HomeMy WebLinkAbout1990-10-17 Bylaw Committee MinutesBYLAW COhlNff CI'EE NIMI ES #181 October 17, 1990 7:35 p.m. Chairman Pacino called the meeting to order in the Town Manager's office of Town Hall. Members present: Phil Pacino, Jack Russell, George Theophanis, and Dolores Carroll. Guests present: Town Manager Peter Hechenbleikner, Paul Caselle, a member of the Board of Health, Jonathan Edwards, CPDC Administrator, Donald J. Nadeau, Conservation Administrator and Ed Loschi, a Conservation Commission member. The Town Manager reviewed Articles 18 and 20 of the upcoming Subsequent Town Meeting with the Committee. With reference to Article 18, he explained that although Town Meeting accepted Section 7A, which also references retirees, at the September 13 Special Town Meeting, Town Counsel advised that Section 9E is more specific and would ensure that retirees receive the same percentage of health insurance payments as active employees. Article 18: On motion of George Theophanis, seconded by Dolores Carroll, Article 18 was recommended by a vote of 4-0-0. Peter then went on to explain that :Art'Oe 20 jgwould allow the Town Manager to dispose of surplus property without Fii Coln s approval, prompting George Theophanis to suggest it become part of the bylaws to preserve authority. Phil Pacino proposed including the words "except Reading Municipal Light Department property" in the motion. Article 20: On motion of Jack Russell, seconded by George Theophanis, the committee voted 4-0-0 to recommend Article 20 with the following modifications, "exclude the Reading Municipal Light Department property and include FinCom's approval." At this point, Paul Caselle, representing the Board of Health, joined the meeting to review Article 17. Discussion ensued with the committee's major concern being the safety factor, resulting in the recommendation of a cover capable of sustaining 300 pounds for all wells. The final analysis being that the Board of Health still favors deleting 5.4.2 of the General Bylaws, with the Bylaw Committee favoring the bylaw as proposed at our meeting of October 10, 1990. Article 17: On motion of Jack Russell, seconded by George Theophanis, the committee voted to postpone taking any action on Article 17 by a vote of 4-0-0. 1 Attention then focused on Jonathan Edwards and Bill Goodrich of the CPDC, attending to discuss Articles 15 and 16 of the Zoning Bylaws. Article 15 would clarify waiver conditions for site plan review, with Article 16 putting further restrictions on developers, relative to access easements, by adding language to the current definition of "frontage" in the Zoning Bylaws. Article 15: On motion of Dolores Carroll, seconded by Jack Russell, the committee voted to recommend Article 15 by a vote of 4-0-0. Article 16: On motion of Jack Russell, seconded by George Theophanis, the committee voted to recommended Article 16 by a vote of 4-0-0. Representing the Conservation Commission were Donald J. Nadeau, Conservation Administrator and Ed Loschi, a member of the Commission, to again review the proposed amendments under Section 5.7 of the General Bylaws. On motion of George Theophanis, seconded by Jack Russell, the committee voted to recommend Articles 4-14 by a vote of 4-0-0. The committee reviewed and accepted the minutes of Meeting 180 by a vote of 4-0-0.
