Move that the Board of Selectmen adjourn the meeting at p.m. ,G) TOWN MANAGER'S REPORT Tuesday, January 04, 2011 Administrative matters ♦ Help wanted o RIVILD CAB member o Bylaw Committee member ♦ The National Guard is having a deployment out of the Reading Memorial High School Field House on Tuesday Februaryl 5, 2011 . * The final quarterly customer service survey results are attached * The Town Clerk tells me that there are approximately 110 dogs that were licensed in 2009 whose owner failed to license them in 2010. These have been turned over to the court for action. The original $10 license fee has increased, with fines and court costs up to $195. Please, to avoid fines.and court costs, license your dog early this year — the form to license dogs is included in the annual census that goes to every household in Reading in January. ♦ Representative Brad Jones tells me that the House and Senate have both approved H. 5122, Reading's Home Rule petition for an additional package store license at 30 Haven Street, and that the bill is on the Governor's desk awaiting signature. Representative Jones' advocacy for this bill has enabled it to proceed at this very quick pace. Community Development ♦ We have received the Environmental notification Form filed by Pulte Homes for the Reading Woods development on the Addison Wesley/Pearson site. Staff will be reviewing it and putting together a comprehensive comment. ♦ An RFQ for Licensing and Permitting software has been finalized and is on the street for response by bidders who are on the State bid list. Responses are due January 18. Public Safety MEMA is doing an evaluation of estimated damages from the recent blizzard to determine whether federal assistance will be available. Chief Burns is heading up the efforts in Reading. Eligible costs would be: o Police, Fire and EMS overtime o Debris removal o Damage to public infrastructure Public Works The Conservation Commission has received from MADOT a Request for .Determination of Applicability for reconstruction of the entire length of Main Street, except for the part that was recently completed in the center of town. We have been pushing for this reconstruction for a couple of years because of the deteriorated condition of the roadway which was last repaved in 1986. Construction projects + done for the year: Dates and Events: • MLK celebration — January 17th at RMHS Performing Arts Center. Breakfast is at 9, and the program at 10. (flyer attached) Reading's annual celebration of Dr. Martin Luther King, Jr. Day will be held on Monday, January 17, at the Reading Memorial High School, Performing Arts Center. Breakfast is at 9 AM with the program beginning at 10 AM. The speaker this year is Tina Chery, co-founder of the Louis D. Brown Peace Institute, an organization named for Ms. Chery's fifteen year old son, who was shot and killed on December 20, 1993, as he made his way to a Christmas party sponsored by Teens Against Gang Violence. She has continued to channel her grief into action by assisting in developing a nationally acclaimed peace curriculum for children and young people, and she founded Survivors Outreach Services, or SOS, a group that assists families in the immediate aftermath of a murder. Ms. Chery founded the annual Mothers' Walk for Peace, on Mothers' Day, 1996. In addition to Tina Chery, this.year's Dr. King Day Celebration will feature music and drama provided by the Reading High School Choir, the. Reading High Drama Club, and the Reading Community Singers. The event is family friendly, and all ages are welcome. Please join us as our community honors the legacy of Dr. King and comes together to recommit to the work of doing justice and making peace. The celebration is sponsored by the Town of Reading, the Reading Clergy Association, and the Reading Human Relations Advisory Committee. Participation credits were initiated several years ago as a way of rewarding Members for long -term commitment to the principles of risk management and loss prevention that are the foundation of the MHA programs. The longer a member participates, the higher the credit. Recognizing the difficult fiscal environment facing cities and towns, the MIIA Board and management are committed to providing needed financial relief to our members while maintaining the long -term financial stability of the program. MIIA's actuaries undertook a thorough analysis and the release of these credits is consistent with sound financial targets for the program. A credit statement will be sent to you shortly indicating your share of the overall participation credit. We are also pleased to announce funding for a second round of loss control grants: The Board approved $225,000 in funding for the current fiscal year. The program is designed to encourage members to engage in loss prevention and risk management practices. This latest round of funding will emphasize loss control activities in the DPW departments and include funding for organization development activities. Look for more details on the program in a forthcoming mailing. At MIIA,,we, continually look for ways to provide our members with tools to manage costs; and we constantly examine ways to better manage the costs of the services that we offer to our members To that end, we recently undertook a review of the EAP services to determine if we could provide those services in a more effective manner. Currently, employees can avail themselves of up to six face -to -face visits with an EAP provider at no cost to