ZONING BOARD OF APPEALS
MrINUTES OF DECEMBER 19, 1996

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:OOPM. Mr. Coote swore in, under
oath, those present that would be addressing the Board this evening.
The first Public Hearing was on the petition of Atlantic Realty Trust who seeks a variance under
Section(s) 5.1.2. and 5.2 of the Zoning By-Laws in order to construct/extend a structure into the
required rear yard on the property located at 30-32 Haven Street in Reading, Massachusetts.

A request was made to continue the hearing to February 6, 1997. A motion was made and
seconded to grant a continuation to February 6, 1997 and the Board voted unanimously to do so.
VOTE 3-0 (passed)
The next Public Hearing was on the petition of David DeCologero who seeks a Variance under
Section(s) 4.10.4.3. of the Zoning By-Laws in order to construct a dwelling within the minimum
J setback of 60'-0" in a Planned Residential Development on the property located at 27 Back Bay
Court in Reading, Massachusetts.
(Case #96-22)
Mr DeCologero addressed the Board by stating that he wanted the 60'-0" setback moved to
45'-0" in order to have the structure of the house in an adequate location on lot 3 for desirable
living and more considerate room for living space and to preserve the nature of the trees and its
surrounding. He presented the Proposed Plot Plan of Dwelling showing the footprint of the
proposed house in compliance of the by-laws and also a Plot Plan showing Change in Restriction
Line showing a 45'-0" restriction line. Mr. DeCologero stated that the trees he wished to preserve
were located to the right side of the lot and could not remain if he followed the 60'-0" setback.
The Board discussed this case and found that this lot was not unique as to size, shape or
topography. They also determined that hardship was not a factor, as this lot was vacant which
allowed for modifications to plans before building begins. Setting the house back further from the
street would be beneficial from a esthetic and safety stand point. The Board felt that the 60'-0"
setback was the standard for a PRD and Case #1996-20 had recently been denied for the same
request, which included other lots in this PRD.
A motion was made and seconded to grant the request for a variance from Section 4.10.4.3. of
the Zoning By-Laws of the Town of Reading in order to construct a dwelling within the minimum
setback of 60'-0" in a Planned Residential Development on the property located at 27 Back Bay
Court (PRD Lot #3) in Reading, Massachusetts.
VOTE 0-3 (denied)
A motion was made and seconded to adjourn, and the Board voted unanimously to do so.
VOTE 3-0 (passed)
