HomeMy WebLinkAbout2011-03-03 Zoning Board of Appeals Minutes1W f~ CL~~ ~ Town of Reading ZONING BOARD OF APPEALS Minutes of March 3, 2011 Members Present: Clark Petschek, Chairman Robert Redfern John Jarema Jeffrey Perkins Damase Caouette Members Absent: John Miles Kristin Cataldo A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Case # 11-04 A Public Hearing on the petition of Dennis A. Lee who sought a Special Permit under Section(s) 6.3.6 of the zoning bylaws in order to add a second level to a non-conforming structure on the property located at 6 Wood End Lane in Reading, MA. The proposed 2'0" floor overhang encroaches into the left sideline setback. 15'0 is required. Terry Shaw, contractor, spoke on behalf of Mr. & Mrs. Lee. He reviewed the proposed plan for the Board. The proposed addition will not be any closer to the side lot line than the existing structure and the addition is going on the main box of the footprint. They will be extending the existing non-conformity but not increasing the non-conformity or creating a new non- conformity. The Board discussed the recent revisions to the bylaws and how certain new provisions contradict each other. The Board determined that Section 6.3.6 of the bylaws was the provision under which the Lee's petition should be considered. On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals voted unanimously to grant the Applicant's request for a Special Permit under section 6.3.6 of the zoning bylaws to permit the second-story addition to the existing non-conforming dwelling on a non-conforming lot at 6 Wood End Lane, Reading, MA The Special Permit was conditioned upon the following: 1. The Applicant's final construction plans for the new second-story addition shall be submitted prior to the issuance of a Building Permit. V ZBA Meeting, March 3, 2011 2. As-built plans showing the completed construction of the addition shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. The vote was 5-0-0 (Petschek, Jarema, Redfern, Caouette, Perkins). Adjournment On a motion by Jeffrey Perkins, seconded by Damase Caouette, the Zoning Board of Appeals voted unanimously to adjourn.
