Neil Sullivan (NS) arrived at 8:35 PM. Also Present: Chris Reilly (CR), Town Planner. The Chair called the meeting to order at 7:35 PM. Public Hearing, Major Modification of the approved Site Plan for 4 West Street Mobil on the Run-4 West Street SD opened the public hearing and RH read the legal notice. Attorney Mark Favaloro represented Joe Prizio, the proprietor of Mobil on the Run who was making the request. Mr. Prizio requested a major modification to the approved site plan for 4 West Street to allow fuel deliveries 7 days a week, instead of Monday through Friday as approved. RH noticed there were no members of the public present and asked CR if proper notice of the hearing was given to the abutters. CR explained that the legal ad was in the paper 2 weeks before the hearing as required and all abutters within 300' of 4 West St. were noticed. He did not hear from anyone prior to the hearing. Mr. Prizio talked about the need for deliveries; some fuel deliveries must take place on the weekend or he could run out of fuel. The abutting gas station in Woburn gets deliveries 7 days a week, 24 hours a day. CR recommended malting any approval of the amendment contingent on compliance with the signage by-laws. There were recent signage violations at 4 West St. and CR felt that compliance needed to improve. RH moved to close the public hearing. JB seconded. Voted 3-0, all in favor. RH moved to approve the major modification, subject to the following condition: Condition 6 shall be modified to allow fuel deliveries seven days a week, from 7:00 AM to 10:00 PM, subject to further review by CPDC on an as-needed basis and compliance with the Section 6.2 of the Zoning By-Laws. JB seconded. in ravor. NS arrived at 8:35 PM. Public Hearing: Request for Major Modification to the PUD Preliminary Permit Johnson Woods Realty, Inc., 468 West Street SD opened the public hearing and NS read the legal ad. Attorney Brad Latham and Engineer Bill Bergeron represented Applicant Johnson Woods Realty Inc., principal Ted Moore. Atty. Latham made a presentation on the amendment request. They are requesting a major amendment regarding the addition of Mr. Louis Peterson's property at 113 Longwood Rd. to the Preliminary PUD Plan, which would add 4, 2 bedroom units and a single family unit for Mr. Peterson to the plan. The property is in the PUD overlay district. CR explained DRT concerns about the legality of Longwood Rd. extension access as proposed in the amendment and advised that Town Counsel should review. Additionally, he has not received the full set of plans as required by the preliminary decision. The Applicant requested clarification on why the submission of a full set of plans was needed for review as required by the preliminary decision, citing cost concerns and the inclusion of the plans in the Final PUD Plan application. CR explained that the plans were needed to insure the Applicant had complied with the decision. SD reviewed CR's email instructing the Applicant to provide the plans as required by the preliminary decision. RH commented that the instructions seemed clear. There was discussion about legal review of the proposed access to the Longwood Road extension and approving the amendment pending Town Counsel review. RH moved to close the public hearing. JB seconded. Voted 4-0, all in favor. RH moved to approve the major modification to the preliminary plan unit development plan, as shown in a drawing dated March 15, 2004 showing an additional 5 units and 35,000 sq. ft. of area, subject to following conditions: 1. Town Counsel shall review and confirm that there is legal access on to Longwood Rd. extension for the new relocated house for Mr. Peterson, which shall replace his existing house. 2. The Applicant shall submit set of drawings showing this modification prior to the submission of the Final PUD Plan, and those drawings shall be stamped "Preliminary Application" and incorporate all of the conditions set forth in preliminary approval dated February 9, 2004. 3. Should Town Counsel be of the opinion that the new, relocated Peterson house does not have legal access onto the Longwood Rd. extension, then this major modification is denied and prior to the submission of the definitive plans the applicant shall submit a set of the final preliminary plans showing the preliminary plan approved on February 9, 2004, incorporating all the conditions approved in that decision. JB seconded. Voted 4-0, all in favor. RH moved to adjourn. NS seconded. Voted 4-0, all in favor. The meeting was adjourned at 9:45 PM.
