The meeting was:=called to order by Chairman Mitchel at 7:15 PM in
Room 19, 52 Sanborn Street (the Community Center) with Board
members J. Shaw, K. Messina and M. Rich present.
The Board then moved to discuss the agenda item B, the Board of
Appeals case, out of order on the agenda.
The notice sent to the Planning Board from the Board of Appeals
states that the petitioner seeks a Special Permit to allow
the land from 150 feet to 250 feet from the center line of Main
Street to be used for multi--family (condominium) purposes on
the property at 259-267 Main Street.
Discussion of this petition included:
- Apartment use not permitted in. Single Family district
- Rezoning of land would be needed to provide this use
- Rezoning of land is the purview of Town Meeting only
- Petitioners have placed an article for rezoning on 182 Annual
Town Meeting Warrant
- The following recommendation will be made to the Board of
Appeals:
The Planning Board position is that this request is a rezoning
of land and this Board without prejudice respectfully request
that this matter be referred to Town Meeting, where all rezoning
of land must be heard.
The present operation of business at this address is a non-
conforming use, being grandfathered as the business existed
before the adoption of the zoning. And the Board, from an
interpretation of Town Counsel, states that non-conformity
is not a right and that the zoning of land should eventually
revert back to its intended use, the present zoning of the
land in question. Any relief from this should be considered
a rezoning of land and not a variance.
At 7:45 PM the Board adjourned to the Auditorium for the public
heating on this case.
At 8:30 PM the Board reconvened in Room 19 to discuss the listed
agenda items. The Board of Appeals has granted the petitioner
the right to withdraw their petition without prejudice in the
above matter.
The Board reviewed the correspondence.
Population Study
M. Rich presented graphs to show the current distribution by age
of the population for the Towne. The Board reviewed and discussed
the given figures on population and noted several areas of interest
- the decrease in the population between ages 0-5
- the increase in the over 65 age group
- the number of residents within the Town was up slightly but
the number of residences increased considerably

Annual Town Meeting Warrant
The Board noted that there were 2 zoning articles on the Warrant;:
the Board of Appeals - Article 26, dealing with use variances, and
Article 2`7, rezoning of 259--2.67 Main Street. Tentative scheduling
of these articles public hearings will be for March 31 and April74
The Secretary will send copies of the Article 26 to MAPC legal
counsel and. to Don Schmidt, BOCD for their review.
The Board deferred discussion on the other listed agenda items
and decided on the following meeting schedule:
3/11 - next,PB meeting at 7;30 PM
3/17 - All Boards meeting at 8:00 PM, Auditorium
3/16 - PB meeting at 7:30 PM
3/8 - Historical Commission will be using office
The Board adjourned the meeting at 10:10 PM.
