3a) This is the annual Arbor Day Proclamation which, in addition to the sentiments in the
proclamation, makes the Town eligible for continued recognition as a Tree City USA.
4a) There is one applicant for the Community Planning and Development Commission and
the VASC will interview the applicant prior to the Board's meeting.
4b) There are additional applicants for the Fall Street Faire Committee and. the VASC will
meet prior to the meeting on Tuesday to interview the applicants.
5a) At the Board's suggestion when the Clergy Association presented to the Board,
representatives from the Reading Food Pantry will be in to review the function of the
Food Pantry and how it operates.
5b) The Town Forest Committee will appear before the Board with a progress report of
where they are in their various activities.
5c) Pulte Homes has a proposed monitoring agent which needs to be approved by the Board
of Selectmen. The resume of the monitoring agent is in your packet, and she will be
present at the Board's meeting.
5d) Affordable Housing Allocation Trust Fund Plan - This matter is before Town Meeting
under Article 24 which will probably be taken up Thursday evening. Since we have not
done an affordable housing allocation trust fund plan in the, past, this document took a
little bit of time to create. This was assisted by Town Counsel, the Community Services
Director, and Finance Director.

5e) The Finance Director and DPW staff will be reviewing proposed utility rates. This will
then be subject to a public hearing on the utility rates on May 10, 2011.
5f) Staff is working on a memo to review the options of making changes to the Aquifer
Protection District of the Zoning Bylaws. There are a number of factors that limit the
ability to make changes, and staff will have a complete review for you for Tuesday night.
5g) Bob LeLacheur has information for approving sale of debt for the Green Repairs Program
so that this project can get underway as quickly as possible. The work needs to be
completed by the end of the summer.
8a) After consultation with Steve Goldy last week, there is need for an Executive Session as
noted. Materials are in your packet.

I am an employee at Laschi Hairstylists (150 Main St)
Last Thursday one of our clients had an accendent out front, well I
was the first one outside to see if she was ok, but before I ran
out the door I yelled "call.911" I had just opened her car door
to ask how she was and responders were pulling in. I and a 'few
others were amazed at how quick everyone got there. Everyone that
showed up from police/fire/ambulance was,very quick and helpful.- I
am sending this message because the men/women who serve this town
probably don't get much thank you's...... so THANK YOU!
ps... our little.lady ended up just fine and still got to get her
hair done!

While we are looking forward to sidewalks on Washington Street we are very disappointed that the
current plan does not include a grassy strip between the sidewalks and the road. There are several
items we would like to address in regards to this matter.
1) The current plan calls for a 5.5 foot concrete sidewalk plus a 6 inch curb with no grass. 5.5 feet
well exceeds code which I believe is 3.5 feet. With 6 driveways along Washington Street there is
ample room for a wheelchair to pull over or turn about.. Therefore, this width seems excessive.
2) Aesthetically this sidewalk will not 'match' the other sidewalks on quiet residential streets in
Reading, including the recently improved sidewalks just down the street at Washington Street
Park, as well as those on Temple Street, which are also part of this same 'safe walk to school'
sidewalk project.
3) A six foot stretch of concrete extending from the street that has no greens space will be
unattractive, take away neighborhood "curb appeal", and therefore likely hurt property value.
4) The town engineer made a point that the standard in Reading is a 3 foot grassy strip. The
rational is that anything less than 3 feet is not maintained. I strongly disagree with this
especially given the level of care that the residents of Washington Street display in maintaining
their properties, lawns and gardens.
® Note: Two years ago the Town put in a sidewalk at the intersection of Washington and
Prescott Street and improved the ramps and pedestrian walkways as a safety
enhancement. At this time they DID include a grassy strip, which is not 3 feet. I am
curious what happened in the last two years that the standard for sidewalks in Reading
has changed.
5) At the public meeting the Town Engineer made reference when talking about the beautiful
sidewalks on Temple Street that they went forward with a narrower grassy strip because they
were replacing existing sidewalks on that street. Directly across from my house are two lots
with sidewalks that currently have grassy strips. On the west side of the street there is only one
house with a sidewalk that does not have a grassy strip; on the East side of the street there are
three houses with sidewalks that have grassy strips; therefore the precedent on Washington
Street is to have a grassy strip. Removing these sidewalks with grassy strips seems to contradict
the rational used to design the Temple Street sidewalks.
6) The lack of a grassy strip is suggestive of a main road or a commercial area. In Reading you see
these on Lowell Street and in the downtown area. The traffic load and the character of
Washington Street are much different than those streets. Washington Street is a quiet
residential Street where children play ball in the middle of the street, neighbors talk across the
street at one another. This is not a commercial area that warrants a 'concrete jungle'.
7) The residents on Washington Street (on either side of the street) simply want the sidewalks to
incorporate green space.
This sidewalk project has the potential to add a significant amount of value to both Washington Street
and the Town of Reading. We urge you to take this opportunity to ensure that we do this project
correctly and truly make this an enhancement and not a $350,000 eyesore

