HomeMy WebLinkAbout1990-10-10 Bylaw Committee MinutesBYLAW CON04rr EE INffli=S #180 October 10, 1990 7:35 p.m. A joint meeting was held between the Conservation Commission and the Bylaw Committee in the Selectmen's Meeting Room of Town Hall. Bylaw Committee members present: Ed Murphy, Phil Pacino, Jack Russell, George Theophanis, and Dolores Carroll. Donald J. Nadeau, Conservation Administrator, gave an overview of the State Wetlands Protection Regulations and outlined previous amendments and the proposed amendments under Section 5.7 (Wetlands Protection) of the General Bylaws; Articles 4-14 of the Subsequent Town Meeting. Approval of these amendments will update the regulations and revisions within the proper scope of the General Bylaws. Following a general discussion, Bylaw Committee meeting convened at the Municipal Light Department. Paul Caselle of the Board of Health, present to discuss the proposed amendment to Section 5.4 (Excavations and Wells) of the General Bylaws, feels there is a conflict between the General Bylaws and the Board of Health regarding wells. He suggested to either delete the bylaw or make it consistent with the Board of Health to eliminate any confusion. Jack Russell recommended removing the words "abandoned wells" and rewording the bylaw to read as follows: 5.4.2 The owner or owners of land whereon is located a well in use shall provide a covering for such well capable of sustaining weight of three hundred (300) pounds. The owner/owners of abandoned wells shall fill the well to the level of the ground in accordance with Reading Board of Health Well Water Regulations. Whoever violates this section shall pay for each offense a penalty of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) Paul will consult with his board and contact Chairman Pacino prior to our next meeting. The committee reviewed and accepted the minutes of: Meeting #178 by a vote of 4-0-1 Meeting #179, as amended, by a vote of 4-0-1 On motions of Dolores Carroll, seconded by Ed Murphy, the Committee voted to recommend Articles 21 and 22, establishing a Land Advisory Committee, by a vote of 4-0-1. 1 Chairman Pacino will invite Town Manager Peter Hechenbleikner to our next meeting to review Articles 18, 20 and 23 and a member of the Community Planning and Development Commission to review Articles 15 and 16 of the Subsequent Town Meeting. The next meeting of the Bylaw Committee will be held on October 17, 1990 at 7:30 p.m. in the Conference Room of Town Hall. Meeting was adjourned at 9:47 p.m. Respectfully submitted, Dolores S.
