H 5 Z GO i TOWN OF READING ZONING BOARD OF APPEALS MINUTES OF FEBRUARY 15, 1996 MEMBERS PRESENT: JOHN COOTE, CHAIRMAN ARDITH WIEWORKA SUSAN GASKILL A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:OOPM. The first Public Hearing was a continuation on the petition of David Gentile who seeks a variance from Section 5.1.2. or Special Permit Section 6.3.1.3. of the Zoning By-Laws in order to remove an existing structure and to construct a single-family dwelling on the property located at 26 Eaton Street in Reading, Massachusetts. (Case #95-23) Mr. Coote reviewed documents sent to him by Town Counsel and the Building Inspector. Town Counsel stated that the copy of the deed dated May 5, 1926 describes the property exactly as it exists today. Therefore, it appears that at the time of this lot's recording or endorsement, it conformed to the then existing zoning requirements, since in 1926 the current area requirement was not in effect. He received a January 24, 1996 certification from Attorney Mark J. Favaloro of Favaloro & Schreiber who states that he has performed a title examination of the property, and certifies "that no owner of the land known as and numbered 26 Eaton Street, Reading, MA as further described on the attached deed, held any land in common ownership therewith in or after 1978." Mr. Glen Redmond, Building Inspector, stated in a letter to Mr. Coote, that upon receiving information from Town Counsel, he now states issuing a building permit is proper for this location. Upon receipt of acceptable building plans, application, fee, etc., a building permit will be issued. Mr. Coote recommended to the Board that the petitioner be re-imbursed for fees incurred for an application and advertising. He will make the recommendation to the Building Inspector to reduce building permit fee by any fees, etc. paid by the petitioner for ZBA. The petitioner, David Gentile, requested to withdraw his request for a variance or special permit without prejudice. At 7:1 OPM, a motion was made and seconded to withdraw the petition of David Gentile seeking a variance from Section 5.1.2. or Special Permit Section 6.3.1.3. of the Zoning By-Laws in order to construct a single-family dwelling on the property located at 26 Eaton Street without prejudice. VOTE 3 - 0 (passed) At 7:1 OPM, a motion was made and seconded to adjourn, and the Board voted unanimously to do so.