and Arbor Day is now observed throughout the nation and the world; and
Whereas, trees reduce the erosion of our precious topsoil by wind and water, cut heating and cooling costs, moderate the
temperature, clean the air, produce oxygen and provide habitat for wildlife; and
Whereas, trees are a renewable resource giving us paper, wood for our homes, fuel for our fires and countless other wood
products; and
Whereas, trees in our Town increase property values, enhance the economic vitality of business areas, beautify our
community, and wherever they are planted are a source of joy and spiritual renewal; and
Whereas, Reading has been recognized as a Tree City, U.S.A. by the National Arbor Day Foundation for over 25 years,
and desires to continue its tree-planting ways.
Now, therefore, we, the Board of Selectmen of the Town of Reading, Massachusetts do hereby proclaim April 29, 2011 as Arbor.
Day in the Town of Reading and urge all citizens to celebrate Arbor Day and to support efforts to protect our
trees and woodlands, and plant trees to gladden the heart and promote the well being of this and future
generations.

Request for Approval of Affordable Monitoring Agent
Dear Board Members and Peter,
In accordance with Zoning By-Law Section 4.11 A 0.7.1 and Condition #4 of the CPDC
Site Plan Approval issued for Reading Woods, we hereby request the Board of
Selectmen formally designate and approve JWO Consultant Services, Ms. Jill W.
Onderdonk as Administering Agent / Affordable Housing Monitoring Agent.
The Reading Housing Authority was contacted about acting as the Administering Agent
/ Affordable Housing Monitoring Agent; however, our understanding is that they were
unable to accept the appointment given the size of the Project and limited resources.
Email correspondence I received from Abby McCabe on 2/1/11 is attached.
Jill Onderdonk and her firm JWO Consultant Services is a highly qualified entity with
considerable affordable housing experience and is well versed in DHCD regulations and
requirements. Jill's resume detailing her affordable housing experience is attached for
your review.
Once appointed, the Monitoring Agent will monitor and enforce compliance with the
affordable housing provisions of the Town's Zoning Bylaw which DHCD approved
pursuant to Chapter 40R. In accordance with DHCD regulations, the costs of the
Monitoring Agent will be borne by the Developer. It is now time to get a monitoring
agent selected for Reading Woods.

We have contacted the Reading Housing Authority about acting as the affordable housing administrating /monitoring
agency but they are unable to do this given the size of the project and limited resources at this time. Are there any other
agencies that Pulte has worked with in the past? A few years ago North Reading adopted a 40R smart growth district and
used SEB, LLC in Brighton http://www.s-e-b.com/index.php. They may be a possibility since they are familiar with the 4011
guidelines and have worked in the area.

AFFORDABLE HOUSING TRUST FUND - ALLOCATION PLAN
Overview:. An Affordable Housing Trust Fund (AHTF) was established through a Home Rule
Petition and an act of the legislature authorizing Chapter 140 of the Actsmf 2001. Despite several
attempts, no funds have been expended out of the AHTF. The AHT17,49 a dedicated fund to create
or preserve, affordable housing. This can be through developmeff~ of new or rehabilitation of
existing dwelling units for purchase or for rent by persons of low~end `mo.0erate income.
Funds deposited to the AHTF came from payments receive~y the Town>~~or things ranging from
sub-divisions that were improperly built, to affordable hotusIrgp units that cauldnot be preserved
and were converted and sold as market units with the,e.affference in price reveffiff o the Town.

that the money will be used in accordance with the purpose of the AHTF that is, to support
affordable housing and, in the event of a default (e.g., selling the property before it's built)
then the Town will be protected by these legal documents which will trigger repayment in
the event of default.

