ZONING BOARD OF APPEALS

A meeting of the Zoning Board of Appeals was held in the Selectmen's
Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts
at 7:OOPM. Mr. Vaccaro swore in, under oath, those present that would be
addressing the Board this evening.
The first Public Hearing was a continuation on-the petition of Cellco
Partnership d/b/a Bell Atlantic Mobile who seeks a Special Permit under
Section 4.3.5 of the Zoning By-Laws in order to locate a commercial
structure on the property located at 2 Summit Drive in Reading,
Massachusetts. (Case #98-17)
Attorney Mario L. Simeola represented the petitioner. After discussion with
the Board, the petitioner requested to withdraw the request for a Variance
without prejudice.
A motion was made, seconded and unanimously voted to allow the
petitioner to withdraw the request for a Special Permit without prejudice.
VOTE 3-0 (passed)
The next Public Hearing was on the petition of Eric Jason Smith who seeks a
Variance and/or Special Permit and any other relief as deemed necessary the
Board of Appeals under Section(s) 5.1.2 / 6.3.3.4 of the Zoning By-Laws in
order to construct a dormer on the property located at 12 Middle Street in
Reading, Massachusetts. (Case #98-20)
Attorney Steven L. Cicatelli represented the petitioner. He stated that the
property is located in an A40 district having an area of 8,579 square feet and
frontage of 65 feet containing a two story dwelling which as three
apartments. The property does not conform to the requirements of the By-
Laws as to area, frontage, front yard set back, and side yard set backs.
It appears as a single-family dwelling, but has two apartments on the ground
floor, and the owner's apartment which is in the attic. The dormer would
increase light, air and headroom in the attic unit. There are only commercial
properties, two family dwellings, and a parking lot in the area. It is unique
to have a three family dwelling in this neighborhood and a hardship with the
present window situation and roofline for the attic apartment. The dormer
would be a minor addition.
A motion was made, seconded and unanimously voted to grant to Eric Jason
Smith for the property at 12 Middle Street, a Variance from Table of
Dimensional Controls 5.1.2 for the purpose of constructing a dormer on the
north side of the house to be no closer than 15 feet from the north property
line as described in exhibit "A".
VOTE 3-0 (passed)
A motion was made, seconded and unanimously voted to grant to Eric Jason
Smith for the property at 12 Middle Street a Special Permit under Section
6.3.3.4 of the Zoning By-Laws, for the purpose of constructing a dormer on
the north side of the house to be no closer than 15 feet from the north
property line as described in exhibit "A".
VOTE 3-0 (passed)
The next Public Hearing was on the petition of Raymond and Lauren
Johnston who seeks a Special Permit under Section 6.3.1.3 of the Zoning
By-Laws in order to construct a single family dwelling on the property
located at Zero Condor Road in Reading, Massachusetts. (Case #98-21)
Many questions were raised as to lot circle, lot shape, and separate lots. The
Board would discuss some issues with Town Counsel and continue the
Public Hearing.
A motion was made, seconded and unanimously voted to continue the Public
Hearing to October 1, 1998.
VOTE 3-0 (passed)
A motion was made and seconded to adjourn, and the Board voted
unanimously to do so.
