CPDC MINUTES
Meeting Dated: November 29, 2004
Members Present: Neil Sullivan, Chair (NS), Jonathan Barnes (JB), Susan DeMatteo
(SD), John Sasso (JS), Richard Howard (RH).
Also Present: Chris Reilly (CR), Town Planner; Joe Delaney (JD), Town Engineer
The Chair called the meeting to order at 7:35 PM.
Administrative Review:
Request for Determination of Minor Modification to the PUD Special Permit
Johnson Woods Inc., 468 West St.
The Applicant was represented by Attorney Brad Latham and Engineer Bill Bergeron.
They have submitted a written request for a determination of insubstantial modification to
the approved PUD Final Plans in order to accommodate some revisions to the Grading
Plans that resulted from errors in the initial surveying.
CR advised that these revisions were reviewed by Town staff and there were no concerns;
the Conservation Commission had already approved the revisions as a minor
modification to the Order of Conditions.
JD explained that he had no issues other than insuring that the limit of work wouldn't
change, which the Applicant had already stipulated in their written request.
RH moved to approve the request for a minor modification to the approved PUD Final
Plans, as contained in the submitted plans C-7 through C-10 revised through November
17, 2004 and with assurances as stipulated in the letter from Attorney Latham dated
November 19, 2004.
JB seconded.
Voted 5-0, all in favor.
143 Main Street Approved Site Plan Extension
Angelo Ciano, 143 Main Street
Attorney Brad Latham represented the Applicant.
They are requesting an extension for completion of work on the approved site plan for
143 Main St, which lapsed on September 30, 2004. Financial constraints have delayed the
project but the Applicant will be able to move forward in the spring and they are
therefore requesting that a site plan extension be granted to December 31, 2005.
CR advised that both the approved site plan and the Board of Selectmen required
installationof landscaping inthe front; which hadnot been completed. TheSelectmen
had requested that the approved site plan be enforced, resulting in a compliance review

1_ by CR. Work has proceeded on an addition but no landscaping has been provided; in

discussions with the Building Inspector CR determined that the landscaping in front
could be installed without affecting the construction on the rest of the site.
JB expressed concern that the lapse didn't seem justified and the landscaping should be
required before any further work is authorized.
RH moved to grant an extension to May 31, 2005 to allow for the installation of the front
landscaping, and a further extension to December 31, 2005 upon review and approval of
the landscaping by the Town Planner.
JB seconded.
Voted 5-0, all in favor.
Baldwin Lane Subdivision Request for Bond Release
Charles Hardy, 24 Russell Road
The Applicant has submitted a request for release of the bond established for construction
of frontage, ways and utilities for the Baldwin Lane Subdivision.
JD reported that the Engineering Division had inspected the subdivision and submitted a
recommendation that $6,000 be retained for remaining work.
CR advised that the extension CPDC had granted for completion of the subdivision
would expire on November 30, 2004, which necessitated a further extension to insure that
the remaining work could be completed.
RH moved to release all but $6,000 of the bond, per the Engineering Division's
recommendation dated November 29, 2004, and grant an extension for completion of the
subdivision to December 31, 2004 to allow for completion of the remaining work.
JS seconded.
Voted 5-0, all in favor.
Public Hearing (continued): Definitive Subdivision
175 Franklin Street, Richard Merrill Trust
Attorney Latham represented the Applicant and submitted a request for extension to
February 2005 to allow for further review of available development options.
RH moved to grant the extension request and continue the public hearing for the
definitive subdivision application for 175 Franklin Street to a date to be determined in
February 2005, subject to further abutter notification.
JB seconded.
Voted 5-0, all in favor.
RH moved to re-open the public hearing due to public requests on clarification of why
the hearing was being extended.
JB seconded.
Voted 5-0, all in favor.
Attorney Latham was present to explain that the Applicant needed more time to have the
engineer revise the plans to meet the Aquifer Protection District zoning requirements.
There was concern expressed by the abutters about when the next hearing would occur
and whether they would be aware of it.
RH moved to extend to a date certain, namely February 28, 2004 at 8:00 PM.
CR will provide further notification to the abutters as to the time.

Minutes
The Minutes of October 4, 2004 and October 25, 2004 were reviewed.
RH moved to approve the Minutes as amended.
JB seconded.

