4a) Move that the Board.of Selectmen accept the report of the Volunteer.
Appointment Subcommittee and confirm the following appointments to
the following Boards, Committees, and Commissions:
Tracy Ellen Sopchak to one Associate position on the Advisory
Committee on the Cities for Climate Protection Program with a term
expiring 6-30-11;
Ron Daddario to one position on the Advisory Committee on the Cities
for Climate Protection Program with a term expiring 6-30-11;
Dorothy Derosa to one position on the Council on Aging with a term
expiring June 30, 2011;
Carl McFadden to one position on the Reading Ice Arena Authority
with a term expiring June 30, 2011.
5a) Move that the Board of Selectmen close the hearing setting the tax rate
for fiscal year 2011.
Move that the Board of Selectmen not grant an open space discount for
the Fiscal Year 2011.
Move that the. Board of Selectmen not adopt a residential exemption for
the Fiscal Year 2011.
Move that the Board of Selectmen adopt a residential factor of for
the Fiscal Year 2011.
Move that the Board of Selectmen not grant a commercial exemption
for the Fiscal Year 2011.
5b) Move that the Board of Selectmen close the hearing on the transfer of
the Wine Shop of Reading package store license.
Move that the Board of Selectmen approve the transfer of the Package
Store Liquor License to Reading Fine Wines, LLC, d/b/a Wine Shop of
Reading located at 676 Main Street.
5d) Move that the Board of Selectmen approve the application for a
portable A-Frame sign for SammyJo's Bakery and Caf6 at 2 Haven
Street.
5e) Move that the Board of Selectmen extend the time to serve alcohol and
food for Grumpy Doyle's from 12 midnight to 12:30 a.m. on Friday,
December 31, 2010.

♦ I am suggesting 2 budget meetings for the Board of Selectmen - one on
Tuesday, January 11 (with no other items on the agenda) and one on Saturday,
January 15.
♦ In your packet this evening is a copy of a subordination agreement for the
Industriplex complex in Woburn. This is related to the Town of Reading sewer
line in this location. In 2008 Town Meeting authorized the Board of Selectmen to
execute such agreements, and the Board of Selectmen has executed one such
agreement in the past. This agreement is required by DEP, and Town Counsel
has reviewed and approved the agreement.
o Paula needs to know who from the Board of Selectmen is going to go to the
MMA annual meeting on January 21 and 22.

s Community Services Director Jean Delios will let the Board of Selectmen know
when/what discussion the CPDC needs to have with the Board of Selectmen
regarding the South Main Street design guidelines, which CPDC has been
working on.

The TOWN OF READING, a municipal corporation organized under the laws of
the Commonwealth of Massachusetts, having a usual place of business at Town Hall, 16
Lowell Street, Reading, Middlesex County, Massachusetts, is the holder of a certain
Order of Taking dated September 27, 1976, recorded with the Middlesex. South District
Registry of Deeds in Book 13078, Page 191, and registered with the Land Registration
Office of the Middlesex South Registry District as.Document No. 549397 (the "Order of
Taking").
. The Town of Reading hereby assents to the Grant of Environmental Restriction
and Easement granted by Resources for Responsible Site Management, Inc., Trustee of
Industri-flex Site Interim Custodial Trust under declaration of trust dated May 9, 1989,
recorded with the Middlesex South District Registry of Deeds in Book 19866, Page 190
and registered with the Land Registration Office of the Middlesex South Registry District

