Chairman Mitchel called the meeting to order at 7:20 P.M. in Room 19,
52 Sanborn Street (the Community Centex) with J. Shaw, M. Rich and
A. Burne present. Mr. Messina arrived at 7:30 P.M. Also present
was V. Adams of the Historical Commission.
Accessory Apartments
With minor changes the Board released a copy of the draft proposal
and requested that the Secretary forward a copy of the same to Town
Counsel for his review and comments. Ms. Rich was designated the.
liaison person. Ms. Rich will try to arrange a meeting with Mr.
Cohen next Monday or Tuesday in Boston or, if Mr. Cohen will be
coming to any meetings in Town, make arrangements to meet with him
at a mutually. convenient time.
The Board reviewed the synopsis of the overview and deferred any
action on this item until Town Counsel's opinion on the draft by-law
proposal was received.
Cluster, PUD, PRD
The Board hoped to have the draft proposal finalized for review by
other Boards re: accessory apartments by February 2nd. After final
preparations for placing the article on the. Town Meeting Warrant, the
Board will then work on a report of progress of Clusters, PUD, PRD
Developments that will be distributed to Town Meeting Members and
read at Town,Meeting. This will be an informational handout on what,
each of these developments are and will not take a position on which
way the Town will be proceeding in proposed by-law changes. This
will give the Board adequate time for preparing for Fall Town Meeting
while answering some of the questions that developers in the Town may
.have.
Political Signs
Chairman Mitchel will contact the By-law Committee and ask that the
language be cleaned up and made more concise. He will report back to
the Board after such discussion.
Busy Bee Florist Rezoning
Chairman Mitchel contacted Ms. O'Brien of the Board of Selectmen and
asked the status of this rezoning proposal as outlined by her at the
Fall Town Meeting. She stated that the Selectmen are working with
Town Counsel to try to provide some relief for an accessory use with
a Special Permit from the Board of Appeals to operate a florist shop
in a Single-Family District. There is a question of discrimination
and Town Counsel is investigating.
Spence Farm
The current status of this issue is Town Counsel will be taking Spence
"Farm to court next week on the cease and desist order issued against
the selling of Christmas trees on this property. :his decision should
be rendered with regard to the agricultural/roadside.stand legisla-
~_r der _Chapter 40A,_ Acts of 1982, wherein it states that a road-

side stand may sell "produce, and wine and dairy products, insofar
as a majority of usch products for sale have been produced by the
owner of the land on which the facility is located,-" In the
Land Use Manager, their legal interpretation states "this provision
literally provides that a majority of products sold do not have to
be raised on the premises where the exempt sales facility is located,.
but must only be produced by the owner of the land on which such
facility is located. Thus, it appears that a land owner may be
able to raise "agricultural" products elsewhere, and then sell
them at a facility located on separate land owned by such person."
The Board will keep informed of the legal proceedings in this, case.
There being no further business before the Board, it was unanimously
voted to adjourn at 9:50 P.M.
