ZONING BOARD OF APPEALS
MINUTES FEBRUARY 23, 1989
Members Present: Catherine Quimby, Chairman
Stephen Tucker
Sally Nitzche
A meeting of the Zoning Board of Appeals was held in the
Selectmen's Meeting Room, 6 Lowell St. Reading, MA.
At 7:40 PM the continued public hearing for Continental Health
Care which was continued from January 19, 1989 began.
Chairman Quimby read a letter from Latham and Latham dated
February 15, 1989 asking for a further continuance of 30 days so
that the applicant could continue discussion with the Marshalls
Department Store regarding alternative parking on their property.
After a brief discussion on the date for the continued public
hearing to be held Sally Nitzche moved to continue the public
hearing for Continental Health Care until March 30, 1989. Mr.
Tucker seconded and the motion passed with a vote of 3-0.
At 7:51 PM Stephen Tucker moved to close the public hearing.
Sally Nitzche seconded and the motion passed with a vote of 3-0.
GENERAL DISCUSSION
At 7:55 PM Stephen Tucker discussed the meeting with Fafard that
was held on February 16, 1989. The Board discussed the changes
in the plans for The Community Center and Greenhouse Acres.
The Board then had an informal discussion on the zoning by law
change to allow for daycare.
PUBLIC HEARING; RULES AND REGULATIONS CONTROLLING THE ZONING
BOARD OF APPEALS.
There was no public present for this public hearing. The Board
discussed the proposed amendments to the Rules and Regula-
tions.After a lengthy discussion the amendments were as follows:
Section 3 Notice and Public Hearing
3.1 add to end of sentence.; first paragraph
Assessors, Conservation Commission, Board of Health, Community
Planning and Development Commission as well as neighboring com-
munities and state agencies.

3.1 Amend second paragraph by changing the word "two" to "one"
so that the last sentence reads as follows:
....Chapter 40A, Section 11; and shall provide one complete
set of stamped business-size envelopes addressed to each abutter
indicated on the above certified list."
3.1 Change last paragraph to read:
Copy of entire application shall be forwarded to all members of
the Board as well as to Town Clerk, Building Inspector, Town En-
gineer and Recording Secretary.
3.1 Amend first paragraph so that it reads as follows:
Notice-Legal Notice of hearings shall be advertised as required
by Massachusetts General Laws, Chapter 40A, Section 11 (cost of
which to be born directly by the applicant.) new wording in
parenthesis.
5.3 Change to read:
Submit proposed amendments in writing to the Board, review of
proposed amendments by the Board at a'public hearing, submission
for review to Town Manager and Town Counsel and final action by
the Board at a subsequent regular meeting.
Chairman Quimby then stated that she would type up the proposed
amendments and submit then for review to the Town Manager and
Town Counsel.
The Board discussed the possibility of attaching the instructions
to the Rules and Regulations.
The Board then discussed the suggested amendments to Section 2.2
made by -one of the members. After a discussion they were as
follows:
Section 2 Organization of the Board of Appeals
2.2 Associate Members- Amend so that last sentence reads: The
Chairman shall rotate assignment (s) among the Associate Members
to afford them the necessary experience. (Thereby striking the
words "an attempt shall by made by the" and changing "to" to
"Shall".)
Amend the third paragraph by striking the word "shall" to "may"
so that paragraph reads as follows:
Associate Members may participate and vote at all business
meetings of the Board of Appeals .
At 9:08 PM Sally Nitzche moved to close the public hearing. Mr.
Tucker seconded and the motion passed with a vote of 3-0.
Sally Nitzche then moved to approve the minutes of December 15,

1988. Chairman Quimby seconded and the motion passed with a vote
of 2-0.
A motion was then made and seconded to adjourn and the Board
voted unanimously to do so.
