Absent: Jamie Maugham Call to Order; Old/New Business 26 Sunset Rock Lane, Enforcement Order The Commission did a site visit and nothing has been done as requested. Mr., Beckman gave numerous reasons why he did not complete the work as ordered. Ms. Stewart moved to issue fines beginning November 24, 2010 if the dirt pile has not been removed. Mr. Tucker seconded. Vote was 6-0-0. 46 Walnut Street, DEP 270-575, RGB 2010-20 The Commission reviewed the dry well design plans that were submitted, including: Engineering Drainage Calculations dated October 18, 2010, by Alberto M. Gala RPE; Percolation Test and Deep Observation Hole Log dated October 13, 2010, by Alberto M. Gala RPE; and Drainage Improvements Plan dated October 18, 2010, by Alberto M. Gala RPE. . Ms. Ohlson moved to accept the dry well design as a minor plan change. Ms. Stewart seconded. Vote was 6-0-0. 2 C Street, DEP 270-558, RGB 2009-20 The owner has not recorded the Order of Conditions yet. 50 Mill Street, RGB 2010-15 Mr. Hecht reported that three maple trees have been planted in the. ZNV and are doing well. Other site work has been completed and the site is stable. Ms. Ohlson moved to close the Determination of Applicability. Ms. Stewart seconded. Vote was 6- 0-0. 58 Mill Street, DEP 270- 574, RGB 2010-14 Mr. Hecht reported that the three additional trees have not yet been planted in the ZNV. Ms. Fink said the trees in the front yard have to be moved out of the street right-of-way, according to the Town Manager and Town Engineer. Ms. Fink will send a letter to the owners. 41-43 Wilson Street 270-571, RGB 2010-4 Mr. Hecht reported the site visit by the Commission. The silt fence and debris have been removed. The front slope of the basin has a small section of bare. soils. The Commission will ask RHA to provide temporary stabilization for the winter. 1 Conservation Commission, November 17, 2010 107 Main Street, DEP 270-561, RGB 2009-23 Ms. Fink reported that the ZBA denied the Variance request to allow additional parking on the site. Mr. Palmer's engineer has sent email messages indicating that he is preparing a revised site plan for the next Commission meeting. 141 Belmont Street, DEP 270-461, RGB 2005-37 Ms. Fink reported that the work has been completed. Three bushes and some sod were planted and debris was removed from the back yard. Ms. Stewart made a motion to issue a Certificate of Compliance. Mr. Tucker seconded. Vote was 6- 0-0. Mr. Tucker made a motion to release the bond in the amount of $1,300. Ms. Stewart seconded. Vote was 6-0-0. 285 Main Street, DEP 270-540, RGB 2008-34 Ms. Fink reported that the tanks were unearthed, and distributed photos of the event. One tank was under the foundation and the other was very close to it. The engineer from Geolnsight asked for permission to leave both tanks in place, rather than jeopardize the foundation. The Fire Department, Ms. Fink, and the Town Engineer inspected, along with Max Gabriello and his structural engineer, Rene Gagnon. The Fire Department approved the emptying of the tanks, leaving both in place, and filling with cement. Soil samples were taken but no reports have been received yet. Johnson Woods, DEP 270-416, RGB 2004-10 Ms. Fink sent Ted Moore a letter on October 20, 2010 with requested actions. November 15, 2010 was the deadline. A drainage system cleaning report was just received today, but no other requested actions have been done. The cleaning report does not include inspections of many components of the drainage system. The Commission asked Ms. Fink to follow up with Mr. Moore. 335 Main Street, RGB 2005-29 An abutter on Benjamin Lane reported a barking dog and trash to Ms. Fink. She contacted the owner of 335 Main Street, Bill Stantial. He inspected and made arrangements to address both problems. Afterwards, he sent a letter with a commitment to continue necessary maintenance. The Commission will send a copy of the letter with the abutter. 84 Martin Road, Violation Notice Mr.'Hecht recused himself from this case and left the room. Mr. Sullivan chaired the discussion of this case in Mr. Hecht's absence. The Commission reviewed a letter from the owner requesting an extension of time to plant the replacement trees next spring. Mr. Tucker moved to allow the owner until June 15, 2011 to plant the two trees. Ms. Stewart seconded. Vote was 5-0-0. Mr. Hecht returned and resumed the chair. Conservation Commission, November 17, 2010 Public Hearing, Notice of .Intent, David and Birgit Martinelle, 25 Curtis Street, RGB 2010-26 Present: David and Birgit Martinelle Mr. Martinelle reviewed their plans for the proposed addition with a second story added over the garage. His subcontractors understand they must follow the Orders of Conditions. The Commission reviewed