HomeMy WebLinkAbout1996-03-21 Zoning Board of Appeals Minutesfop i MEMBERS PRESENT: TOWN OF READING ZONING BOARD OF APPEALS MINUTES OF MARCH 21, 1996 ARDITH WIEWORKA JOHN JAREMA CHRISTOPHER VACCARO A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading,. Massachusetts at 7:OOPM. Ms. Wieworka swore in, under oath, those present that would be addressing the Board this evening. The first Public Hearing was on the petition of William Sinatra viho seeks a variance and/or a special permit under Section(s) 5.1.2., and/or 6.3.2.1. of the Zoning By-Laws in order to construct a 2nd level on a non-conforming structure on the property located at 19 Wilson Street in Reading, Massachusetts. (Case #96-2) Mr. Sinatra stated that his intent is to build a second floor addition over present first floor family room. He would like to expand the second floor to allow for an additional bedroom and bathroom for his family. He stated that he has lived in Reading for twenty years and has lived at 19 Wilson Street for eight years and does not want to move. The original house was a two bedroom Cape. The house currently has three bedrooms. In 1992, he added a deck to the property and at that time added a bedroom. He finished the basement to allow for an additional bedroom and a playroom. Mr. Sinatra stated that the houses on both sides of his property already have full second stories and he feels his property will fit right into the neighborhood. He cannot go back any further due to an existing inground pool. He stated that an extension to the rear of the property would interfere with the use of the pool and would probably result in the removal of the pool. He stated that the rear of the lot is a wetland and it would probably require permits from the Conservation Commission. The Board found that the topography of the property was unique because of the closeness of the rear lot line of the property to a brook, as well as the location of a portion of the property within what appears to be a buffer zone adjacent to a wetland. The Board noted that to refuse to allow the petitioner a variance to construct the proposed second story addition would create a hardship to the petitioner. The Board noted that the granting of the 7 variance to the petitioner would not result in a substantial detriment to the public good and would not nullify or substantially derogate from the intent or purpose of the Zoning By-Law. The Board also found that the proposed addition would not be substantially more detrimental to the neighborhood than the existing non-conformity of the dwelling. At 7:55PM, a motion was made and seconded to grant a variance under Section 5.1.2. and a special permit under Section 6.3.3.4. of the Zoning By-Laws to allow the construction of a second story addition to the dwelling along the rear of the dwelling, provided that such addition is built entirely within the existing building foot-print of the dwelling on the property located at 19 Wilson Street. VOTE 3-0 (passed) At 8:l OPM, a motion was made and seconded to adjourn, and the Board voted unanimously to do so.