either the employee or the member. MIIA will continue to offer the services at no cost to the member, however, we will be changing how individuals access the EAP service provider beyond the initial three sessions. Individuals will be able to access additional visits with approval of A110ne, your EAP service provider, if it is determined that a limited number of additional visits will benefit the individual. We will be sending information on this change under a separate mailing. We are pleased to provide you with these additional benefits and cost - saving tools at a time when so many of you are in need of additional resources. He contacted my landlord and has talked with him about a solution regarding the heat being turned off in the building and I have to recourse to have. it turned back on. My landlord told Larry he was going to install zoned heating. Larry is expecting a follow up call from my landlord next week and has okayed a follow up call from me the end of the week. I found Larry to be knowledgeable, cooperative and very professional. The only thing that the gentleman could suggest was that I wait until spring for the hazardous waste removal day. When I explained that the waste that I possessed wasn't accepted at hazardous waste day, he couldn't suggest an alternative disposal site or offer further information. He simply was uninformed and seemed rushed to give me the answer so that he could quickly get off the phone. • Staff was very helpful • Satisfied with the service and thank you. • I have tried for 2 days to find the name of the home milk delivery in Reading in the 1950's and 60's. I called everyone from the librarian to senior . services, including the tax collector! I called milk companies and ice cream stores. Thankfully, I remembered Regina Benoit (I think that is her name) from my October 3, 2009, visit to your town. She is the most fantastic representative you have! I wasted hours and downloads and wanderings with wonderngs! All one has to do Is ask her for help and she can and will! I understand a neighborhood communication opposing the sidewalk is to be presented at tonight's meeting. My position on the sidewalk is described in that communication as "ambivalent' I'm unable to.attend the meeting tonight, but for the record I wanted to state that rather than being. ambivalent, I'm fully in favor of the sidewalk project. Generally I feel that a walkable town is very desirable and important for the safety of children walking to school. Specifically, I feel that the sidewalk will be a considerable asset to our neighborhood: an improvement in safety, and a potential enhancement to the value of our our properties. Woburn and. Prescott Streets, and Sunnyside Avenue between Prescott Street and Fairview Avenue. The Town has received plans for this proposed project and the Board of Selectmen is inviting input from the residents of the area at '8:00 p.m. on January 4,-2011 in the Selectmen's Meeting Room, 16 Lowell Street, Reading, Massachusetts. Following review of comments MassDOT will schedule a public hearing for the proposed improvements. The he prqjeot requires several temporary construction easements and one permanent easement ent at the southeasterly comer of Washington and Woburn Street. Hechenbleikner Town Manager 12/29 20 Section 3.11 — Permit/License for Portable A- Frame /Sandwich Board Signs At the 2010 Annual Town Meeting, Section 6.2. "Signs" of the Zoning By -Law was amended to permit the use of Portable A -Frame or Sandwich Board signs in the Business B Zone. Prior to this zone change, Portable A -Frame signs were prohibited by zoning. The amended sign by- law stipulates that Portable A -Frame signs fall under the regulatory control of the Board of Selectmen. Applicants will be required to apply to the Board of Selectmen for an annual permit. The following policies regulate the use and installation.of A -Frame and Sandwich Board signs. 3 11.1 - Purpose and Intent This policy is developed in order to promote a pedestrian friendly community that supports businesses. The regulation of Portable A -Frame /Sandwich Board Signs is intended to balance the aesthetic, safety, and economic development needs of the community. By regulating this use, sidewalk access will be preserved for pedestrians, particularly. those with disabilities; and required ongoing maintenance of sidewalks including snow and ice control can be accomplished. 3 112 Requirements and Rules — Portable A- Frame /Sandwich Board signs General: 1. A license and annual permit from the Board of Selectmen is required r� for to the placement of any Portable A- Frame /Sandwich Board sign. 2. Permits are valid for one calendar year: (January 1 — December 315) or remainder thereof, and must be renewed annually. The license to utilize the public way will continue as long as a permit is issued and renewed for consecutive years. - 3. Portable A- Frame /Sandwich Board signs are permitted in the Business -B zoning district only. 4. The Board of Selectmen will generally issue licenses and permits only for retail business uses and consumer services, excluding banks, realtors, attorneys, medical practitioners, and other similar business uses for which a portable /sandwich board sign is not usual and customary. Size and Location: 5. The maximum height of a Sign shall be 4 feet; 6. The maximum sign area shall not exceed 6 square feet per side, with no more than 2 sides; 7. Portable A- Frame /Sandwich Board signs: • May be on public or private property; • Shall