the draft Findings and Conditions and made revisions. Ms. Ohlson moved to issue an Order of Conditions permitting the work, with the Findings and Conditions as amended this evening. Vote was 6-0-0. Public Meeting, Request for Determination of Applicability, Brian and Karen Poor, 140 Charles Street, RGB 2010-27 Present: Brian & Karen Poor, Jim Findley (contractor) Mr. Poor said some minor changes have been made to the plans at the request of the Building Inspector. He distributed a revised plan to the Commission with a slightly larger deck, and also a photograph of the machine used to install the proposed helical piers. Mr. Hecht gave a site visit report. The Commission reviewed the draft conditions. Mr. Poor asked a few questions about some of the conditions, and minor changes were made. Ms. Ohlson moved to issue a negative Determination of Applicability with the conditions as revised this evening. Ms. Scanlon seconded. Vote was 6-0-0. 40 Sunset Rock Lane, DEP 270-549, RGB 2009-1 The Commission did a site visit. There a few areas that could use some additional seeding in the spring, but there should not be any erosion. Ms. Fink said the draft Conservation Restriction has been accepted by the owners, and they have request that the as-built plan be waived. There are other records on file concerning the installation of the drainage system. Ms. Stewart made a motion to waive the as-built plan requirement. Ms. Scanlon seconded. Vote was 6-0-0. Parker Middle School, DEP 270-517, RGB 2007-31 Ms Fink sent an email to Engineering and DPW on October 2, 2010 stating what was needed to finish the project before the Order expires in February. On November 2, 2010 she sent a second email with the same request. There has been no response to date. Ms. Fink will send a letter from the Commission asking them to comply. 88-98 Walkers Brook Drive, DEP 270-489, RGB 2006-39 and DEP 270-502, RGB 2007-7 The Commission reviewed as-built plans and a drainage system cleaning report. They reviewed and approved a letter to the owner requesting additional details and installation of controls in the wash bays to contain water inside the building. 10 Torre Street, DEP 270-538, RGB 2008-35 A site visit was done and the site looked good. The Commission has not yet received an as-built plan, or the fall inspection and maintenance report, as required. t Conservation Commission, November 17, 2010 306 Main Street. - 21E report Ms. Fink spoke to D.E.P. about the recently discovered PCB's and other contaminants at the site. DEP is checking the details and will provide further information soon. Mattera Cabin An energy audit will be scheduled, and the Commission hopes to include a blower door test before and after work is completed. Ms. Fink will get more information. The Tech. School students are working on final plumbing and wiring/lighting projects. Cabinets and tiles have been ordered. Maplewood Village Trail Easement Ms. Fink sent a letter to the Board and their attorney in response to their recent letter. They have not yet sent a reply. Economic Development Summit Meeting report Mr. Sullivan and Ms. Fink gave reports on the meeting. There will be another one held next May. 197 South Street and 257 West Street Work is underway at both locations. Tree Stand, Timberneck Swamp A tree stand was found in Conservation Land. Ms. Fink left a note in it for the owner, with a copy of the rules for use of Conservation Land. Memorial Park Ms. Fink gave a progress report on Memorial Park. The stormceptors have been installed and the second coat of pavement has been applied to Harrison Street. Plant cover remains sparse around the ponds, especially in the floors of the ponds. Some of the pond banks are eroding. Controls will be needed to keep dirt out of the stream when the ponds are filled and emptied. 147 Belmont Street Ms. Fink reported that the owners did plant the trees as required. The Commission reissued the Order of Conditions for recording purposes. Trail Building Report M. Fink updated the Commission about current trail building techniques Mr. Tucker made a motion to purchase up to $100 worth of paint or stain for trail building projects, from the Conservation Trust Fund. Mr. Sullivan seconded. Vote was 6-0-0. Meeting dates for 2011 The Commission reviewed the proposed meeting dates for 2011: January 12 and 26, February 9 and 23, March 9 and 23, April 13 and 27, June 8 and 22, July 13 and 27, August 10 and 24, September 14 and 28, October 12 and 26, November 9 and 30, and December 14. Mr. Tucker made a motion to approve the 2011 dates. Ms. Stewart seconded. Vote was 6-0-0. Adjournment On a motion by Ms. Stewart, seconded by Ms. Ohlson, the Conservation Commission moved to adjourn the meeting. The vote was 6-0-0. 4
