dining Licenses utilizing public sidewalks shall ba made to the
Board of Selectmen by submission of an Application Form. The application will include
the name, address, email address, and telephone number of the owner of the building
within which the restaurant is located, proof of ownership, a lease, or written approval of
the property owner within which the restaurant is located (if other than the applicant) for
the use of the premises for the license period. The application shall be signed by the
owner of the restaurant and shall be accompanied by a copy of the current Permit to
Operate a Food Establishment issued by the Board of Health.
3. The application shall also include 10 copies of a professionally drawn plan and all
supporting documents containing the information required in order to be able, to make a
decision as to the license, and shall also include a plan for outdoor lighting if any is
proposed.
4. The License is revocable at will by the Town for any reason whatsoever upon written
notice to the Licensee from the Town. The License Agreement shall stipulate that in the
event of such revocation, the Licensee shall have no recourse or. claim against the Town
for such revocation whether by way of in charges, a suit in equity or otherwise.
5. Outdoor Dining Licenses shall be issued only to Inn-holders and Common Victualers for
portions of public sidewalks directly abutting their business, and will be issued only
within a commercial or industrial zoning district within the Town, unless such a business
shall exist and has pre-dated zoning, or has been granted a variance to do business in a
location that is not in a business or industrial zoning district.
6. Prior to the issuance of a license for outdoor dining on public sidewalks, the Board may
require a review by the Community Services Director, Health Services Administrator,
Police Chief, Fire Chief, Town Engineer, and the Building/Zoning Inspector and proof
that all necessary approvals, permits, and other licenses needed to operate have been
issued.

Sale and Service of Alcoholic Beverages
7. Pursuant to section 5.5.6 of the General Bylaws of the Town of Reading, the Board of
Selectmen may permit service and consumption of alcohol while on a public way.
Therefore, the Board of Selectmen may approve the modification of a plan of the
"licensed premises" pursuant to Section 3.2 of the Board of Selectmen policies, for-
• Restaurant Licenses to Expose, Keep for* Sale, and to Sell All Kinds of Alcoholic
Beverages to be Drunk on the Premises; and
Restaurant Licenses to Expose, Keep for Sale, and to Sell Wine and Malt Beverages
to be Drunk on the Premises (less than 100 seats)
to allow alcohol service and consumption on a sidewalk area as part of a "Licenses for
Utilizing Public Sidewalks for Outdoor Dining."
8. Applicants who hold an alcoholic beverages license and who elect to apply for an
Outdoor Dining License which would include sale and service of alcoholic beverages
shall provide a detailed alcohol control plan/strategy as part of their Outdoor Dining
License application packet. The alcohol control plan shall include what steps the manager
shall take to ensure that alcohol remains only on the licensed premises (including the
sidewalk area). Such a plan/strategy may include signage, staff instructions, monitoring of
the outdoor dining area, etc. The applicant shall also submit as part of the application
packet the alcohol server training certificates for all managers and servers of the
restaurant which is licensed to sell alcoholic beverages.
9. There shall be no service of alcohol in an outdoor dining area unless the customer also
orders food from the menu.
Standards for Operation
10. The area licensed for outdoor dining shall be limited to the sidewalk area immediately
abutting an establishment otherwise licensed as a "Common Victualer", and the licensee
shall limit the placement of seating and other outdoor furnishings to the sidewalk
immediately in front of the licensed establishment.
11. There shall be no bar or service bar located on the public sidewalk. All alcohol service
shall be limited to customers who are seated at a table.
12. Due to the seasonal and temporary nature of an outdoor dining area, the seating within an
outdoor dining area will not be considered an increase in the number of seats serving a
restaurant or eating establishment and will not be counted toward any off-street parking
requirement
13. Outdoor dining areas shall be considered as part of the restaurant and shall comply with
Board of Health Regulations. In addition to any other requirements, smoking is prohibited
in seasonal outdoor dining areas per Board of Health regulations.
14. The Board of Selectmen may require outdoor dining areas to be separated from their
surroundings by a temporary removable perimeter barrier. No such barriers may damage
the public sidewalk.
15. Perimeter treatments, umbrellas, furniture and trash receptacles shall be . supplied by the
applicant and shall be maintained in a safe and sanitary manner by the applicant. All
perimeter treatments, umbrellas, furniture and trash receptacles must be removed at the

