HomeMy WebLinkAbout1981-04-08 Planning Board MinutesMinutes of the Meeting of April 8 1981. Chairman Zorabedia.n called the meeting to order at 7:35 P.M. in Room 19, 52 5------with B. Mitchel, E. Childress and K. Messina present.. Also present at this meeting were approximately 12 citizens, including Ms. Virginia Adams, a petitioner of Article 16. Correspondence Mail was reviewed. Town.Meeting Warrant Issues Articles 14 and 16 - The Board reviewed the draft prepared by the .Secretary re: 4/2/81.public hearing on these articles. A discussion ensued. Topics covered were: "Indefinite postponement" mtion presented at the public hearing doe-s,-not have to be the actual motion: The petitioners could have some other motion considered by Town Meeting.. - The motion for "indefinite postponement" takes pre- cedence over any other motion. If no other motion is presented, then there will be no discussion of the 2 articles< A Town Meeting member can rise and move to have the subject matter of Articles 14 & 16 considered. Only then can a discussion be allowed. The motion for "indefinite postponement" cannot be arnmended but only approved or disapproved. Upon a motion.duly made and seconded, the Board considered the recommendation to "indefinitely postpone" under Articles 14 and 16 of the 1981 Annual Town Meeting Warrant. After much dis- cussion and the following considerations: Article 14 - Unless a By-law is adopted to include condominiums then the By-law can be interpreted to mean that apartment/condomium are equal under the Town's law. That condominium is a right. of ownership question and the law has not been clear on the right of a Town to legislate against condominiums. Because of the vagueness of the law in this regard the Board on a motion duly made and seconded, voted to recommend "indefinite postponement" of this article. Article 1-6-- The Board reviewed the concerns expressed at the 4/2 public hearing: water supply and quality; traffic safety, pedestrian safety, ability of Town to provide adequate Town services; payback to Town as regards the development of private homes (s10) vs. condominiums; The right of citizens who already homes in the. area to have a petitioner build high-density housing in the area when they purchased homes with, an S10 zoning and th.en have the zoning changed to A80 The Board also discussed the matter of indefinite post ponement requested at the Public Hearing by Attorney Amon. The Board had a request, by petition on the Town Meeting Warrant, to consider a zoning change from S10 to A80. The actual construction and the proposed project are not the issues, but rather the charge of zoning from S10 to A80 and all that this change will allow under the law. With advice from Town Counsel and per Chapter 40A, MGT, the Board considered the subject matter under Article 16 and held the public hearing as directed by Ch. 40A. The density of S10 vs A80 was addressed: with 23A approximately available for construction, the amount of-single residences would be less than 50; the amount of condominiums/apartments would be over 600. The question is not the size of the project, but rather the rezoning to allow this land to be developed to such a high use. Because of the adverse impacts stated above, the Board unanimously voted, upon a motion. duly made and seconded, not to recommend passage of Article 16. Mr. Zorabedian will present the Planning Board report and recom mendation under Articles 14 and 16 at Town Meeting. The Board reviewed.other matters relating to Town Meeting: The Board will request that Articles 6, 46 and 47 on the Annual and Article 16 on the Special Town Meeting Warrants be considered collectively. Article 47 will be determined by the previous votes. Articles 15 on Special Town Meeting Warrant - Public hearing will be held tomorrow evening at 7:30 P.M. Article 11 Annual; Restaurant parking will hold the public hearing at 8:30 PAZ tomorrow evening. Article 13 Board recommends passage of the article to include IND district within buffer strip dimensional controls. Article 15 - Annual; Board recommends indefinite postpone- ment of this Article because of the wording. Article 12 Annual; Board recommends passage of rewording. from discontinuance to,non-use. Article 17 - Special; Public Hearing scheduled for 4/16/81 @ RMHS, Rm 133 @ 7:30 PM t E 4/8 - Page 3 Horizon Homes - Comprehensive Permit The Board reviewed their input and that of other Town boards to the Board of Appeals re: comprehensive permit for this project. The Board is still awaiting input from BPW re: traffic count on Haverhill Street which they were conducting. Meeting Scheudle The Board approved the schedule as drafted. After instructional matters pertaining to information relative to Town Meeting given to the^Secret:ary the Board unanimously voted to adjourn at 9:30 PM. R----------- BJM
