March 20, 1991
7:40 p.m. Meeting called to order by Acting Chairman George Theophanis, in the Arnold Berger Room
of Town Hall.
Members present: Ed Murphy, George Theophanis, Jack Russell and Dolores Carroll.
Guests present: Town Counsel Ted Cohen and Town Planner Jonathan Edwards.
Minutes #185 were read and accepted by a vote of 4-0.
Article 11: Jonathan distributed CPDC's recommendation, with suggested changes, which he read into the
record (copy attached). He stressed future regionalization and the advantages of continuous back-up
coverage.
Ted was concerned with the Zoning Enforcement Officer having knowledge of the legal system for court
appearances. He suggested including the following as part of the motion:
"The Town Manager shall appoint a Zoning Enforcement Officer and one or more Zoning
Enforcement Officers to assist the Zoning Enforcement Officer or act in his stead."
Article 7: Ted related that since the Attorney General rejected the Conservation Commission's
amendment to Section 5.7 of the General Bylaws as not being specific enough, it was redrafted to be
included in the Special Town Meeting of April 11, 1991.
Article 12: Committee favors approval of this article adopting the state law permitting disposition of
surplus goods to charitable organizations.
Article 16: George Theophanis questioned the existence of an election law forbidding town elections from
being held on the same day as state or federal elections. Ted reviewed the election laws and could find no
such reference.
Article 19: Jack Russell proposed the following modification be included as part of the bylaw enforcing a
water plan:
5.1.6.3. "Further, any enforcing person, or his designee or agent, may enter onto any property and in any
buildings thereon for the purpose of inspecting or investigating any violation of this bylaw or enforcing the
same, except no dwelling unit shall be entered without the consent of the residents."
With George Theophanis making the following recommendations:
5.1.6.1. Delete the word "Purpose."
5.1.6.2. Line 8, add the word "plan" after the word "which," and on line 9, add a after the word
"emergency."
Article 11: On motion of Jack Russell, seconded by Ed Murphy, the Committee voted 3-1 (with
Dolores Carroll voting in the minority) to recommend Article 11 as amended.
Article 12: On motion of Jack Russell, seconded by Dolores Carroll, the Committee voted 4-0 to
recommend Article 12.
Article 13: On motion of Ed Murphy, seconded by Jack Russell, the Committee voted 4-0 to recommend
Article 13.
Article 16: On motion of Jack Russell, seconded by Dolores Carroll, the Committee voted 4-0 to
recommend Article 16.
Article 19: On motion of Dolores Carroll, seconded by Jack Russell, the Committee voted 4-0 to
recommend Article 19.
Article 7: On motion of Jack Russell, seconded by Ed Murphy, the Committee voted 4-0 to recommend
Article 7 of the Special Town Meeting.
