ZONING BOARD OF APPEALS
MINUTES DECEMBER, 3 1992

A meeting of the Zoning Board of Appeals was held
in the Selectmen's Meeting Room of the Town Ball, 16 Lowell
Street, Reading, A at 7:00 P.M.
The first hearing was a continued hearing on the petition
of Loretta Cavagnaro who was seeking a Variance and or an
Appeal to the Decision of the Building Inspector under
Section 5.1.2 of the Zoning By-Laws of the Town of Beading
in order to build a 16 x 16 screened porch too close to the
lot line on property located at 120 High Street.
Ms. Wieworka stated that no testimony was taken at the last
hearing held on October 15, 1992.
Mr. Timothy Kelley, representing the applicant, submitted a
memo summarizing his comments.

r. Kelley went on to say that there is a pool behind the
house that was not present on the plan. This was one
reason for building the porch. He went on to say that he
believed that the lot met the criteria for a Variance.
He stated that the Lot was a unique shape. He stated that
the lot was an acute triangular shape. He also stated that
the porch could not be put anywhere else on the lot. If it
was put on the other side of the house it would not be
useful because it would not be near the pool.
Mr. Kelley stated that it would be a hardship for the
Cavagnaros because they could not use their property.
The porch would allow them to enjoy their pool area more
as there are many bugs from the swamp area nearby. He also
stated that it would not be detrimental to the public good,
and in fact would have a positive effect on the
neighborhood.
Mr. Kelley then submitted a letter from the direct abutter
stating that they did not object to the porch. Be also
stated that it would not derogate from the intent of the
by-law.
The Board discussed that although there was a good argument
that the lot was unique the encroachment would be
significant. The Board asked the applicant if they would
consider a 16 x 13 poach, noting that it would not encroach
on one corner and the ether corner would not be as
significant. They also stated that they would be more
comfortable with this size.
The applicant stated that a 16 x 13 porch would be
sufficient. They also withdrew their petition to Appeal
the Decision of the Building Inspector.
At 7:45 P.M. Mr. Tucker moved to grant a Variance on the
property located at 120 Nigh Street on the petition of
Loretta Cavagnaro who seeks to construct a 16 x 13 foot
screened porch located on the northerly side of the house
which shall extend no closer that 11 feet to the northerly
side lot line on the condition that the petitioner submit
a certified plot plan showing the location of the screened
porch. Mr. Coote seconded and the motion passed with a
vote of 3-0.
The next hearing was on the petition of Eric Wurzbacher
who was seeking a Variance under Section. 5.1.2 of the By-
laws in order to construct a addition to the side of the
dwelling on property located at 3 Harriman Avenue, Reading
MA.
Mr. Wurzbacher stated that they would like to build a half
bath as they only have one bath in the house. Be stated
that they have 2 children now and one on the way. He felt
that it would enhance the property. He then discussed that
this would be the best spot to put the bathroom.
The Board discussed that the house was built in 1926 or
1927 and was already non-conforming. They discussed that
if the bathroom stayed within the lines of the house only a
Special Permit would be needed.
Mr. Wurzbacher asked to amend his application to read a
Special permit under Section 6.3.3.4
At 8440 Mr. Jarema moved to accept the petitionerĀ°s request
to amend his application. Mr. Tucker seconded and the
motion passed with a vote of 3-0.
At 8:41 r. Jarema moved to grant a Special Permit to Eric
Wurzbacher who seeks a Special Permit under Section 5.3.3.4
of the Reading Zoning Bar--Laws to add a one story addition
to the Easterly side of the house located at 3 Harriman
Avenue, Reading, MA which shall not protrude beyond the
east gall of the building and shall be no closer that 103.3
feet to the Northeasterly lot lime. Mr. 'ducker seconded
and the motion passed with a vote of 3--0.
At 8:50 P.M. a motion was made and seconded to adjourn and
the Board voted unanimously to do so..
