ZONING BOARD OF APPEALS

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:OOPM. Mr. Tucker swore in, under
oath, those present that would be addressing the Board this evening.
The first Public Hearing was on the petition of David W. Williams who sought a Special Permit
and a Determination of Flooding and Suitability under Section(s) 4.4.4. / 4.5.5. of the Zoning
By-Laws in order to permit the use of land in a Flood Plain District for single-family dwellings on
the property located at Map 91, Plot 1 Salem Street, in Reading, Massachusetts. (Case #97-30).
The petitioner was represented by Attorney Steven L. Cicatelli, of Cicatelli & Cicatelli, who
stated that he had appeared before the Board of Health, and presented a letter that the Board of
Health agreed with the engineering flood stage change to 193 feet, noting this as 2 feet above
flood stage, voted to accept the plan. The Community Planning and Development Commission
sent a letter stating that they found that the portion of the above-referenced property lying above
elevation 190.25 feet, is not subject to flooding and is not unsuitable for human habitation, and
development thereof would not be detrimental to public health, safety, or welfare, according to a
memorandum dated March 5, 1998, of the Town Engineer. This case was not heard before the
Conservation Commission.
At 7:50PK a motion was made, seconded and unanimously voted to grant a Special Permit under
Section(s) 4.4.4. / 4.5.5. to allow the petitioner to build two single-family homes on Lot A and
Lot B as defined on Subdivision Plan of Land, dated March 7, 1997, revised February 18, 1998
and March 6, 1998, as prepared by Chester Redmond, subject to the following condition: owners
return to Conservation Commission for filing of "Notice of Intent".

At 8:OOPM, a motion was made and seconded to adjourn, and the Board voted unanimously to do
so.
