March 28, 1990
Members present: Ed Murphy, George Theophanis, Dolores Carroll and
Phil Pacino.
Guests present: Ted Cohen, Town Legal Counsel and Peter
Hechenbleikner, Town Manager.
7:34 Meeting called to order in the conference room of the Library.
The committee reviewed with Ted Cohen and the Town Manager several
articles on the Annual Town Meeting Warrant.
Article 11 will be indefinitely postponed thus the Committee took no
action on the article.
On a motion of Phil Pacino and seconded by Dolores Carroll the
committee after discussion voted 4-0 to recommend Article 20.
The committee was asked to reconsider their prior vote to not
recommend Article 21. The committee agreed to hold further action on the
article until later in the meeting.

The committee reviewed their previous action on Article 22 with their
The committee then reviewed Article 23. The committee discussed how
this bylaw would be implemented and if the intent of the bylaw could or would
be achieved. The committee had a problem with this article in terms of
defining the particular fees that Town Meeting would vote on. The committee
touched on using the term "broad base" and setting a dollar amount as to what
fees should be voted on.
On a motion of Phil Pacino and seconded by Dolores Carroll the
committee voted to not recommend Article 25 by a vote of 4-0.
The committee discussed Article 31 briefly with their guests since its
intent is not been fully defined at this time.
The committee's guests exited the meeting.
The committee on a motion of George Theophanis and seconded by Dolores
Carroll voted to reconsider Article 21 by a vote of 3-1.
After discussion the committee on a motion of Phil Pacino and seconded
by Dolores Carroll voted to not recommend Article 21 by a vote of 4-0. The
committee had problems with respect to some of the time limits contained in
the article and to the burden this article would place on some residential
homeowners.
The committee on a motion of George Theophanis and seconded by Dolores
Carroll voted to reconsider Article 22 by a vote of 4-0.
Under Article 22 the committee on a motion of George Theophanis and
seconded by Dolores Carroll voted to not recommend that sections 4.4.1 thru
4.4.8 of the Bylaws be deleted and the title of section 4.4 of the Bylaws be
changed to "Reserved for Future Use" by a vote of 3-1.
The committee on a motion of Phil Pacino and seconded by Dolores
Carroll voted to recommend Article 22 with the same language as approved by
the committee at their March 13, 1990 meeting.
The committee on a motion of Phil Pacino and seconded by Dolores
Carroll voted to bring back from the table Article 23 by a vote of 4-0. The
committee then proceeded to vote to not recommend the Article by a vote of 4-
0. The committee went further and voted to offer a motion to Town Meeting to
indefinitely postpone the subject matter of Article 23 by a vote of 4-0. The
committee felt that the definitions at present within the article were too
broad and that they would need further work to straighten them out in order to
accomplish the intent of the article.
The committee then considered the Special Town Meeting Warrant of
April 26, 1990.
The committee agreed on Article 4 to invite the Recreation committee
to the next meeting to discuss the article.
After discussion the committee on a motion of George Theophanis and
seconded by Phil Pacino voted to recommend Article 9 by a vote of 4-0.