The $400,000 DPL request is based on Oaktree's Project Financials which reflect the need
for these funds to fill an existing financing gap.
An independent review, has been undertaken by a housing consultant Housing Partners
Inc. (HPI) of the project financials and market analysis. HPI's conclusion was that the
financial assumptions.and market analysis are reasonable. HPI further concluded that as
the first project proposed under the provisions of the Downtown Smart Growth Zoning
District and the first residential project to be developed in downtown Reading in several
decades, a public contribution would not be inappropriate. Benefits to the Town of Reading of this first Downtown SmatTOG!r`kovu ,h project include:

Dear Mr. Hechenbleikner:
I am pleased to report that the Board of the Massachusetts School Building Authority
("MSBA") voted to approve the Proposed Green Repair Project ("Proposed Project") for
the Town of Reading to replace the windows at the Birch Meadow Elementary School
and the roof at the J. Warren K.illam Elementary School.
The Board approved a total estimated maximum grant of $984,448 for the Proposed
Project, with individual maximum grant amounts for each of the two projects referenced
above. The final grant amount for each of the two projects will be determined by the
MSBA based on a review and audit of all project costs incurred by the District, in
accordance with the MSBA's regulations, policies, and guidelines. The final total
combined grant.amount for the two projects may be an amount less than $984,448.
Pursuant to the terms of the MSBA's Green Repair Program, the District has 90 days to
acquire and certify local approval for an appropriation and all other necessary local votes
or approvals showing acceptance of the cost, type, scope and timeline for the Proposed
Project. Upon receipt of the certified votes demonstrating local approval, the MSBA and
the District will execute a Project Funding Agreement which will set forth the terms and
conditions pursuant to which the District will receive its grant from the MSBA. Once the
Project Funding Agreement has been executed by both parties, the District will be
eligible to submit requests for reimbursement for Proposed Project costs to the MSBA.
We will be contacting you soon to discuss these next steps in more detail, but in the
meantime, I wanted to share with you the Board's approval of the Proposed Project for
the Town of Reading to replace the windows at the Birch Meadow Elementary School

Reports and Comments
Selectmen's Liaison Reports and, Comments - Jimmy Houston noted that there was an Arts Fest
going on at the High School tonight; Joshua Eaton was having open house tonight; the RCASA
is holding their RCASA Applauds Parents series tonight; the girls varsity game is tomorrow and
the girls lacrosse game is tomorrow. The recycling program he is working on is moving along
nicely with a big turn in of recycling.
Stephen Goldy noted that he had the office hour tonight and there was a discussion' regarding
Article 21. Also, he met with the Town Manager and Clear Channel regarding potential revenue
to the Town.
Camille Anthony requested an updated list of double poles. She also asked what was being done
about the water problem at Tennyson Road and Whittier Road. The Town Manager noted that
catch basins are being installed. Camille Anthony noted that the grand opening of the Mattera
Cabin is April 30, from 10:00 a.m. to 12 noon.
Ben Tafoya thanked the residents for his re-election. He also noted that the anonymous email
that was circulated regarding the school election was not in the tradition of Reading and he is
concerned about that behavior.
Public Comment - Jacob Berman, 54 Longview Road, not that he lives near West Street and
the residents don't shovel their sidewalks. He noted this is a safety hazard for the children. He

belongs to the Cub Scouts and they could help people who are not able to shove their sidewalks.
He also noted that shoveling is a great form of exercise.
Town Managers Report - The Town Manager gave the following report:

He has given the Board of Selectmen a summary of what municipal funds have been
spent on the Mattera cabin to date.

