HomeMy WebLinkAbout1993-06-03 Zoning Board of Appeals MinutesTOWN OF READING ZONING BOARD OF APPEALS MINUTES JUNE 3, 1993 Members Present= Stephen Tucker, Acting Chairman Carol Scott John Coote A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, MA at 7:00 P.M. The first hearing was the continued hearing on the petition of Andrew and Viwanna Buck. Mr. Tucker stated that Mr. Buck had notified the Board that there had been a medical emergency in his family and he could not attend the hearing tonight. He had asked that the hearing be continued so that he could attend. The public present asked that the abutters be notified of the continuance date. The abutters at #67 and #63 Riverside Drive asked to be notified by mail of the continuance date. At 7010 P.M. Mr. Coote moved to continue the hearing until July 15, 1993. Ms. Scott seconded and the motion passed with a vote of 3-0. The next public hearing was on the petition of James and Laurea Nugent who were seeking a Variance from Sections 5.1.2 and 2.2.13 of the Zoning By-Laws to allow a common driveway easement over Lot 2 to access Lot 1 (on plat 196 of the Assessor's Map) and to allow less than the required area on Lot 1 for a buildable lot in a 5-20 District for property located at 511 Pearl Street {as shown on a plan of land filed with the Town of Reading dated 3-8-93. Mr. Brad Latham, representing the applicant stated that they would like to withdraw the request for the Variance for the size of Lot 1 and would only be looking for the common driveway Variance. He then submitted a plan where the lot lines had been moved so that Lot 1 would have sufficient area. He also stated that the Nugent's had been working with the Town for 3 years in order to make 4 buildable lots for their 3 sons. Mr. Latham then discussed the criteria for the Variance. He stated that the location of the wetlands made lot 1 and lot 2 unique. He also stated that if the Variance was not granted the subdivision could not go forward and this would be a hardship. Mr. Latham then submitted memos from the Town Engineer and the Town Planner stating that due to the location of the wetlands on the site, a common driveway would be the best choice, He also read a letter from the Conservation Commission stating the same thing. The engineer present from Hayes Engineering discussed that having one 15 foot driveway that would service both lots would be less disturbing to the wetlands than two 12 foot driveways with a barrier in between. He also stated that they were encouraged by CPDC to do this. It was discussed that both lot 1 and lot 2 had 120 foot frontages. The Board discussed that when the Variance was given last year, it was given with the condition that the roadway not be changed. The engineer stated that only the cul-de-sac was changed, not the roadway. Mr. Coote questioned whether the cul-de-sac would conform to the 60 foot circle by-law. Mr. Latham stated that this was not a By-Law when Mr. Nugent started this project, therefore, he felt that it would be grandfathered. The Board discussed that they did not like the way the lot line was shaped for lot 1 and would rather see the applicant ask for the area Variance. Mr, Latham stated that originally they were going to ask for the two Variances but did not want to complicate the request. He stated that they would like to request the variance for area. At 8:30 P.M. Ms. Scott moved to allow a Variance under Section 5,1.2 and 2.2.13 of the Reading Zoning By-Laws on the petition of James and Laurea Nugent to allow for a common driveway easement over lot 2 to access lot 1 and for allowing less than required area on lot 1 which is 17,470 square feet as a buildable lot in an S-20 district for the property located at 511 Pearl Street, Reading, Ma as shown on the plan for Nugent Lane dated 3-8-93 by Hayes Engineering. Mr. Coote seconded and the motion passed with a vote of 3-0. At 8:35 P.M. a motion was made and seconded to adjourn, and the Board voted unanimously to do so.