Per the email chain I will request under the Town Manager's report the approval for the Board of Selectmen to
sign the attached agreement. Below is the 2008 STM background that Ellen referred to in her email/
The property. previously taken by the Town of Reading for the installation and construction of the
Willow Street Interceptor is now located within a portion of the physical site boundaries of the 245-
acre hazardous waste site known as the Industri Alex Federal Superfund Site (the "Site') in Woburn.
Owners of property within the Site are required to impose certain land use and other restrictions on
their property, referred to as a Grant of Environmental Restriction and Easement or Institutional
Controls. These restrictions govern the preservation and maintenance of the EPA approved remedy
installed at the Site while permitting varying types of activity under very stringent conditions. The
EPA requires subordination of the Town of Reading's rights in the easement to ensure that the
Institutional Controls function as the primary method for governing the Town's access to the
easement area for emergency repairs and maintenance to protect the health and safety of Town
workers, the public and the environment. Resources. for Responsible Site Management, Inc.,
Trustee for the Industri Alex Site Interim Custodial Trust is the first landowner within the Site to
approach the Town for the subordination. Since the property taken by the Town affects other land in
the Site, other landowners will approach the Town in the future requesting subordination of the
Taking as it affects their property. This Article is intended to allow for the subordination of the
Taking in the, public interest and to provide a single vote authorizing subordination of the Taking for
all owners of property within the Site so as to avoid the need for repeated Articles and Town Meeting
action.

Peter,
I do not know why they waited until the last minute on this. Is it possible for the Selectmen to sign tomorrow
night?
As you might recall, Article 19 of the November 2008 Subsequent Town Meeting authorized the Selectmen to sign
subordination agreements regarding this easement which is located in/upon the Industri-plex Superfund Site on
the Woburn/Reading line. This document makes that easement subordinate to the controls for doing work in or
upon the site.
I wrote a background for Article 19 which may refresh your memory and that of the Selectmen.

DEP started the clock on the 21 day timeframe for the submission of executed documents for
the inauguration of Institutional Controls against the former Woburn Industrial Associates
property. Given the holiday period and schedule, I'd like to receive the fully executed
Subordination and authority documents for the Town of Reading by not later than
Wednesday, December 22, 2010.
If this is not possible, please email me back and let me know the reasons and when you think
the soonest possible time might be for the delivery of the executed Subordination and
executed authority documents.
DEP has provided the following comments on the Subordination and Authority documents.
Please note, as provided below, DEP is now looking for (i) a Town Clerk's certificate of
incumbency for the Selectmen and (ii) a Town Clerk's certificate that the 11-10-08 Article 19
subordination approval is still valid (not subsequently modified or withdrawn).
I'm attaching both marked and unmarked, execution copies of the documents containing the
required comments.' I appreciate your help in making this pilot project a success. Please.feel

REMINDER FOR READING BUSINESS OWNERS
The Reading Board of Selectmen will hold its annual public hearing TONIGHT - Tuesday, December 14 at 8 p.m.
at Reading Town Hall, Board of Selectmen room.
At the conclusion of the hearing the Board of Selectmen will vote to either shift the Town's real estate tax rate by
setting a higher rate for commercial property owners orto maintain an equal rate for both residential property
owners and commercial property owners . The outcome does not create more income for the town, it just shifts
the tax burden. Currently Reading's property tax is equal between residential and commercial properties.
Representatives from the Chamber Board of Directors will be at the hearing. Interested parties are also
encouraged to attend.

Tax Classification Meeting
Peter,
The Chamber of Commerce has provided notice to its members of the annual tax
classification meeting to be held this evening. In advance of any vote, I would strongly
advocate that the Town maintain an equal rate for both residential and commercial property
owners.
As a community bank, we have equal consumer and business customers and wish for a tax
policy that is equitable to all. As the town of Reading has minimal business zoning the
amount of an increase to the business community to provide any material residential
benefit would be onerous.
We have been in an economic decline and this recovery is anemic. As a lender in the
community, I can tell you our small business sector has taken the biggest brunt of this
downturn due to the limited market it can serve. The downtown business community has
weathered the construction project and this poor economy; to increase taxes when things
are tenuous at best would not serve the town's economic development efforts.

24. The Licensee shall comply with all applicable laws (including. the sign portions of the
Zoning by-laws), rules,. regulations, and conditions of other licenses and permits.
25. The license fee for the use of the public sidewalk shall be $100 per year and shall be
payable upon initial application for an Outdoor Dining License, and for annual renewal of
the license.
In granting a License, the Board of Selectmen may impose such additional conditions as it
determines to be appropriate.