Calereso's has started their demo work getting ready for construction of their new facility

® The MWRA water line construction will begin in August.
® The Town has saved $56,000 in trash tipping fees so far this year.
Assistant Town Manager Report - The Assistant Town Manager noted that the Finance
Committee made some changes to the proposed FY12 budget. including adding $18,000 to the
Library and adding $6,300 to the Community Services Department to, add :benefits for the
positions being reduced.
Proclamation/Certificates of Appreciation
Proclamation - Public Safety Telecommunicator's Week - Police Chief James Cormier and Fire
Chief Greg Burns were present to receive the proclamation on behalf of the Dispatchers.
A motion by Tafoya seconded by Goldy to approve the proclamation for Public Safety
Telecom municator's Week, was approved by a vote of 3-0-0.
Personnel and Appointments
Appointments - Fall Street Faire Committee - A motion by Goldy seconded by Tafoya to
accept the report of the Volunteer Appointment Subcommittee and confirm the following
appointments to the following Committee:

Sheila Clarke for a position on the Fall Street_ Faire Committee with a term

The motion was approved by a vote of 3-0-0.
Discussion/action Items
Chamber of Commerce Re: Buy Local Program - Irene Collins and John Murphy from the
Chamber of Commerce were present.
Irene Collins noted that the Chamber is producing a guide to promote buying locally and it will
be mailed to Reading and North Reading residents. They will promote buying local weekends
using the "Shop the Block" model and they hope to partner with the Economic Development
Committee and reach out at the Fall Street Faire. She also noted that there will be a business
expo on May 4 at the Woburn Hilton and it costs $20 for admission.
Bertucci's Change of Officer - The Town Manager noted that the change of officer is being done
system wide and has already been approved by the ABCC.
_A motion by Goldy seconded by Tafoya to approve the application for a new
officer/director for Bertucci's Restaurant Corp., 45 Walkers Brook Drive, was approved by
a vote of 3-0-0.
Bertucci's Change of Plan. - Outdoor Dining - Michael Bonnell, Manager of Bertucci's was
present. The Town Manager noted that the change in plan is to expand the outdoor seating from
five tables to seven.
A motion by Goldy seconded by Tafoya to approve the change in plan for outdoor dining
for Bertucci's Restaurant Corp., 45 Walkers Brook Drive as shown on plan A2 date issued
on March 16, 2011, was approved by a vote of 3-0-0.
Hearing - Pondview Lane Street Acceptance - The Secretary read the hearing notice. The Town
Manager doted that this is on the Town Meeting Warrant. A letter from Don McNeice, 33
Pondview Lane, was received indicating the Town should be aware of cracking in the sidewalk
and sinkholes on the grass strip and a small portion of the street.
Town Engineer George Zambouras noted that the project was completed in 2004 - 2005 and the
Town received the as built plans this year. In reference to Don McNeice's letter, the settlement
in the sidewalk and crack near the curb look like a utility crew backed onto it and caused the
damage. He has sent a letter to the developer asking for the damage to be repaired. The Town
Manager noted he anticipates the repairs will be made before Town Meeting.
A motion by Goldy seconded by Tafoya to close the hearing on accepting Pondview Lane as
a public way was approved by a vote of 3-0-0.

A motion by Goldy seconded by Tafoya for the Board of Selectmen, to approve the
acceptance of Pondview Lane as a public way was approved by a vote of 3-0-0..
Conservation Commission Review Process - Conservation Commission member Jamie
Maughan was present. He noted the Board has been given an outline of what the Conservation
Commission wants to do. The intent is to find out resident concerns and identify a way to make
the process simpler. The plan is to form an ad hoc committee consisting of Iwo or three
members of the Conservation Commission, former members of the Conservation Commission
and Commissioners from other Towns, They will send questionnaires to interested parties to get
input on how to make the regulations simpler. They feel that 54 pages of regulations can be
reduced to 6 -10 pages.
.Ben Tafoya asked why they want Commissioners from other towns and Jamie Maughan noted
because they are familiar with the terms and wouldn't have a conflict regarding the potential for
appearing before the Commission.
The consensus of the Board was for the Conservation Commission to proceed as outlined.
Review Warrant.- Annual Town Meeting - The Town Manager noted that Article 21 is the issue
of whether to require property owners to clear their sidewalks which is commonly done across
the country. He noted that the budget is stretched and positions are being cut. The proposed
Bylaw would require residential property owners to clear snow within eight hours of a snow fall
and commercial owners within three hours. There would be fines and penalties but the intent is
to get compliance, not raise money.
Ben Tafoya asked how much we spend on plowing the, sidewalks. The Town Manager noted
that we spent $40,000 this winter. The DPW needs the equipment to widen the roads instead of
clearing sidewalks. Ben Tafoya suggested dealing with the costs another way and to table this
article at Town Meeting.
Stephen Goldy suggested postponing the Article indefinitely to allow for discussion.
Camille Anthony noted that obesity is a problem and this would get people moving. She also
noted that walking in this community is very difficult in the wintertime.
Stephen Goldy asked about liability and Town Counsel Ellen Doucette noted that the current
case law has to do with natural and unnatural accumulation. The Town is not responsible unless
there is a defect underneath.
A motion by Tafoya seconded by Goldy that the Board of Selectmen vote to recommend
indefinitely postponing Article 21 of the Annual Town Meeting Warrant was approved by
a vote of 3-0-0.