be located within 15 feet of the hardship); business entrance (unless granted a visibility • Must be located so as to leave a minimum of 4 feet (48 inches) of an unobstructed- walk-way for safe pedestrian passage and shall not obstruct pedestrian movement; • Shall be subject to all requirements for handicapped accessibility • . Must be located in a manner that does not obstruct site lines or vehicular traffic; C:\Documents and Settings \pschena \Local Settings \Temporary Internet Files \OLK25\A - frame -v signs - delegation.doc3 - 1 Board of Selectmen Policies 21 -'� o Must be located at least 20 feet from the intersection on corner lots; • Shall be located at least 20 feet from another Portable A- Frame /Sandwich Board sign; • May be placed in a permitted location only during business hours of operation, and must be removed at the end of the business day. • May not be located on landscaped islands or other planted areas; • Must be' freestanding and not attached to any public appurtenance such as a bus shelter, sign post„ light fixture, trash barrel, bench or other similar item; • May not include attachments like balloons, flags, banners, lights, reflectors, or other items; • Must be sufficiently weighted to prevent it from blowing over. 7. Visibility Hardship - Businesses may apply for a hardship for placement of signs on the major access roads due to their location in 'an alleyway or other area that restricts visibility of the business from major roads. Applicants shall demonstrate this hardship with photos or other supporting documentation. If a hardship approval is granted, signs shall be located on the street closest to the business. All of the other requirements for Portable A- Frame /Sandwich Board signs shall apply. Other 8. The sign shall be maintained in good condition; 9. Only one portable A -frame sign per businesses is, allowed; 10. The sign material shall be weather resistant, shall not be reflective, and shall not include any type of illumination; 11. Portable signs shall be removed during a declared snow emergency. 12. The sign permit is non - transferable and application for such permit must be from the business owner (not the sign installer /maker). 13. The permit is not valid for any other business or location other than what was approved by the original permit, and the advertising on the sign shall only apply to the business for which the permit was granted. 14. Political statements or messages are prohibited. 15. Applicant shall indemnify the Town of Reading or its agents from damage to signs resulting from plowing or other public works maintenance. 16. Applicants must be current on all taxes or fees owed to the Town prior to the application for a permit. Application 17. The application fee for a license and permit for a Portable A- Frame /Sandwich Board sign shall be $50.00 for the first year or part thereof; and $25 per year for annual renewals. 18. Each application will be considered on a case by case basis. 19. Two copies of the completed application form and all the required attachments and supporting material shall be submitted. 20. The application shall include: • business name and address; • business owner contact information with email address and telephone number; • ownership status of the business as a property owner or tenant, demonstrated by proof of ownership or lease; if a tenant, written permission from the property owner is also required. There is nothing to preclude the business owner from changing the specific message during the year, and if the business owner's intent is to change the message frequently — i.e. restaurant's special of the day — then they should specify that in their application. • photographs of the area where the proposed sign is to be located, showing the storefront, building(s), the existing signs, abufting properties and the streetscape surrounding the proposed sign. • materials and colors of the sign shall be described in the application and on the drawings. 21. The sign shall not be installed until the owner has received the sign permit and license authorization from the Board of Selectmen. 22. Signs placed in violation of this policy may be removed immediately by the Town at the sign owner's expense. 23. The permit fee for a Portable A -frame / Sandwich Board Sign installed without a sign permit will be double the regular sign permit fee Permit Renewal 24. For renewals of permits and licenses, a simple submittal of the completed application without attachments will be sufficient if none of the parameters of the initial license and permit have changed. 25. The Board of Selectmen reserves the right to renew or not renew the license and permit in its sole discretion. 26. The Board of Selectmen may delegate the process of renewal of licenses and permits. Administrative. Requirements 27.. The approval of a permit and license or the renewal of a permit and license shall be subject to the execution of a License Agreement and submission of proof of Liability Insurance naming the Town of Reading as an additional insured. 28. The Authority to initially approve and license, and to approve renewals and re- license A -Frame signs is hereby delegated to the Community Services Director /Town Planner. Any decision by the Community Services Director/Town Planner regarding A -Frame signs may be appealed to the Town Manager, and the Town Manager's decision is subject to further appeal to the Board of Selectmen. The Board of Selectmen decision in such cases shall be final.
