Re: Board of Appeals Case No. 1981-33, Application of Roman
Catholic Archbishop of Boston and Reading Gymnastics
Academy for a Special Permit or Variance for property
located at 172-186 Woburn Street for use as a gymnastics
academy
Dear Board Members:
At the Planning Board's December 9, 1981 meeting, the above-named
subject matter was discussed. Attorney for the applicants, 0.
Bradley Latham and Ms. Leslie McGonagle, co-owner of the Reading
Gymnastics Academy were_pres.ent. At that time the,-enclosed.;.con-
dition_s. w-ere cdi euz ed. Thy s -Board -felt that there,were additional
problem areas that must be addressed and the applicants have agreed
to the following listed conditions (see enclosed letter):
1) - maximum area of identifying sign shall be one foot by
two feet (1 ft. x 2 ft.) ;
2) - maximum number of students for regular classes shall
not exceed 40 students;
3) - for any regional meet and/or demonstration, there shall
be a police officer on duty to regulate traffic;
4) - the variance or special permit granted shall have renew-
able five (5) year reviews to insure compliance with
all imposed conditions; and
5) - Reading Gymnastics Academy's equipment, facilities and
activities shall comply with the standards as outlined
in the United States Gymnastics Federation (USGF) and
Amateur Athletic Union (AAU) standards or any successor
to those organizations.

The Board discussed in detail the additional requirements for the
granting of either a Special Permit or a Variance. Under Section
10, Chapter 4OA, MGL, time limitations may be imposed for either
a Special Permit or a Variance and therefore this Board feels that
either one could be granted in this case.
.The Board unanimously voted to recommend that the Board of Appeals
take favorable action on the granting of either a Special Permit
or a Variance on the above--named application.

CONDITIONS TO BE IMPOSED BY THE ZONING BOARD OF
APPEALS AS TO A VARIANCE CONCERNING THE WOBURN STREET
(LOWER) SCHOOL
1. Traffic:
(a) The Applicants shall coordinate'as to parking so that at no
time shall the use of the facility for gymnastic purposes cause on-street
parking to be generated.
(b) For safety reasons, the principal access door to the gymnasium
shall be the rear (southerly) door to the building. This requi rement' is
imposed to discourage individuals from stopping on Woburn Street to.a]low
individuals to alight from the motor vehicle and run into the Woburn Street
side door of the building.
(c) There shat] be prompt and adequate snow removal from the parking
area so that there will be adequate off-street parking for use of the
premises as a gymnastic academy and so that anyone exiting from the parking
area will have adeabate visibility of traffic on Woburn Street.
(d) There shall be designated one-way traffic to the parking area
and to Woburn Street. The western driveway shall be designated as the
entranceway and the eastern driveway shall be designated as the exitway.
Those areas shall be clearly marked as being one way and the traffic flow
shall be marked by painting an arrow on the asphalt.
(e) There shall be a stop sign installed at the end of the exitway
at the intersection with Woburn Street.
(f) For regional gymnastic meets, there shall be a police officer
on duty to regulate traffic.
11. Restrictions as to the Use of the Area Leased:
(a) The area leased (gymnasium and surrounding area). shat l be utilized
only for the purpose of providing physical education to youth (between the
.ages of 5 and 21) through gymnastic exercise, including conditioning and
improving physical and mental coordination. All courses and activities would
be those sanctioned by and customarily used by the United States Gymnastic
Federation and the standards of the U.S. and International Olympic Committees
for gymnastics.
(b) At no time shall the area be used fora health spa, massage parlor,
weight lifting facility, or other similar use.

(c) The leased area shall be used for classes only between the
hours of 9:00 a.m. to 8:30 p.m., Monday through Friday and Saturday from
9:00 a.m. to 3:00 P.A. There shall be no regular classes scheduled on
Sundays.
(d) The premises shall, in all regards, conform to the requirements
of Massachusetts Statutes and all rules and regulations of the Commonwealth
of Massachusetts and the Town of Reading, including but not limited to fire
safety regulations and the State Building Code.
(e) There shall be one exterior sign of one foot by two feet, which
shall identify the occupant of the gymnasium.
(f) The maximum number of students attending gymnastic classes in
the building at any one time shalt be forty.
(g) The equipment, facilities and activity in the premises shall
conform to the standards of the United States Gymnastic Federation, or
the applicable standards of any successor to that Federation.
III. Quinquennial Review: The variance granted shall be reviewed by
the Board of Appeals every five years to determine continuing compliance
with the conditions of approval. If the conditions are determined to have
been violated, the variance shall not be extended. If the conditions are
not violated, the variance shall be extended for successive five year
periods.
IV. Breach of Conditions:
A material breach of any of the conditions of this variance shall
be grounds for the termination of the variance.
