HomeMy WebLinkAbout1991-05-29 Bylaw Committee MinutesBYLAW COMMITTEE MINUTES #187 May 29, 1991 7:35 p.m. Meeting called to order by Chairman Phil Pacino in the Conference Room of Town Hall. Members present: Phil Pacino, Ed Murphy, George Theophanis, Jack Russell and Dolores Carroll. Minutes of Meeting #186 approved by a vote of 4-0-1. The Committee reviewed the instructional motion of Gloria Hulse to amend the Bylaws and/or Charter by eliminating mailing warrants to Town Meeting Members. Amending Article 3, Section 3.4.2 of the Bylaws, by replacing shall mail with shall make would accomplish this. Town Meeting Member Robert Lynch joined the meeting to discuss his instructional motion to allow the Zoning Enforcing Officer to impose a fine for violation of the Zoning Bylaws. Failure to comply would result in increased fines and a court appearance. The Captain of Precinct 2 asked the Committee to review the section of the Charter referring to the removal of Town Meeting Members. It seems a member from her precinct failed to attend one-half or more of the meeting sessions, resigned and was re-elected. On motion of George Theophanis, seconded by Jack Russell, the Committee voted 5-0-0 to send a letter to the Precinct Captain, with a copy to the Moderator, explaining that per Section 2.6 of the Charter, he can be removed even if re-elected at the last Annual Election, since this election is specifically referred to in that section. Philip addressed a proposed amendment for Section 4.8 of the General Bylaws to permit the General Manager of the Light Department to choose the medical examiner for his employees, not the Town Manager. Reviewed the Town Manager's description of the Bylaw Committee, revising the first sentence under "Purpose" so that it reads: "The Bylaw Committee considers proposed changes in the Bylaws and reports its findings on all such articles on the Warrant in writing at least seven days before Town Meeting." Next meeting will be held on Wednesday, June 26, 1991, with Gloria Hulse, the Building Inspector, Town Manager and Selectmen invited to attend to gain insight into their instructional motions. 9:15 p.m. Meeting adjourned.