end of each season.
16. The licensee shall provide, maintain, and empty as needed, outdoor trash receptacles
during the times that the licensed premises are open for business. All trash receptacles
shall be covered and trash removed nightly.
17. The licensee shall be responsible for keeping the portion of the sidewalk subject to an
Outdoor Dining License clean and free of dirt, dust, and other debris from April 15
through October 31 of each year. In addition, the Outdoor Dining Licensee shall be
responsible for preventing and/or cleaning up litter from the licensed establishment in
areas abutting the licensed premises.
18. In no event shall the placement of outdoor dining furniture, umbrellas, or perimeter
barriers create a pedestrian or wheelchair passage along the public sidewalk of less than
four feet in width. Restaurants shall have an accessible path of travel at least 36 inches
wide from the traveled portion of the public sidewalk to the doorway(s) of the
establishment through the outdoor dining area.
19. Outdoor food preparation shall not be allowed unless approved by the Board of Health in
accordance with their procedures and regulations.
20. The Outdoor Dining License shall be considered annually and every license shall expire
on December 31 of each year, subject to renewal. No facilities or furniture shall be
placed on the sidewalk as part of the license except for the period between April 15 and
October 31 of each year.
21. Within the period from April 15 to October 31, upon notification from the Department of
Public Works or from Public Safety personnel that weather conditions or work to be
performed on the property of the Town requires removal of the outdoor dining furniture,
the applicant shall immediately remove all of its property associated with the Outdoor
Dining License from the public property.
Administrative Requirements
22. If the license is. approved by the Board of Selectmen the owner and operator of the
restaurant shall sign a License Agreement and shall provide a required Certificate of
Insurance before issuance of the License and before commencement of any activities
under the License.
23. The. Licensee shall provide evidence of insurance as required by the Town Manager and
by State Statute. Such insurance shall cover the use of all equipment related to the
premises related to the Outdoor Dining License. The Comprehensive General Liability
Policy shall insure against all claims and demands for bodily injury and property damage
with respect to the sidewalk dining facilities and services, and the Town shall be named
as an "additional insured" in all policies of such insurance. If alcohol sale and service is
to be part of the outdoor dining license, a liquor liability insurance policy shall also be
required. The Licensee (and their heirs, successors and assigns in interest) shall hold
harmless, defend and indemnify the Town of Reading and its employees and agents from
any responsibility, liability and claims arising out of or related to the operations under the
Outdoor Dining License.
24. The Licensee shall comply with all applicable laws (including the sign portions of the
Zoning by-laws), rules, regulations, and conditions of other licenses and permits.

