BYLAW COMMITTEE MINUTES #149
€ March 15, 1989
Members present: Ed Murphy, George Theophanis, and
Dolores Carroll.
7:35 Chairman Murphy called the meeting to order in the Employees'
Lounge of Town Hall.
Present to review the following articles with the committee for
the Annual Town Meeting was Town Manager Peter Hechenbleikner.
Article 9: The town manager gave several reasons why the town
would benefit from a local excise tax. It would supplement
revenue as a result of Prop 2 1/2, and we expect to receive an
average of $200,000 per year from the Embassy Suites with a 75%
occupancy.
Article 31: Peter explained that although the $15 milk fee has
been in place for several years, in accordance with the general
laws it is illegal to charge more than $10.
Articles 33 and 34: Peter and the committee discussed the
process to defer water and sewer charges. To be eligible an
owner must be receiving an exemption from property taxes, as
the deferred charges are added to their tax bill which is
secured by a lien, with 8% interest.
Article 35: The petitioner for this article, Mr. Blanchard,
was not present. Peter informed the committee that the
petitioner would like his property included in the PUD district
which it borders. Committee agreed to attend the April 3rd
meeting of the CPDC meeting of April 3 where this article would
be discussed.
Article 36: The town manager reported that in town counsel's
opinion, this article will be ruled out of order at town
meeting.
At this point Peter left the meeting and the committee took
action on the following articles:
Article 9: On motion of Dolores Carroll and seconded by
George Theophanis, it was voted to recommend Article 9. Motion
carried by a vote of 3-0-0.
Article 31: On motion of George Theophanis and seconded by
Ed Murphy, it was voted to recommend Article 31. Motion
carried by a vote of 3-0-0.
Article 33: On motion of George Theophanis and seconded by
Dolores Carroll, it was voted to recommend Article 33. Motion
carried by a vote of 3-0-0.
Article 34: On motion of Dolores Carroll and seconded by
George Theophanis, it was voted to recommend Article 34.
Motion carried by a vote of 3-0-0.

Article 35: On motion of George Theophanis and seconded by
Dolores Carroll, it was voted action pending until the CPDC has
their meeting on April 3rd. Motion carried by a vote of 3-0-0.
Article 36: On motion of George Theophanis and seconded by
Dolores Carroll, it was voted not to recommend Article 36.
Motion carried by a vote of 3-0-0.
The committee then proceeded to discuss the definition of the
word "inhabitant" and whether age and being a registered voter
should be considered. Citizen and inhabitant could possibly be
the same definition.
9:05 Meeting adjourned. Next meeting to be held on Wednesday,
April 5th.
