HomeMy WebLinkAbout1981-11-10 Planning Board MinutesMinutes of the Meeting of November 10, 1981. The meeting was called to order by Chairman Mitchel at 7:35 P.M. with F. Orlando, J. Shaw and M. Rich present. Correspondence Mail was reviewed. The Board received correspondence from the Town Clerk's office with a copy of the approved by-law changes approved by Town Meeting on April 23 and June 1, 1981 signed by the Attorney General. This new Zoning By-law will be inserted into the current handbook. Town Meeting Issues ARTICLES 25 and 26 The Chairman requested that the Secretary make copies for distribution to Town Meeting members of the corrected versions of motions under Articles 25 and 26. The copy of the motion for presentation to Town Meeting was approved by the Board. Transparencies of these motions will be made for Town Meeting presentation. Included in the packet for this presentation should be the old buildings codes, old Zoning by-laws, letter from Board of Assessors and notes from Building Inspec- tor, original draft, new motion and the overhead tranparencies. ARTICLES 30 and 31 The Board again reviewed the correspondence and unanimously voted to recommend adoption of Article.30 unanimously. Article 31 was also unanimously supported by the Board and they will recommend adoption at Town Meeting. At 8 P.M. The Board adjourned to the Community Center Auditorium for the public hearing on the Flood Plain Insurance articles #27, 28 and 29 on the Fall Town Meeting Warrant. At 9:10 P.M. The Board reconvened in their office to review the public hearing and continue discussion on the listed agenda items. The Chairman reviewed the presentation given by Ms. O"Brien re: these articles and highlighted the following points: - that the Town has no protection unless Town Meeting votes these articles and that current local homeowners have no insurance coverage and the property they own is not mortgagable under present conditions, - That these homeowners are not able to sell, renovate or otherwise. obtain mortgage money for building and/or expansion under current existing conditions; - Current zoning restrictions of the Town are more severe than those allowed under Federal proposal; - There are 3 different zones: Zone A - 100 year flood with 5 levels of severity; Zone B - 500 year flood; and Zone C - out of flood. The Board reviewed the maps distributed at the public hearing. Town Counsel will be consulted by Ms. O'Brien regarding Conservation Commission's request to delete "National Flood Insurance Flood Plain (NF)" and insert in place thereof the words "National Flood Insurance District (N)". 11/10/81 Page 2 After some discussion, the Board unanimously voted to recommend adoption of Article 27 by Town Meeting. The Board then reviewed the language of Article 28 and unanimously recommended that the following phrase be offered as an amendment to Article 28: Delete word "map" in the second sentence under Section 3.2. and insert in place thereof the following phrase: 'aforementioned index map and 39 detailed maps' so that the corrected version shall read: "The aforementioned index map and 39 detailed maps shall be kept on file and current by the Planning Board, who shall supply copies to the Town Clerk, the Building Inspector and the Board of Appeals". Upon a motion duly made and seconded, the Board unanimously supported the adoption of Article 28 by Town Meeting and the above amendment under said article. Article 29 was then reviewed and the Board unanimously recommended adoption of this Article by Town Meeting. ARTICLE 9 The Board reconsidered their vote on Article 9 and after some dis- cussion the Board unanimously voted to recommend adoption of this article by Town Meeting. Minutes The Board deferred action on this item until a subsequent meeting. Meeting Schedule The Board will meet again on Tuesday, November 17, 1981 at 7:30 P.M. in the office.