Selectmen
There is hereby created an ad hoc Committee to Review Amplified Sound on Public Property under the
Jurisdiction of the Board of'Selectmen (the ad hoc Committee), which shall exist until October 31, 2011 or
until such earlier.date the ad hoc Committee may have completed its work. The terms of ad hoc committee
members may be extended by the Board of Selectmen for up to an additional 3 months.
The ad hoc Committee shall consist of seven (7) residents of Reading for terms expiring October 31,
2011. In selecting the membership, an attempt will be made to fill the membership as follows:
o 2 members of the Board of Selectmen;
o 2 members appointed by the Recreation Committee from among their members;
o 3 Residents at Large appointed by the Board of Selectmen. The residents at large shall not be
members of the Recreation Committee or the Board of Selectmen, and at least one of the
members at large shall live within 300 feet of one of the following Public Parks, Playgrounds,
and Recreation Areas: Birch Meadow, Hunt Park, Longwood Place, Memorial Park, Sturgis
Park, Symonds Way, Washington Park, or school grounds that are used for public recreation.
The ad hoc Committee shall perform the following activities related to the issue of the use of amplified
sound in Public Parks, Playgrounds, and Recreation Areas under the jurisdiction of the Board of Selectmen
which:
I . Review and understand the scope of the charge to the ad hoc committee, and develop a work plan
and schedule;
2. Review and understand "Section 4-14 Rules and Regulations Relating to Public Parks,
Playgrounds, and Recreation Areas" of the Board of Selectmen Policies and Rules and regulations,
and especially to Section 4.143 Rule 3: "RULE 3. No person shall, on any public park,
playground, recreation or other area under the jurisdiction of the Recreation Committee in the
Town of Reading, solicit the acquaintance of or annoy another person or utter any profane,
threatening abusive or indecent language or loud outcry; or solicit any subscription or
contribution; or have possession of, or drink any alcoholic beverages as defined by Chapter 138,
Section 1, of* the General Laivs; or play any game of chance, or have possession of any instrument
of gambling; or make an oration or harangue or any political or other canvass; or preach or pray
aloud; or do any obscene or indecent act; or play any musical instrument or use any sound
amplifier, except by written authority fr°oin the Recreation Committee or their designee. (emphasis
added);
3. Reach out to Town Departments Boards/Committees/Commissions, volunteer athletic
organizations, and the community broadly (with particular emphasis on those who live in the
proximity of public parks, playgrounds, and recreation areas) that may have an interest in this
issue, and request their information and ideas;
4. Develop draft amendments to "Section 4-14 Rules and Regulations Relating to Public Parks,
Playgrounds, and Recreation Areas";
5. If amplified sound is recommended to be allowed in Public Parks, Playgrounds, and Recreation
Areas with a permit from the Recreation Committee, develop draft regulations or other guidance to

the Recreation Committee on the circumstances and manner in which amplified sound is to be
permitted;
6. Prepare a preliminary report on the issue of Amplified Sound on Public Property under the
Jurisdiction of the Board of Selectmen, and solicit public input on the preliminary report;
7. Submit the preliminary to the Board of Selectmen for their review and comment;
8. Based on review with the Board of Selectmen, finalize the report and submit it to the Board of
Selectmen;
Staff and Town Counsel will be assigned to work with the ad hoc Coininittee on Amplified Sound on
Public Property under the Jurisdiction of the Board of'Selectmen through the Town Manager. The ad hoc
Committee will be considered to be part of the Town Managers Office for administrative purposes.

Full disclosure - I am Rec. Committe member Kate Kaminer's husband. That said, it has nothing to
do with my thoughts on this issue. I'm sorry that I can't make tomorrow nights meeting.
I am writing as an abutter to a ballfield (Washington Park) and a 20 plus year participant in Reading
mens softball.
I'm adamantly opposed to allowing the amplified sound on a regular basis to a group of adults
predominantly from out of town. I can see it allowed in rare instances for a READING youth event
such as an all star game.
If you are going to allow amplified sound at Morton, why not allow it for READING mens softball?
But you know what; I don't think it should be because of the neighbors.
Yes, when I moved in 25 years ago, I knew that Washington park was there but I also knew there
were no lights and no sound system. Living with the games on weekends is one thing; living with the
games AND SOUND is another.
Allowing the amplified sound would set a bad precedence. If you allow it for this mens baseball.
team, how could you not allow it for all the Reading youth sports that take place within the Birch
Meadow complex?

We, as a community, need to have more fun and family events so Reading can be
a hometown
we can be proud to call our own. This is one way we can do that. We need to
support
the Reading Bulldog's and make them happy and proud to represent Reading.
We need to give back to them what they have been giving to us.
The decision to revoke their permit was not fair or done correctly and therefore,
the town should seriously consider reinstating their permit immediately for the
remainder of

