Mr. Coote swore in, under oath, those present that would be addressing the Board this evening. The first Public Hearing was a continuation on the petition of Steven Rhodes and Richard S. Rhodes, Jr. who seeks a Special Permit under Sections 6.3.1.3 of the Zoning By-Laws in order to construct a dwelling on a nonconforming lot on the property located at 29 Hampshire Road in Reading, Massachusetts. (Case #96-18) Attorney Christopher Coleman, Carter & Coleman, represented the petitioners. He began by explaining to the Board the reasons why a Special Permit should be granted. The non-conformity of this lot, lot 59, is that it contains less than 15,000 square feet of area. Section 6.3.1.3 states that the Board may grant a Special Permit as long as the applicant establishes that the property satisfies six specific conditions. Attorney Coleman presented deeds for the property showing that lot 60, which abuts lot 59, the lot in question, were held in common ownership and the lots were established under`a plan of land dated in 1924, which pre-dates zoning in Reading. The assessor's map showed that lot 59 has 13,118 square feet of area. Attorney Coleman showed the Board Exhibit F Table which listed the built upon lots within the three hundred foot area. Lot 59 was similar to or greater than 12 of the lots as to frontage, and similar to or greater than 29 of the 3.8 lots as to area. The abutting lots were built upon and have at least 5,000 square feet of area and 50 feet of frontage. There were not any building plans presented so the Board stated that if a Special Permit is granted it will be up to the Zoning Enforcement Officer to enforce all other zoning requirements. Mr. Tim Pressy, 32 Hampshire Road, who lives directly across from lot 59, is in favor of developing the lot. At 7:32PM, a motion was made and seconded to grant the petitioners a Special Permit under Section 6.3.1.3 of the Zoning By-Laws of the Town of Reading to establish lot 59 as shown on the Assessor's Map 130, Revised January 1, 1991, as a buildable lot. VOTE 3-0 (passed) At 7:35PM, a motion was made and seconded to adjourn, and the Board voted unanimously to do so. Due to lack of quorum, the meeting was continued to October 10, 1996 at 7:OOPM. Case #96-18, 29 Hampshire Road was rescheduled to October 10, 1996 and Case #96-17, 11 John Street and 2 Lakeview Avenue was rescheduled to October 17, 1996.
