March 13, 1992
The Board of Health met at 7:00 pm Thursday, March 12, 1992 in
the Berger Room of Town Hall. Present at the meeting were Chair
James Nugent, Kathy Baranofsky, Bill Murphy, and staff Ruth
Cogan.
The minutes of January 27, 1992 were approved by a vote of 3:0:0.
(motion by Baranofsky, seconded by Murphy)
Cogan recommended the renomination of Regina Benoit and Diane
Kurkjian as the Inspectors of Animals. Motion was made Murphy
and seconded by Baranofsky to nominate Benoit and Kurkjian. Mo-
tion passed unanimously.
Site Plan for Main Street, Dunkin Donuts - A presentation was
made by the Director and the applicant's attorney, Brad Latham
concerning the demolition of the buildings present on the
property and the erection of a building with two retail spaces,
including Dunkin Donuts. A motion passed 3:0:0 to approve the
plans with the following comments:

this time. A copy of the plan review form will be sent to the
applicant's attorney with instructions for its completion. No
construction may begin until there is an approved plan review
from this office.
Cogan gave an update on the annual Rabies clinic which will be
held April 11 at the DPW Garage from 1 - 3 pm. There will be a
five dollar fee, same as last year, and the clinic will be held
by Dr. Hutchinson.
An update was given on the present status of the FY93 budget.
The Director gave a report of a request of a homeowner concerning
lead paint. The building next to them did not have children un-
der 6 living in it, but they have a two year old. Paint chips
from the building next door have landed on their property; their
child plays outside in the dirt. The Director collected paint
chips and had them tested at the State Lab; the white trim was
negative and the brown paint was positive. The only enforcement
avenue would be through the public health nuisance law. If the
owner of the building would refuse to delead the exterior of the
building, the only avenues of enforcement would be a $20 a day
fine or having the Town do the work and sue the owner for the ex-
penses. The Board instructed the Director to ask Town Counsel
what alternatives the people would have privately as well as what
liability the Town would have if they did not act.
Brad Latham, attorney for the applicant, gave a presentation for
a Special Permit request for Peters and Tracey Builders for 58
Baystate Road. The Board voted 3:0:0 after motion by Baranofsky,
seconded by Murphy, to, recommend to the zoning Board of Appeals
that the property is not subject to flooding and is suitable for
- human habitation.
A discussion was held concerning revisions of the tees and
regulations. The Board gave suggestions as to revisions in the
fee schedule. A public hearing will be held at the next meeting
and then the revised fee schedule and regulations would be
adopted at the May meeting.
Cogan noted that the FDA requested to use Reading to train a new
inspector on food service inspections. She said that it was al-
right as long as our Inspector was with them, that they only in-
spected places that were scheduled to be inspected that month,
and she was in the office to answer questions or concerns.
It was noted that the next meeting date would be changed from
April 9 to April 16 and would be held - at the High School before
Town Meeting.
The meeting adjourned at 8:25 pm.
