HomeMy WebLinkAbout1994-03-10 Zoning Board of Appeals MinutesTOWN OF READING ZONING BOARD OF APPEALS MINUTES RC 1-0, 1994 MEMBERS PRESENT: JOHN JAREM , CHAIRMAN STEPHEN TUCKER JOHN COOTS meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, A at 7:00 P.M. It should be noted that this meeting should have been held on March but was cancelled due to weather conditions. The first hearing was on the petition of Barry M. Sullivan who was ;peeking a Special Permit under Sections 6.3.3.3 and 6.3.3.4 of the Zoning By-Laws to permit the elimination of the attached garage area of the non--conforming structure located at 4 Lewis Street and permit its conversion to a family-room. Mr. arem a l tie from the u11 v n' ate aneyY Christoher C. Fallon, stating that neither he nor the petitioners could be present at this meeting. He also asked that the hearing be continued until April 7, 1994. 14P also stated that the 8ullivans were willing to extend t time allowed to render a petition as to a Variance r until April 22, 1994 c f'm11 P.M. Mr. Fucker moved to continue the bearing until Aril , 1994. Mr. Coote seconded and the motion passed with a vote of 3-0. The neat hearing was on the petition of Frederick J. Ravens III who was seeking a Variance under Section 5.1.2 for a rear and side yard set back for the addition to the structure located at 198 Ash Street and located in a Business A Zone. Dr. Ravens then discussed that he had owned the property since 1978. He stated that currently he had one treatment room and a lab and sterilization area.. He stated that it took 10 minutes to sterilize the treatment room between patients. He would like to add an addition so that he could have 2 treatment rooms to make the patient flow easier. With the new OSHA Laws working time had been reduced. He would also like to have a separate Lab and Sterilization room according to the regulation. •--a Brialn Woods, the arc `itec:t for the project, then d _usse that the lot Ll Pie shaped. They would be adding 2 .7 square feet whicaa ti,I-ould bring the required parking spaces up to 10. They would have 12 parking spaces. He also stated that can the back of the property they would like to make a new access for the employees, There is a spiral staircase there now which is very tight. He stated that they would be asking for 2 Variances, one for the side yard., and. one for the back yard. Mr. Woods then discussed the criteria needed in carder to receive a Variance. she seated that the new regulations by OSHA have created a hardship and working time has been reduced. They would like to make the working environment more efficient. He stated that he had tried to stay inside the footprint of the building, but that it could not be done. Mr. Woods also stated that they have not exceeded the non-conformance there now. The only thing they would be increasing was the work flow. Mould not be detrimental to the neighbors. He also stated that the shape of the lot ima.de it unique. All rather lots that abut the property have 4 sides. If this lot was square, the addition would fit onto it without being non-conforming. Dr. Ravens then discussed that he had looked at rather properties, but would like to stay in Reading. He also stated that the new OSHA regulations were not optional, that they had to be dune. He discussed that he had 2 Hygiene roams with. 1 full--time hygienist and 3 part time hygienists. Mr. cote had difficulty with the basement area not being used as square footage as it was used to held machines that wer used for the business. It was decided to add the s U._". footage of the basement which would bring the _d parking spaces up to 13. Mr. Woods stated that they could fit 13 parking spaces on the lot. At 8:35 R.M. Mr. Tucker proved to grant a Variance to Frederick J. Ravens III under Section 5.1.2 for rear yard set back at the structure located at 198 Ash Street located in a Business Zone for proposed addition at the rear of the structure, Said addition to be 13.4 feet from rear lot line and for proposed addition to Northerly side of structure that will came 10.5 feet of rear lot line and a front yard setback of 41.9 feet with condition that they conform to set backs shown on plan of land dated 1-21-93 by Middlesex Survey Inc. Also, 13 parking spaces required with one of them being marked handicap.
