Chairman Zorabedian called the `meeting to order at 7:35 P.M. in
the Community Center Auditorium with J. Shaw and K. Messina present.
Public Hearing - Article 12
Pursuant to Section 5, Chapter _4 OA, General Laws, a public
hearing or this proposal was held. on Thursday, March 26, 1981, in
the Community Center Auditorium, 52 Sanborn Street, with Board
members K. Messina, J. Shaw and Chairman J. Zorabedian present.
There were no citizens present at this hearing.
In accordance with Section ll,. Chapter 40A, General Laws, the
public notice was published in the Beading Chronicle on Thursday,
March 12, 1981 and,_-iarch 19, 1981 and was.read into the meeting
record.
This petition was brought to the Planning Board by the Building
Inspector. As presently written the By-la4v- 1s vague and di ffz-
cult to 'interpret_ The present wording states, "lien a non-confooming
use is discontinued or abandoned or a period of more than two (2)
years, etc." The new paragraph reads, ",,ner_ a non--conforming use
is not used for a period of two (2) ' or more years, etc."
The present. wording is vague and could be interpreted to mean that
the owner would have to take a -positive, formal action to declare
the use discentinue.d or abandoned. The rewording as proposed in
this By-lain 'revision is a more positive statement.. It allows the
Building Inspector to make a better determination because as
reworded the By-ia;., does not call for any formal action on the
part of the owners to declare the use abandoned or discontinued.
it is a matter of fact that if t_'?e use has not been used for a
period of tT7o (2) or more years, then the Building Inspector has
the absolute right not to reissue a Build`'ing Permit for such non-
conformity. The owner would still have legal recourse by'making a
petition to the Board of Appeals for a var? ance .
The Board conrnued this hearing for approximately 20 minutes. so

The Board unanimously voted to adjourn the public hearing on this
matter at 8:35 P.M.

Article 13 Public Hearing
The Board considered the subject matter under this article.
Pursuant to section 5, Chapter 40A, General Laws, a public hearing
on this proposal, was held on Thursday, march 26, 1981 at 9:00 P.M.
in the Community Center Auditorium., 52 Sanborn Street with Board
members B. Mitchel, K. Messina J. Shaw and Chairman J. Zorabedian
present.
There were no citizens present at this meeting.
In accordance siith Section 11, Chapter 40A, General Laws, the
public notice was published in the Reading Chronicle on March 12,
1981 and March 19, 1981 and was read into the meeting record.
This Article was placed on the 1981 Annual Town Meeting Warrant in
response to concerns with respect to proposed future development
in the ?industrial area of the Town. The Board felt that those
residents abutting the Industrial District would not be adequately
protected by any wording within the current ZoninSF By-lairs and
thev should be afforded the same protection as those residents
abutting Business C property.
The present buffer strip requirement was passed by Town meeting
at their 1980 Annual Town Meeting by petition o the west Side
Citizens Committee. The Planning Board actively participated in
the formulation of that article and.feel that with the present
plans to phase out the dump within the next 2-3 years and the
proposal to con=ence development within this area in .the-

The Board adjourned this meeting at 9:10 P.M. to allow enough.

Upon a motion duly made and seconded, the Board unanimously voted
to recommend adopt-ion of Article 13 on tie 1981 Annual Town.t

The Board reconvened their general business meeting in.the Planning
Board office, Room 19.
Comprehensive Per_rztit Horizon Homes
.The Board reviewed the hearing on this matter held on 3/25/31.
Discussion on this matter ensued. The Board then voted to
send another letter to Chairman Anderson, Board of Appeals,
as follows
Dear Mr. Anderson:
Please be-advised that the Planning Board requires that the
following conditions be met by United Church Homes on the
proposed 97 unit Horizon Homes project at Bay State Road:
9 7 permanent-
parking spaces must be provided;
~ - Provision of a buffer strip essentially as required in
Section 5.3.1.
3. of the Town's Zoning By-lxvTs;
- Construction of a pedestrian sidewalk on-the north
side of Bay State Road with all costs borne by the
petitioner;
- That Haverhill Street be used as the primary vehicular
access and allow emergency access only from Bay State
1 Road,
The Planning Board feels that if these. conditions cannot or
will not be met by the petitioner, teen the Board of Appeals
should deny the petition.

Meeting Schedule
The Planning Board will meet on Wednesday,.4/1/81 at 7:30 PM
so that anyone wishing to respond to the above-drafted letter
may do so. The Board will attend the Comprehensive Permit
hearing at 8 PM in the COA meeting room.
The Public Hearings on Articles 14 and 16 - re: rezoning of
hand off Pleasant Street by Tambone Corp., Adams and Gentile,
et als. will be held at 7:30 and 8:15 PM res-oectively on
Thursday, 4/2/81,0
Proper audio-visua-l equipment should be provided by those
making the presentations, as per the Board's instructions.
Upon a motion duly made and seconded, the Board unanimously voted
to adjourn at 10:15 p.m.