A resident from 36 Whittier Road noted that his sidewalk is in such bad condition that when he
used his snow blower it broke. He noted that the sidewalks are in disrepair and when he did
plow them, his neighbors didn't.
Sally Hoyt noted that she is opposed to the proposed Bylaw. She noted that the only exemptions
are citizens who are in poor health or don't have adequate financial means. She suggested
charging a small fee to shovel the sidewalks.
Tony Rickley from Precinct 2 noted he lives on Timberneck Drive and the'Town plows the snow
onto the 'sidewalks. He is going to be 90 years old'and will not shovel. He is willing to pay for
an override. He also noted that the Town has been plowing the route to the Pearl Street School
and it is no longer a school.
Frank Coleman from Randall Road noted that he. is not in favor of an override. He noted his
snow blower is not able to7clear the slush and ice that covers the sidewalks. He noted the
problern is not what falls from the sky; it is what's placed there by DPW.
Margaret Wass, 21 Eastway, noted she cannot shovel through what the Town plows put on the
sidewalk.
Mark Ventura, 142 Belmont Street passed out pictures showing .the amount of snow that the
DPW places in front of his house. He noted the sidewalks are in disrepair.
James Goldsmith from Eastway noted he does not own a snow blower. He feels this is an ill
conceived Article and asked why the fine is $25.
A Forest Street resident noted that she had to drive her son to school every day though he usually
would have walked.
John Sullivan from Haverhill Street noted that the snow in unmovable. He noted he couldn't
even clear the fire hydrant.
Lucy Intinti, 150 Village Street, noted that every plow goes by her house on the way to the Town
barn. All the snow on John Street ends up on her property.
Bobbi Botticelli, from Chapel Hill Drive, suggested charging $5 per household to cover the cost
of the Town plowing the sidewalks.
David Mancuso of Making Reading Better indicated it is their desire to stop the trend of punitive
Bylaws. He feels it is not fair to selectively isolate a few residents.
Fred. Van Magness thanked the Board for the process this evening and thanked everyone for
coming out.
Ben Tafoya asked Town Counsel Ellen Doucette about Article 24 and she noted that in order to
use this money for housing there has to be an allocation plan approved by Town Meeting.

The Town Manager noted that Town Counsel feels the petitions are not drafted correctly and
each street has a little problem so those Articles will be postponed.
The Town Manager suggested that the Board meet on at 6:30 p.m. on April 25 to vote on the
remainder of the Articles before Town Meeting.

Gentlemen,
I am pleased to inform you that I have authorized District Local Technical Assistance (DLTA)
funding for a transit vision for the Main Street Corridor from Reading Depot to Oak Grove, as
outlined in the project proposal you submitted to MAPC on January 31, 2011. Planning for
appropriate land uses, changes to regulations, and improvements to public infrastructure that
support alternative modes of transportation are critical elements of iniplementating MetroFuture,
our regional plan. We are very pleased, therefore, to fund this worthy project.
In order to move forward, I have directed my staff to work with you to finalize a scope of work for
this project (including a budget not to exceed $25,000), with a timeline that sets a completion no
later than December 31, 2011. Assuming that a satisfactory scope and timeline can be worked out,
this project will then be able to proceed.
We will be working with you at appropriate times during the process to provide information on
this project to the media. Once the project scope is completed, members of the MAPC
communications team will be in touch with you to discuss media opportunities. When the timing
for press is appropriate, we will be looking for quotes from community leaders related to this

I received your inquiry regarding the Reading Police Department's ("R-PD")
ability to continue its noncriminal enforcement of Section 4.3 of the Town of Reading
Board of Health's Dumpster Regulations in light of M.G.L. c.l 11, §31A which provides
in relevant part that; "no rules or regulations shall restrict the hours of the day when
garbage, offal or other offensive substances may be collected in areas zoned for business,
commercial or industrial use."