Public Hearing: Site Plan Review
Mark Investments, Inc. I-I5 Hamden St.
NS opened the public hearing.
JS read the legal ad.
Attorney Brad Latham, Engineer Fuss and O'Neill, Traffic Engineer VHB and Architect
Edwards and Kelcey represented the Applicant.
They are proposing to redevelop 1-15 Hamden St. into an approximately 10,000 square
foot Walgreens, with associated on and off-site improvements to the property and
municipal parking lot. The Applicant's engineer and architect gave presentations of the
proposed site plan.
They have responded to the DRT comments and have revised the plans to enhance the
fagade and landscaping.
JD reviewed his memo to the CPDC dated November 29, 2004:
➢ The utilities need to be upgraded and the DEP storm water regulations apply.
They will need to conduct soils tests to insure their drainage system will function as
proposed.
➢ There are some other existing conditions issues that need clarification, such as the
Danvers Savings dumpster status where the application indicates handicapped
parking.
➢ The traffic study will need peer review.
CR went over the results of the DRT conducted on November 22, 2004:
Planning:
➢ Street lighting, brick banding and granite curbing on sidewalks, additional street
trees/landscaping and Christmas lights should be consistent with downtown plan
Dumpster design should be consistent with building materials, with separate gates for
employees and trucks
Elevations: Fagade has dead space on corner of Hamden/Pleasant
-will need extended awning and architectural features-perhaps community bulletin
boards
-west elevation mezzanine clumsy-should have roof articulation similar to awning
-windows should be elevated to avoid clutter effect.
➢ Planting box should be incorporated into faqade on Hamden.
➢ Should have peer review of traffic study
➢ The placement of the Walgreens signage on the north elevation is not allowed by the
zoning by-laws
➢ Parking lot islands need shade trees, granite curbing and low level lighting-spaces at
Pleasant entrance could be utilized for shade trees
There may be opportunity for tandem parking/snow storage in proposed landscaped
area behind building-landscaped area in rear for buffering not as big a priority as
parking
➢ Loading space waiver now available

Engineering:
Limited parking a concern
Exnlore possibility of off-site narking
Town might want to look at public parking on Pleasant
i Must meet DEP storm water regulations for redevelopment
Drainage to be reviewed
i No improvements to utilities proposed-upgrades needed.
i Dumnster design should be consistent with building materials. with separate g'ates for

i Area indicated on plans as sidewalk near back entrance is currently used by Danvers

RH asked the Applicant when they wanted to be continued to, given the need for a peer
review of the traffic study.
The Applicant agreed to continue to January 10 in order for sufficient time to peer review
the traffic study.
RH moved to continue the public hearing to January 10, 2004 at 8:00 PM.
JB seconded.

Certificate of Appropriateness
J&B Crosby & Co., 175 Haven Street
The Applicant made his presentation; they are seeking approval of a permanent, green,
canopy-style awning as indicated in the submitted application.
Virginia Adams and Roberta Sullivan were present from the Historical Commission; they
would like to see a flat awning similar to other retractable awnings on Main Street. They
also would like to see the elevation of the awning reduced to expose a granite band on the
fagade of the building.
JB suggested that the Applicant provide a rendering addressing the Historical
Commission's concerns.
The Applicant agreed to revise the application and provide the requested renderings.
CR advised that the action date would expire before the next meeting and an extension
was needed from the Applicant, which was provided.
RH moved to direct the Applicant to submit revised renderings reflecting the alternative
awning discussed and continue the application to December 13, 2004 at 8:30 PM.

Certificate of Appropriateness
Bank of America, 600 Main Street
The Applicant presented their application for signage at 600 Main St. Fleet Bank is
transitioning to Bank of America and the signage application proposed to replace the
existing Fleet signage with Bank of America signage.
Conformity with the Zoning By-Laws was reviewed. The interior ATM and Haven St.
entrance signage is not allowed, but the replacement wall signage on Haven and Main
Sts. and the exterior ATM signage seemed fine.
RH moved to approve the Certificate of Appropriateness for 600 Main St. as proposed,
subject to the omission of the identified signage that is not allowed by the Zoning By-
Laws.
JS seconded.
Voted 5-0, all in favor.
Public Hearing (continued): Site Plan Review
519 & 505 Main Sts., Inzran Alvi et al
Mark Favaloro, Attorney for the Applicant, had submitted a request for continuance by
fax to give the Applicant time to conduct the requested soils tests.
CR advised that the action date would expire by the next meeting and they needed an
extension.
JB questioned whether, the fax from Attorney Favaloro was an adequate extension
request.
CR reviewed the options, which included denying the application because of inadequate
information as required by Zoning By-Laws Section 4.3.3, approving the draft decision
CR had prepared or granting the continuance based on what was submitted.
RH discussed the possibility of approving the extension subject to receipt of a proper
extension request from the Applicant by the close of the action date, with the decision
being filed failing receipt of said agreement.
The draft decision was reviewed and amended in accordance with the available
information in the application file; given inadequate access as indicated the proposed
addition was denied.
RH moved to approve the extension request to December 13, 2004 at 9:00 PM subject to
receipt of the extension agreement by the close of the action date, however in the absence
of said agreement the decision as amended shall apply.
JB seconded.

Subdivision Approval Not Required (ANR)
Trickett Realty Trust, l10 Main St.
CR reviewed the proposed ANR, which was required by the recently approved site plan
for 110 Main St. A strip of land has been swapped to accommodate the proposed pass-
thru and relocate the driveway on the adjoining residential lot, as required by the site plan
review decision.
JD has reviewed the ANR and has no concerns.
RH moved to approve the ANR for 110 Main St. prepared by Andover Engineering Inc.,
dated October 4, 2004.
JB seconded.