Section 3.11 - Permit/License for Portable A-Frame/Sandwich Board Signs
At the 2010 Annual Town Meeting, Section 6.2. "Signs" of the Zoning By-Law was
amended to permit the use of Portable A-Frame or Sandwich Board signs in the Business B
Zone. Prior to this zone change, Portable A-Frame signs were prohibited by zoning.
The amended sign by-law stipulates that Portable A-Frame signs fall under the regulatory
control of the Board of Selectmen. Applicants will be required to apply to the Board of
Selectmen for an annual permit.
The following policies regulate the use and installation of A-Frame and Sandwich Board
signs.
3.11.1 - Purpose and Intent
This policy is developed in order to promote a pedestrian friendly community that
supports businesses. The regulation of Portable A-Frame/Sandwich Board Signs is intended to
balance the aesthetic, safety, and economic development needs of the community. By regulating
this use, sidewalk access will be preserved .for pedestrians, particularly those with disabilities;
and required ongoing maintenance of sidewalks including snow and ice control can be
accomplished.

placement of any Portable A-Frame/Sandwich Board sign.
2. Permits are valid for one calendar year (January 1 - December 31 or remainder thereof,
and must be renewed annually. The license to utilize the public way will continue as
long as a permit is issued and renewed for consecutive years.
3. Portable A-Frame/Sandwich Board signs are permitted in the Business-B zoning district
only.
4. The Board of Selectmen will generally issue licenses and permits only for retail business
uses and consumer services, excluding banks, realtors, attorneys, medical practitioners,
and other similar business uses for which a portable/sandwich board sign is not usual and
customary.

5. The maximum height of a Sign shall be 4 feet;
6. The maximum sign area shall not exceed 6 square feet per side, with no more than 2
sides;
7. Portable A-Frame/Sandwich Board signs:
• May be on public or private property;
• Shall be located within 15 feet of the business entrance (unless granted a visibility
hardship);
• Must be located so as to leave a minimum of 4 feet (48 inches) of an unobstructed
walk-way for safe pedestrian passage and shall not obstruct pedestrian movement;
• Shall be subject to all requirements for handicapped accessibility
• Must be located in a manner that does not obstruct site lines or vehicular traffic;
• Must be located at least 20 feet from the intersection on corner lots;
• Shall be located at least 20 feet from another Portable A-Frame/Sandwich Board sign;
• May be placed in a permitted location only during business hours of operation, and
must be removed at the end of the business day.
• May not be located on landscaped islands or other planted areas;
• Must be freestanding and not ,attached to any public appurtenance such as a bus
shelter, sign post„ light fixture, trash barrel, bench or other similar item;
• May not include attachments like balloons, flags, banners, lights, reflectors, or other
items;
• Must be sufficiently weighted to prevent it from blowing over.
7. Visibility Hardship Businesses may apply for a hardship for placement of signs on the
major access roads due to their location in an alleyway or other area that restricts
visibility of the business from major roads. Applicants shall demonstrate this hardship
with photos or other supporting documentation. If a hardship approval is granted, signs
shall be located on the street closest to the business. All of the other requirements for
Portable A-Frame/Sandwich Board signs shall apply.

8. The sign shall be maintained in good condition;
9. Only one portable A-frame sign per businesses is allowed;
10. The. sign material shall be weather resistant, shall not be reflective, and shall not include
any type of illumination;
11. Portable signs shall be removed during a declared snow emergency.
12. The sign permit is non-transferable and application for such permit must be from the
business owner (not the sign installer/maker).
13. The permit is not valid for any other business or location other than what was approved
by the original permit, and the advertising on the sign shall only apply to the business for
which the permit was granted.
14. Political statements or messages are prohibited.
15. Applicant shall indemnify the Town of Reading or its agents from damage to signs
resulting from plowing or other public works maintenance.
16. Applicants must be current on all taxes or fees owed to the Town prior to the application
for a permit.

