APPEALS .6 LOWELL STREET ZONING BOARD OF APPEALS READING, MA MINUTES - FEBRUARY 18, 1988 Members Present: Catherine Quimby John Jarema Stephen Tucker Ardith Wieworka Chairman Quimby openend the meeting at 7:30 PM, February 18, 1988 in the Selectmen's Meeting Room, 6 Lowell Street, Reading, MA. The meeting was called to order, and the Board members began by discussing and endorsing the letter composed by the Board addressed to the Town Manager regarding the proposed negotiated agreement for Eric's Greenhouse. Discussion then moved on to include approval of minutes of January 6 and January 20, 1988. John Jarema made a motion to accept minutes of January 6, and the Board voted unanimously its approval. Stephen Tucker then.moved to accept minutes of January 20 as amended. The Board also voted unanimously to accept these minutes as amended. At 7:55 PM Chairman Quimby called the scheduled public hearing to order. The subject hearing was a continuance of Mr. Joseph Machnowski of 227 Woburn Street seeking Special Permit for an accessory apartment. The hearing had again been continued to allow clarification with the building inspector as to the compliance with state law of the door entering into the garage from the accessory apartment, and also per request of the Petitioner, to allow a final review of his plans for submittal to the Board tonight. Catherine Quimby then read a letter from Mr. Machnowski stating his appreciation to the Board in making the effort to keep all safety and zoning laws in mind while reviewing his case in order to eliminate the possibility of any problems arising once construction begins in the spring. Following discussion with the building inspector, the Board was satisfied and made it clear to the Petitioner that the access into the garage was within fire code if the door was a fire door. The Petitioner stated it February 18, 1988 ZONING BOARD OF APPEALS Page 2 was his intention to use such a door. He then submitted his final plans. After review of the plans, Ardith Wieworka moved to grant Special Permit to Joseph Machnowski to allow for installation of an accessory apartment at 227 Woburn Street under Sections 4.3.2. and 4.3.2.8. of the Reading Zoning By-laws as shown on plan (Exhibit A) dated October 1987. Stephen Tucker seconded the motion, and the Board voted unanimously to grant Special Permit. Mr. Machnowski then inquired whether Special Permit was the same as a Building Permit, i.e., would he need a Building Permit at the time of construction. Catherine Quimby clarified this matter as well as the time frame involved and procedures to be followed. The hearing was then adjourned at 8:05. A lengthy discussion then ensued regarding the Machnowski petition and the time and effort put forth by all parties involved as well as the importance of clarifying all associated documentation on the case for future reference. Ardith Wieworka stated she would review and revise the minutes and notes taken in previous hearings and reflect a clear picture in her writing of the decision on the case. The Board members then gave final review to the 1987 Annual Report for Zoning Board of Appeals*. Stephen Tucker then made a motion to approve the report as presented by Catherine' Quimby. Ardith Wieworka seconded the motion, and the Board voted unanimously its approval. The meeting was then adjourned at 9:00 PM. *Copy of report attached. Respectfully submitted by Pamela A. There were twenty-five applications for a Special Permit: two were withdrawn; twenty-two were granted-and one is still pending. Fourteen of those granted dealt with additions, alterations or extensions to a non--conforming structure. One was for the construction of townhouses, Greenhouse Acres, which the Board deliberated on at five separate hearings. Five were for Accessory Apartments, four of which were granted and one is still pending. One Special Permit granted was to allow off- street parking under Section 6.1.1.2. for TASC. The final two granted allowed for construction of a single-family dwelling on an undersized lot. Twenty-eight, applications for Variance were received of which fourteen were granted; eight were denied and six were withdrawn. One request granted authorized an eighteen month extension of a previously granted use variance to the Reading Gymnastic Academy. Ten extended relief to structures that do not conform to present zoning regulations but have been in existence for at least seven years without complaint., and were constructed with a legal building permit. The remaining three granted were to allow for an extension of a'present one car garage into the side lot setback and two decks which also encroached into the side lot setback.
