A meeting of the Zoning Board of Appeals was held in the Selectmen's
Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts
at 7:OOPM. Mr. Coote swore in, under oath, those present that would be
addressing the Board this evening.
The first Public Hearing was on the petition of Thomas Guarino who seeks a
Variance and/or Special Permit under Section(s) 5.0 / 6.3 of the Zoning By-
Laws in order to construct a second level and to add a two-story addition to
the rear` on the property located at 12 B Street in Reading, Massachusetts.
(Case #98-11)
The petitioner represented himself and had previousely come before the
Board and was issued a finding under Section 6 of the Massachusetts
General Laws to allow the second level and a two-story addition, Case 97-
27. Town Counsel has now advised that the petitioner needs to obtain a
Variance and/or Special Permit in order to begin construction.
The petitioner is now requesting a second level addition only, not the two-
story addition in the rear. The Board stated that now a Variance would not
be required, just the Special Permit.
The Board reviewed a plan dated February 2, 1998, prepared by Ranere
Associates, Inc. The construction of the second floor above the existing
structure would not be detrimental to the neighborhood.
A motion was made, seconded and unanimously voted to grant a Special
Permit under Section 6.3.3.4 of the Zoning By-Laws to allow the petitioner
to construct the proposed additional story to the dwelling, in.accordane with
the Plan; provided that there is no change in the dwelling's footprint, and the
proposed addition to the rear of the dwelling shall not be constructed.
VOTE 3-0 (passed)
The next Public Hearing was on the petition of Laura Breton Kittery (Breton
Realty Trust) who seeks a Variance / Special Permit / and an Appeal from
the Decision of the Building Inspector under Section(s) 5.0 setback / 6.3.3
nonconforming structure of the Zoning By-Laws in order to enclose a front
porch under an, existing roof on the property located ar 3 Smith Avenue in
Reading, Massachusetts. (Case #98-08)
The petitioner explained that this is the home of her elderly parents. She is
seeking permission to enclose the porch to make an entrance hallway. There
will be no extension of the building.
The Board determined that a Variance would not be needed, and there is no
increase in the existing nonconformity.
A motion was made, seconded and uanimously voted to grant to Laura
Breton Kittery for the property at 3 Smith Avenue, a Special Permit to allow
the construction of an enclosed front entryway per a plan by John
Livingstone, Jr. dated March 28, 1998.
VOTE 3-0 (passed)
The petitioner requested that the Board withdraw her request to overturn the
Decision of the Building Inspector, which was unanimously voted.

The next Public Hearing was on the petition of Marie and Francis Higgins
who seeks a Variance and/or Special Permit under Section(s) 5.0 / 6.3.3 of
the Zoning By-Laws in order to construct an addition and deck on the
property located at 136 Summer Avenue in Reading, Massachusetts. (Case
#98-09)
Attorney Mark Favaloro represented the petitioners. The owners reside in
the property, which is located at the corner of Summer Avenue and Glen
Road. Attorney Favaloro submitted a petition signed by neighbors that abut
the property in support of their request.
Lot coverage was checked and calculated as 28%. Attorney Favaloro
requested a continuation of this Public Hearing. .

A motion was made, seconded and unanimously voted to grant a
continuance of the Public Hearing to July 16, 1998.

The next Public Hearing was on the petition of the YMCA of Greater
Boston, Inc. who seeks a Special Permit under Section(s) 4.2 / 4.2.2 / 2.2.6 I
7.3 / 6.3.2.1 / 7.4.2.3 of the Zoning By-Laws in order to construct a
Combined Service Use (swimming pool facility) on the property located at
36 Arthur B. Lord Drive in Reading, Massachusetts. (Case #98-10)
Attorney O. Bradley Latham represented the petitioners. Paul Gorman,
Executive Director of the YMCA Reading branch and Bill Jennings,
Construction were also present at the Hearing.. - The YMCA is a nonprofit
organization. With a generous donation by Nelson Burbank, the YMCA is
able to add two indoor swimming pools to its current location. Attorney
Latham stated that the Board of Selectmen, FinCom, the Recreation
Committee, and Town Meeting are all in support of this project.
Discussion continued about parking, off-site childcare, hours of operation,
rates, and abutters.
The Board instructed the petitioner to meet with CPDC and the Conservation
Commission and then return to the Board with their reports.
A motion was made, seconded and unanimously voted to grant a
continuance of the Public Hearing to July 16, 1998.
VOTE 3-0 (passed)
At 10:05PK a motion was made and seconded to adjourn, and the Board
voted unanimously to do so.