. Chapter 111, §31A clearly limits the scope of that portion of. Section 4.3 which
prohibit the emptying of dumpsters between the hours of 11:00 p.m. and 6:30 a.m. at
businesses located within an area zoned for business, commercial or industrial use.
Section 31A does not however, prohibit the RPD from enforcing noise complaints arising
out of the filling of dumpsters between those stated hours.
With respect to identifying those "areas zoned for business, commercial or
industrial use", please be advised that such areas are defined on the official Zoning Map
of the Town of Reading which is available at the Town Clerk and Community
Development and Planning offices. As an aid to future enforcement of Section 4.3
violations, it may be helpful to coordinate with the Board of Health to create a list of the
businesses with dumpsters noting thereon the zoning district in which each business is
located.

In addition, there are businesses in the Town of Reading which operate pursuant
to specific zoning approvals. In most if not all cases, zoning approvals contain specific
conditions regarding the hours during which dumpsters may be emptied. This is a
separate issue, and the violation of a condition for zoning approval that limit the hours
during which a dumpster may be emptied, should be referred to the Building Inspector
for zoning enforcement.

On Saturday, April 9, 20111 visited the Reading Public Library and was disturbed to find what I consider
.political propaganda in, the area adjacent to the entrance. This propaganda was promoting a proposal
to expand the library and thereby eliminating the grassy hill that abuts School Street. 1 was further
disturbed to witness a library, trustee opining in favor of the expansion, while explaining the detailed
drawings shown on the display boards.
I and other residents of School Street.askthat this display be removed from the library immediately and
that trustees while acting on the behalf of the library itself refrain from providing opinion to the merits
of this proposal. These trustees represent an asset of the Town of Reading. This asset exists for the
benefit of all Reading Residents not just the select few that believe this project is best for the library, the
neighborhood and most importantly the Town of Reading.
Finally, I and other residents of School Street ask that you refrain from using library, space to meet,
.promote, or otherwise attempt to advance the cause of adding to the library. We however, would agree
to allow the use of library meeting space, if you would agree to grant our cause the same courtesy.

At the June 8, 1998 RMLD Board meeting, the Board moved that with regard to transfers from
the return on investment to the Town of Reading, a benchmark payment of $1,560,414 be
established, and that in subsequent years the payment will be adjusted by the Consumer's Price
Index (CPT) for the previous calendar year. (See attached RMLD Board Minutes 6/8/98.) This
motion was based on the recommendations of the Subcommittee for the Payment to the Town of
Reading and the CAB. Attached also is a table showing the history of the payments since the
formula was approved.
The Boston Region CPI (Boston-Brockton-Nashua) for the calendar year 2010 is 1.6% as shown
on the attached tables. The increase results in a FY2012 Reading Town Payment of $2,205,957,

On behalf of the Commonwealth of Massachusetts Fire Service Commission it is our distinct
pleasure to inform you that Chief Gregory J. Burns has voluntarily participated in a Fire Chief
Credentialing process administered by the Massachusetts Fire Service Commission, a
gubernatorial appointed board that has established a process for uniform credentialing for fire
chiefs.
During this process Chief Burns had to submit documentation to the Fire Service Commission;
these documents included a resume that identified the years of service, his progression within the
fire service structure to the position of Head of the Fire Department, attendance at training and/or
professional development courses provided through both state and nationally recognized fire
service educational organizations, formal education accomplishments and participation in a state
and/or national certification program. With this and other information submitted, the
Massachusetts Fire Service Commission applied the information into a scoring matrix that
assigned a point value to the various levels of accomplishment submitted by the candidate.
When a candidate's score reached or exceeded the minimum level established, the applicant was
awarded credentialing at the level of "Fire Chief This level signifies that the applicant has
strived to obtain the specialized knowledge and competencies necessary to be an effective fire
service leader.
In order for the Fire Chief to keep his accreditation valid, he must participate in a recurring
training/professional development program approved by the Fire Service Commission and
submit proof of completion every three years.
