' ZONING BOARD OF APPEALS Minutes of October 7, 2010 114 P: Members Present: Jeffrey Perkins, Vice Chairman Robert Redfern Damase Caouette Kristen Cataldo Members Absent: Clark Petschek John Miles John Jarema A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 10-09 A Continuation of a Public Hearing on the petition of Richard Quaglia who seeks a Special Permit and a Variance under Section(s) 6.3. /6.3.4 /6.3.6 of the zoning bylaws in order to construct an attached garage to a non-conforming structure on a non-conforming lot as per plans submitted on the property located at 20 Locust Street in Reading, MA. Richard Quaglia presented his case via a power point presentation for the Board and presented his arguments as to why he should be granted a Variance and a Special Permit. The Building Inspector and members of the Board asked questions of Mr. Quaglia about his proposed attached garage. Mr. Redfern thought that what Mr. Quaglia needed are two Variances and a Special Permit for this proposal. The Building Inspector said what Mr. Quaglia is asking for are three Variances and a Special Permit does not apply in this case. Sharon Horton of 28 Locust Street said she did not have any objections to the proposal. Mike Gighotti of 21 Federal Street said he did not have any objections to the proposal. One email was presented from abutter John Marchetti of 15 Federal Street who did not object to the proposal. The members of the Board each gave their individual opinions of the proposed attached garage. ZBA Meeting, October 7, 2010 1 On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals moved to grant the Applicant a variance under Section 5.1.2 of the Zoning Bylaws in order to construct the addition as depicted on the referenced Plot Plan of Land and supporting architectural elevation and drawings. The vote was 4-0-0 (Perkins, Redfern, Caouette, Cataldo). Case # 10-10 A continuation of a Public Hearing on the petition of Elite Freestyle Karate LLC who seeks a Variance and an appeal from a decision of the Building Inspector under Section(s) 6.2.3.2.2 of the zoning bylaws in order to install 2 additional wall signs where sign bylaw allows 1 wall sign per business on the property located at 1349 Main Street in Reading, MA. On a motion by Robert Redfern, seconded by Jeffrey Perkins, the Zoning Board of Appeals moved to continue the hearing to October 21, 2010 at the request of the Applicant. The vote was 4-0-0 (Perkins, Redfern, Caouette, Cataldo). Case # 10-11 A continuation of a Public Hearing on the petition of Charles Gray who seeks a Special Permit under Section(s) 6.3 / 6.3.3.2/ 6.3.8 of the zoning bylaws in order to demolish an existing non- conforming two family dwelling located on a non-conforming lot and to reconstruct a new two family dwelling as per plans submitted on the property located at 167 Washington Street in Reading, MA. There were only three members present that could vote on the case so there was not a quorum. The Applicant submitted information to the Board for their review for the continued hearing on October 21, 2010. Other business Discussion of Internal Memorandum Due to the absence of Chairman Clark Petschek, this will be continued to the next meeting. The vote was 4-0-0 (Perkins, Redfern, Caouette, Cataldo). ZBA Meeting, October 7, 2010 2 Adjournment On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals moved to adjourn the meeting.
