October 16, 1991
7:30 p.m Meeting called to order in the Town Hall Conference Room.
Members present: Phil Pacino, George Theophanis, Ed Murphy, Jack
Russell and Dolores Carroll.
Guests present: Town Counsel Ted Cohen,Town Manager Peter Hechenbleikner
and Town Planner Jonathan Edwards.
Mr. Cohen and Mr. Edwards spoke in favor of Article 18 which would
grant ticketing power to the Zoning Officer for zoning violations,
thereby reducing court appearances. Mr. Cohen suggested inserting
the words "as defined in the Zoning Bylaws and" following the words
"Building Inspector" so that the motion reads:
"5.11.5 For purposes of this bylaw, "enforcing person" shall mean
any member of the Board of Selectmen, any police officer of the Town,
the Building Inspector, as defined in the Zoning Bylaws and the Health
Director or his or her designee.
Mr. Cohen agreed with George Theophanis that the motion under Article
19 include Section 7.2.2 of the Zoning Bylaws in its entirety.
He felt that with regionalization a future possibility, the adoption
of Article 17 would ensure proper zoning enforcement.
Mr. Hechenbleikner explained that if the amendment to Section 5.8.2
of the General Bylaws is adopted under Article 16, final decisions
for scenic road renovations would rest with an elected body
(Selectmen), rather than an appointed one (CPDC). Following a brief
discussion relative to-'the wording of the motion under this article,
Mr. Cohen suggested striking the word "recommendation" from the
seventh line and inserting in lieu thereof, the words "written
consent" and striking the word "recommendation" from the eight line.
Mr. Hechenbleikner agreed with Article 20 allowing several options
for distribution of the FinCom Report to Town Meeting Members, i.e.
picked up at the police station, delivered by Precinct Captains to
members of their precinct, with those remaining brought to Town
Meeting, thereby eliminating postage.
Minutes of Meeting #191 were read and accepted, as amended, by a
vote of 5-0.
Article 10: On motion of Jack Russell, seconded by Ed Murphy, the
Bylaw Committee voted to recommend Article 10 by a vote of 5-0.
Article 16: On motion of Ed Murphy, seconded by Dolores Carroll, the
Bylaw Committee voted to recommend Article 16, as amended, by a vote
of 3-2.

Article 17: On motion of Ed Murphy, seconded by George Theophanis, the
Bylaw Committee voted to recommend Article 17 by a vote of 5-0.
Article 18: On motion of George Theophanis, seconded by Ed Murphy, the
Bylaw Committee voted to recommend Article 18 by a vote of 5-0.
Article 19: On motion of George Theophanis, seconded by Dolores Carroll,
the Bylaw Committee voted to recommend Article 19 by a vote to 5-0.
Article 20: On motion of Ed Murphy, seconded by Jack Russell, the
Bylaw Committee voted to recommend Article 20 by a vote of 3-2.
Article 21: On motion of George Theophanis, seconded by Ed Murphy,
the Bylaw Committee voted NOT to recommend Article 21 by a vote of 5-0.
