A meeting of the Zoning Board of Appeals was held in the
Selectmen's Meeting Room of the Town Hall, 16 Lowell Street,
Reading, MA at The scheduled Public Hearing was on the petition of Reginald
T. eter g e ra. M. Longo, and George A. Peters, Treacy Buildings
Inc., et al3 who were seeking a Variance and/or Special Permit
under ec:tio 4.4.4.2 o the Reading Zoning By-Laws to allow

Mr. _,,rra Latham, repres'.:lp".in the applicants, gave brief
e?epcripL":1_on of the property. He state that the property
cctained approximately 3.5 acres of land. it is locates
partially i an S--10 and partially in an S-20 zoning district.

five new dwellings within a small subdivision on the property.

'r. Latham then stated that because the zoning map indicates
that the flood plain is situated on a portion of the property,
applicant Special s Permit under Section 4.4.4.2.

Mr. Latham also submitted letters from neighbors in the area
stating that the land is not subject to flooding. He also
submitted decisions from other cases in the area. He also

the CPDC. Both Boards have found that the land is not subject
to flooding and that it is suitable for human occupancy. He
also stated that the Conservation Commission had issued a
negative determination.
%r. Latham also stated that the use of the land would not be
detrimental to the ")ubl?c health, safety and welfare. The

fd.t'_°e J. Corey, the Engineer for the project, stated that they
had do_ae hydraulic study. _ showed a map of the area showing
the culverts. state that the maximum rise in the water
elevation of the c:atc}2ma are would be a the 192 level. He
stated that the lowest elevation on the site would be 195,
therefore, there would be at least a 3 foot difference. He
also stated that. LdZeyp had done 3 test its on the site and found.

After a brief discussion Mr. Tucker moved to grant a Special
Permit to the petitioners Reginald T. Peters, Zedia M. LC°,ngo,
a','1d George A. Peters, Treacy Building Inc., under Section 4.4.4.2
to allow for buildings for human occupant on the property
located at 5B Day State Road, assessors' *`dap 95, Lot 5, Reading,
MIA on the basis that he requirements of Section 4.4.4.2 have
been met as evi:dence& by a CPDC _memo dated 3-17-92, a Board
of T'_Fealth memo dated 3- 1 3-92, a memo from the ~ Engineer

dated 3-1 2-92 g and determination from the Conservation
Commission dated 12-18-91. Ma ® Coote seconded the motion and
it passed with a vote of 3-0
At 8:00 P.M. a motion was made and seconded to adjourn and the
Board voted unanimously to do so.