Dear Mr. Fuedo:
I am writing as a Reading resident to comment on the continuing discussions regarding the rescinding of the
amplified sound permit for the Reading Bulldogs baseball organization at their games at Morton Field. I live at the
corner of Tower Road and Winthrop Avenue, which is within two blocks of the field. I mention this not to add my
voice as a complainant to the discussion (the intervening topography and houses diminish the noise levels
reaching my property) but to establish that I am a. resident of the affected area and I consider the original
petitioners my friends and neighbors. My family and I have lived there for 27 years.
The issue as I see it is a clash between the reasonable expectation of the Reading residents abutting the field to
enjoy the use of their property without undue disruption with a neighbor using their property for a purpose that by
its nature crosses property boundaries (i.e, broadcasting amplified sound). The latter neighbor in this case is the
Town of Reading acting as the landlord for Morton Field and is therefore responsible for the actions of its tenant,
the Reading Bulldogs. Bringing the complaint to the Town via the Recreation Committee and its authorizing
entity, the Board of Selectmen, is therefore the proper course to follow and should not be considered a "short-cut",
as has been suggested. Further, Vicky and Rick Shubert have as much right as any Reading resident to file a
complaint and ask for relief and they should not be vilified as "well-connected" insiders taking advantage of Rick's
position on the BOS to get what they want. The fact that they have pursued this complaint in a very public and
transparent manner (with Rick properly recusing himself from the BOS discussions and vote) shows how false

this assertion is. How else could they be expected to act? There were 32 signers to the original petition and
knowing many of them, they can hardly be described as blind followers of the Schuberts' lead. It's a
neighborhood complaint, not a Selectman's. Focusing on the Schuberts here is wrong and (in my opinion) a
shameful display of small-mindedness.
Speaking to the noise issue itself, I feel it is a matter of degree. As with any "noisy neighbor" problem,
establishing decibel levels and times of play that are agreeable to both property owners would appear to be a
reasonable compromise. Just as times and noise levels are limited by the Town for construction activities (the
comparison is apt), so too could the time and sound levels of the Bulldogs' sound system broadcasting be
curtailed to allow the abutting Reading residents to enjoy the use of their property during the Bulldogs' exercise of
their lease of Morton Field. Perhaps a "trial and error" event could be organized with the abutters and the
Bulldogs wherein a decibel level that is acceptable could be established and reasonable times of broadcasting
could be established by mutual consent. I recommend that the Recreation Committee be the organizer of such
an event and that a formal report be made to the BOS on the outcome of it. If no compromise is possible,
rescinding of the broadcasting permit would then be the only solution possible, in my opinion.
I am copying this correspondence to the BOS via the Town Manager in order to serve as background material for
the upcoming discussion of the subject on Tuesday, June 21St (agenda item 5e). It has been my intention to be
constructive with this e-mail and I hope the upcoming discussion will be undertaken with cool heads and an
avoidance of useless hyperbole. I feel my friends and neighbors two blocks away are due at least that courtesy.

15.Complete evaluation of regionalization of Public Safety Dispatch Reading is part of multi-community effort that is currently
exploring the feasibility of providing a regional 9-1-1 dispatch center. We have completed the-second phase of the
project which was to develop a detailed feasibility and information plan for establishing a Regional Emergency
Communications Center to serve the city of Melrose and the Towns of Reading, Stoneham and Wakefield as well as the
Middlesex Sheriff's Office (MSO) Phase III is underway and includes a grant request through the State 9-1-1 Department
and the filing of enabling legislation These items are complete and we expect to receive information on our grant
request in the fall
16. Focus public health School Substance Abuse and other resources on a Healthy Community model with an initial focus on
obesity prevention as one of the maior health crises facing our country. Find ways to encourage walking, cycling, and other
activities These efforts may involve many departments with efforts led by the Health Division.

Some feedback from another Reading taxpayer.
When you buy a home adjacent to Reading parks and fields, please don't ask for "peace and
quiet". If I heard Vicki Schubert say "peace & quiet" one more time I was going to throw
something at the television. Who is she to decide what the 'character' of Reading should or should
not be?

We have a lot more families, a lot more kids in Reading than we did 10-20 years ago. And when
you have kids, you have NOISE. Just how loud is this amplified sound anyway? While Peter H. and
the BOS may have been within their legal right to reverse the Rec Committee's permit allowing the
speakers, they stepped way outside the appropriate bounds of how this issue should have been
addressed in a democratic process.
I don't even like baseball, but I think the Reading Bulldogs organization is a GREAT thing for the
town and makes for a lot of FUN FUN FUN, for a whole lot of people in town, especially kids.

insufficient notice for Reading Bulldogs management to attend or provide credible responses to
petitioner's claims;
Given that petitioner complaints shown to be unrelated .to the Bulldogs activities were used in