Application
17. The application fee for a license and permit for a Portable A-Frame/Sandwich Board sign
shall be $50.00 for the first year or part thereof, and $25 per year for annual renewals.
18. -Each application will be considered on a case by case basis.
19. Two copies of the completed application form and all the required attachments and
supporting material shall be submitted.
20. The application shall include:
• business name and address;
• business owner contact information with email address and telephone number;
• ownership status of the business as a property owner or tenant, demonstrated by proof
of ownership or lease; if a tenant, written permission from the property owner is also
required.
• color drawing of the proposed sign and a site/plot plan (to scale) showing the
proposed sign location and dimensions of the sidewalk, distance to the business
entrance, and relationship to adjacent buildings, roads, driveways, and other street
amenities such as trash receptacles, fire hydrants, utility fixtures, etc.
• type of sign message. There is nothing to preclude the business owner from changing
the specific message during the year, and if the business owner's intent is to change
the message frequently - i.e. restaurant's special of the day - then they should specify
that in their application.
• photographs of the area where the proposed sign is to be located, showing the
storefront, building(s), the existing signs, abutting properties and the streetscape
surrounding the proposed sign.
• materials and colors of the sign shall be described in the application and on the
drawings.
21. The sign shall not be installed until the owner has received the sign permit and license
authorization from the Board of Selectmen.
22. Signs placed in violation of this policy may be removed immediately by the Town at the
sign owner's expense.
23. The permit fee for a Portable A-frame / Sandwich Board Sign installed without a sign
permit will be double the regular sign permit fee
Permit Renewal
24. For renewals of permits and licenses, a simple submittal of the completed application
without attachments will be sufficient if none of the parameters of the initial license and
permit have changed.
25. The Board of Selectmen reserves the right to renew or not renew the license and permit in
its sole discretion.
26. The Board of Selectmen may delegate the process of renewal of licenses and permits.
Administrative Requirements
27. The approval of a permit and license or the renewal of a permit and license shall be
subject to the execution of a License Agreement and submission of proof of Liability
Insurance naming the Town of Reading as an additional insured.

The negotiations of.contracts and health benefits has
allowed us to fair much better than any other
community.
Operations 4 - Operations has made good progress over the last
year and half.
Services 3.5 - the trash contract is a great win for 2010. We
need to be forever vigilant on customer satisfaction and
how we can improve everyone's experience in working
with the Town.
Policies and Procedures 3.5 - although we have started peeling back the onion
on our policies and procedures we have a long way to
go. I believe half the problems we have in regards to
customer service is due to our on charter and by-laws.

SELECTMEN COMMENTS
This past year was a very busy one for the Town Manager as the departments had many important initiatives
that required his attention. Economic Development was certainly an area of continuing motion this past
year. Considering the state of the national economic condition, Reading has been very fortunate to have a
significant number of new businesses and large developments establishing their roots in the community.
In addition, the successful labor negotiations were a huge endeavor which required hours of discussion
and patience and will hopefully help Reading remain financially stable in the difficult funding years we are
encountering.
The implementation of the new rubbish contract was a huge success. The reduction of waste through
recycling and more public education is meeting both a financial and an environmental goal. Reading is on
its way of moving to the state's mandate of 60% recycling.
The goals to be completed this year were numerous, too numerous to be completed. Great strides have
been made and the next year should see many more fulfilled. The one area that needs to be more fully
addressed next year is the process for helping businesses, new and existing, maneuver through the many
regulations of the town. For too many years the process has been too cumbersome and is still in need of
being streamlined.
In retrospect, we can be proud of the strides that have been made under Peter's direction last year. We have
been fortunate to have an able administrator who is deeply committed to the community and its success.

been realized. Pete has been successful in managing
labor contract negotiations and staff salaries during
these especially difficult budget years.

Working on its own and jointly with the School
Department, the Town has greatly benefitted from
numerous grants that were aggressively and creatively
pursued over the last year.
Operations

The new trash/recycle contract has been a great success
in the eyes of our residents; several other expressed
concerns of the Board, Town Meeting and residents have
been addressed and resolved successfully establishing
new procedures for delivering services (snowplowing
church parking lots, further. implementation of MUNIs,
upgraded reverse 911 system.) The MWRA water main
break / community emergency last Spring was handled
extremely well.

