HomeMy WebLinkAbout1998-08-06 Zoning Board of Appeals MinutesTOWN OF READING ZONING BOARD OF APPEALS MINUTES OF AUGUST 6, 1998 a e. st€ 4: A MEMBERS PRESENT: CHRISTOPHER VACCARO, CHAIRMAN JOHN COOTE LAURA, GREGORY A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:OOPM. Mr. Vaccaro swore in, under oath, those present that would be addressing the Board this evening 01 The first Public Hearing was ion the petition of-Anita Sybertz who seeks a Special Permit under Section(s) 4.3.2.8 of the Zoning By-Laws in order to allow an accessory apartment to, remain on the property located at 56 Wakefield Street in Reading, Massachusetts. (Case #98-14) The petitioner represented herself. She explained to the Board that she purchased the house one year ago. She received a document at that time from Remax Realtors and told that the apartment was legal. Recently, she decided to do some remodeling to the kitchen.and was denied a building permit. She stated that she lives in the smaller portion of the house and her nephew lives in the main hour with his children. Mr. Coote was concerned abort the exits from the apartment and stated that three parking spaces must be stained on the property. The petitioner presented evidence that the dueling was built prior to August 1, 1982 and the size of the accessory apartment and the building density was appropriate under the by-laws. The Building, Inspector will inspect to make sure that all building code requirements are met and safety devices are installed. The appearance of the house is of a one family and the owner lives on the property. At 7:35PM, a motion was made, seconded and unanimously voted to grant a Special Permit under Section(s) 4.3.2.8.2 of the Zoning By-Laws to allow the existing accessory apartment to remain on the property; provided that there is no change in the front yard parking on the property as it existed on August 1, 1982 and the accessory apartment meets all building coda requirements and fire safety devices are properly installed and maintained for the entire dwelling. VOTE 3-0 (passed) The next Public Hearing was on the petition of Cellco Partnership d/b/a Bell Atlantic Mobile who seeks a Special Permit under Section(s) 4.3.5 of the Zoning By-Laws in order to locate a commercial communication structure on the property located at 2 Summit Drive in Reading, Massachusetts. (Case #98-15) Attorney Mario L. Simeola represented the petitioner. Also present were company representatives. Attorney Simeola explained that they intended to erect cellular telephone antennae on the side of the penthouse at the roof of the building, to utilize a storage room in the basement and to install an emergency generator outside, the building. The antennae would be.painted to match the color of the penthouse in order to reduce visibility. A plan was submitted showing details of the proposed installation. The petitioner was unable to explain exactly where the generator would go so the Board determined that they would continue the hearing to allow the petitioner to present more detailed information. The Board was concerned with the noise of the generator and more information about that will be given. The petitioner stated that licensing, health and safety, and certification would all be complied with and requested a vote tonight for the Special Permit, as it could operate without the generator. A motion was made, seconded and unanimously voted to continue the hearing to September 3, 1998 to enable the petitioner to provide a location for the generator and to demonstrate to the Board the noise it will make in operation. VOTE 3-0 (passed) A motion was made, seconded and unanimously voted to grant to Cellco Partnership d.b.a. Bell Atlantic Mobile a Special Permit under Section 4.3.5 of the Zoning By-Laws, for the purpose of installing a telecommunications facility on the rooftop of the building at 2 Summit Drive and a storage room in the basement conforming to plans 2717 dated April 4. 1998 by R.~ F. Cameron Associates and drawings S-1 and S-2 by Daigle Engineering undated, not including the emergency generator shown thereon. The permit is subject to the submission to the Building Inspector, prior to issue of a building permit, the certification required under items 4.3.5 f and g of the Zoning By-Laws. VOTE 3-0 (passed) The next Public Hearing was on the petition of Richard R. MacDonald who seeks a Variance under Section 5.0 of the Zoning By-Laws in order to construct an addition within the required side setback on the property located at 26 Willow Street in Reading, Massachusetts. (Case #98-16) The petitioner represented himself. He stated to the Board that he is seeking to add a bathroom to the first floor of his two-story home. He finds this a hardship for his family and for elderly relatives that visit, as there is no other bathroom on the first floor. The Board found that lack of a bathroom on the first floor is a unique situation and this request met the requirements needed to obtain a variance. A motion was made, seconded and unanimously voted to grant a Variance from Section 5.1.2 of the Zoning By-Laws, Table of Dimensional Controls, and a Special Permit under Section 6.3.3.4 of the Zoning By-Laws for the construction of a bathroom with the dimensions of 3'6" by 12', including the present projection and limited to a single story, on the west side of the first floor of the dwelling located at 26 Willow Street as shown on the plot plan dated April 22, 1998, by James R. Keenan. VOTE 3-0 (passed) At 9:30PM, a motion was made and seconded to adjourn, and the Board voted unanimously to do so.
