A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen
Redmond, Commissioner of Buildings.
Case # 10-16
A Continuation of a Public Hearing on the petition of Gibraltar Pools Corporation (James
Yoshizawa) who seeks a Variance under Section 4.8 / 4.8.6.1.9 / 4.8.6.1.10 of the zoning bylaws
in order to install an above-ground pool on the property located at 64 Dividence Road in
Reading, MA. This property is located in an Aquifer Protection District. The proposed pool
increases the lot coverage from 22.73% to 26.07%0. Maximum lot coverage of 20% is allowed if
an acceptable recharge system is installed.
Jack Sullivan of Sullivan Engineering presented a revised plot of land including two proposed
recharge systems to bring the installation into compliance with the requirements for effective lot
coverage. He also addressed the criteria for the granting of a Variance. A,memo from the Town
Engineer was submitted recommending any relief from the zoning regulations should include the
requirements stated in his memo. Letter from two abutters were submitted stating their approval
of the proposed pool.
On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals
moved to grant the Applicant a Variance from Section 4.8.6.1 of the zoning bylaws in order to
permit the installation of an above-ground pool on the property conditioned upon the following:
1. During installation of the proposed recharge system, should the underlying soils be
determined to differ than those indicated in the soil test pits, the system shall be
redesigned and submitted to the Engineering Division for review and approval.
2. An as-built of the completed recharge system shall be submitted to the Engineering
Division.

3. , The contractor shall be required to obtain a "Jackie's Law" excavation permit prior to any
excavations.
4. The owner shall arrange an inspection of the recharge chambers yearly to verify proper
operation. Copies of system inspections shall be submitted to the Engineering Division
yearly by January 15tH
5. In the event the system is found to be functioning improperly, the applicable components
of the recharge system shall be repaired or replaced within 90 days. All repair or
replacement work shall be inspected by the Engineering Division.
Vote was 5-0-0 (Petschek, Caouette, Redfern, Jarema, Perkins).

On a motion by Jeffrey Perkins, seconded by John Jarema, the Zoning Board of Appeals moved
to approve the minutes of February 17, 2011 with changes.
The vote was 6-0-0 (Redfern, Perkins, Petschek, Miles, Caouette, Jarema).
On a motion by Damase Caouette, seconded by Jeffrey Perkins, the Zoning Board of Appeals
moved to approve the minutes of March 3, 2011.
The vote was 6-0-0 (Redfern, Perkins, Petschek, Miles, Caouette, Jarema).
Adjournment
On a motion by Jeffrey Perkins, seconded by Robert Redfern, the Zoning Board of Appeals
moved to adjourn the meeting.