This is'and will continue'to be the most challenging
area, meeting an increasing demand for the quality and
quantity of services while budgets and staff are being
reduced. The complex customer service issue (again,
perceived versus actual) is starting to be examined and
understood figuring out the right balance will be key
in the next year.

SELECTMEN COMMENTS
Excellent work on finance and development. The budget is under control but more importantly the expenses
are kept to acceptable levels. The economic development in Reading is moving along at a great pace
thanks. to Pete's hard work and persistence. Pete works very hard and is successful in securing state
construction funding for infrastructure which enhances the attractiveness of the Town.
Pete needs to consistently push back on staff to correct the perception that Reading town hall is a hard place
to do business for both commercial and residential customers.
Implementing the customer service policies is a great first step in the services category. Pete needs to work
hard to have all staff meet the requirements of these policies as well as make them a consistent part of
all interactions

Fully completed 22 of 48 goals established in January 2010, with major progress on 11 others. The following is a
synopsis of mayor accomplishments in 2010:
Development
• Affordability of Cedar Glen housing complex, potentially expiring in 2010, was extended in perpetuity
• Downtown Smart Growth zoning approved, $350,000 in State Funding secured and in the stabilization fund,
and the first application - Oaktree - is approved and expected to begin construction in the winter/spring of
2011
Peter Sanborn Place expansion of 50 affordable housing units is moving forward
• Addison Wesley Pearson property is pending sale to Pulte Homes for 425 units of housing including Gateway
Smart Growth (40R) district, age restricted housing, and non age restricted housing - site demolition
expected winter 2011, with site construction beginning in the spring of 2011.
Continue to advocate for redevelopment of MF Charles building and Lynch building in downtown.
• Completed sign inventory; completed analysis of sign conformance with sign bylaw; Town Meeting approved
several amendments to the sign bylaw; "friendly" enforcement begun.

SELECTMEN COMMENTS
Overall, Pete Hechenbleikner continues to do an excellent job managing the municipal operations of the Town
of Reading. Even while having served in the role of Town Manager for well over 20 years, he continues to
innovate and provide a high level of management.
We are in the midst of extremely challenging financial times and Pete's leadership has proven critical to
maintaining town operations at the level expected by residents of the community. Finance is an area
where we have a very strong team and expect continued great things.
In addition to Finance; Development is an area of important dynamism for the town. The continued
progress toward start of construction on the Oaktree project is a positive sign for the community; as or
the proposals at Peter Sanborn Place and the Pearson property. Reading's reputation is growing as a
strong market for goods and services.
We are able to maintain a high level of service delivery. We expanded the support for the street faire and
other citizen organized events. The study regarding regional dispatch is a positive development and we
need more initiatives to efficiently and competently deliver services on a regional basis.
Operations have been marked by lack of resources in many areas. We need to increase resources
particularly for roadways. It would be helpful to have measures in place to see how productive we are
using existing monies. We make efficient use of resources in recreation, engineering and public works.
Strong labor relations remain a hallmark of Pete's tenure. The ability to communicate openly with staff is
critical at this time of shared sacrifice. Timely completion of contracts on a sustainable basis marked
excellence in the area of personnel. However, performance of all staff needs to be at the same level and
with the same commitment to customer service as the Town Manager.
Pete has an excellent grasp of the importance of Policies and Procedures. His work in trying to
accommodate concerns of the BOS regarding the implementation and modification of the sign by-laws is
appreciated. It would be god for the town for Pete to have the resources to complete the proper review of
the general and zoning by-laws in the near future.

The sidewalk is of sufficient width for the placement of the sign. I do not see any issues either as long as they
conform to the regulations and the sign is removed during snow storms to permit the clearing of sidewalks.
The regulations indicate "removal during declared snow emergencies" we remove snow from sidewalks without
declaring an emergency.
FYI if this is not a renewal - they are already in violation as the sign is up.
