HomeMy WebLinkAbout2010-12-02 Zoning Board of Appeals Minutes~OW~J ~iE21< Town of Reading ZONING BOARD OF APPEALS Minutes of December 2, 2010 25 Members Present: Clark Petschek, Chairman John Jarema Jeffrey Perkins Robert Redfern Kristin Cataldo Damase Caouette Members Absent: John Miles A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M.. Case # 10-05 Continuation of a Public Hearing on the petition of Jiffy Lube (Back Bay Sign) who seeks a r Variance under Section 6.2.3.2.1 of the zoning bylaws in order to allow Jiffy Lube one free- standing sign and two wall signs (current bylaws allow one free-standing sign or one wall sign) for the property located at 369 Main Street in Reading, MA. On a motion by John Jarema, seconded by Robert Redfern, the Zoning Board of Appeals moved to continue the hearing to January 6, 2011 at the written request of the Applicant. The vote was 5-0-0 (Petschek, Perkins, Jarema, Redfern, Caouette). Case # 10-16 Continuation of a Public Hearing on the petition of Gibraltar Pools Corporation (James Yoshizawa) who seeks a Variance under Section 4.8 / 4.8.6.1.9 / 4.8.6.1.10 of the zoning bylaws in order to install an above-ground pool on the property located at 64 Dividence Road in Reading, MA. This property is located in an Aquifer Protection District. The proposed pool increases the lot coverage from 22.73% to 26.07%. Maximum lot coverage of 20% is allowed if an acceptable recharge system is installed. Jay Henshaw of Gibraltar Pools reviewed his proposal for the Board. The above-ground pool will increase the, lot coverage but he plans on installing a recharge system that will decrease the lot coverage to 15%. He said the Town Engineer approved the plan although there were no reports from the Town Engineer submitted to the Board. Mr. Henshaw also said the Building A/ ZBA Meeting, December 2, 2011 1 Inspector had to deny the building permit application due to the increase in the maximum lot coverage. The Board questioned the setback of 6' from the lot line and the final maximum lot coverage. There was some question as to whether the required criteria were met to issue a Variance. There was also a question that this above-ground pool could be removed and an in-ground pool could be installed without coming back to the Zoning Board. The uniqueness of this lot was. not demonstrated and no hardship was presented either. Some questions were asked regarding the impact on abutting properties from the discharge system. A report from the Town Engineer to the Board should be submitted. The owner said there was no objection from abutters and they did have an above-ground pool at this location in the past. The Board needs additional information submitted by the Applicant and more information from the Town Engineer. The Applicant will submit additional information in time to be reviewed by the Board. On a motion by Jeffrey Perkins, seconded by Robert Redfern, the Zoning Board of Appeals moved to continue the hearing to January 6, 2011 at the request of the Applicant. The vote was 5-0-0 (Petschek, Perkins, Jarema, Redfern, Caouette).
