Also Present: Anne Krieg, Town Planner, Joe Delaney, Town
Engineer
Richard Howard (RH) moved to enter into Executive Session in order to discuss
the Marion Road Definitive Subdivision pending litigation at 7:35 PM. Neil
Sullivan (NS) seconded. All in favor.
Anne Krieg (AK) and Cheryl Blaine, Town Counsel (CB) updated to CPDC as to
current status of the pending litigation. Previously requested information has
been submitted and reviewed by the CPDC, and general acceptance of these
documents has occurred.
AK and CB both intimated the remaining issue for the CPDC appears to be the
consensus as to granting a waiver for roadway width. This waiver would
accommodate the Order of Conditions (also pending litigation, and appeals to
DEP) denying the filling of the resource area at the mouth of the proposed
roadway. CPDC, acting under the authority of Subdivision Control, has final
jurisdiction over adequate width of roadways to serve lots.
CPDC members and staff questioned the appropriateness of this discussion. It
was accepted this discussion is necessary as there is pending litigation with
the Conservation Commission regarding two appeals on their Order of
Conditions, and further, the re-submission of a plan acceptable to the
Conservation Commission hinges upon the CPDC acceptance of this waiver.
After lengthy discussion, there was no consensus generated by the Commission
as to the future acceptance of a waiver for roadway width. Further review by
- the CPDC-would -occur -if an open public hearing -were called for the project. -
CB to follow up with the applicant on their response.

Meeting was called to order by the Chair pro-tem at 7:35 PM.
RH made a motion at 7.35 PM to enter into an executive session in order to
discuss pending litigation surrounding the Marion Road Definitive Subdivision.
Seconded by NS. Vote taken as a verbal roll call by the Chair. All in favor.
RH made a motion at 8:10 PM to leave executive session and return to open
meeting.
Seconded by NS. Vote taken as a verbal roll call by the Chair. All in favor.
DEER RUN DEFINITIVE SUBDIVISION
CONTINUATION OF A PUBLIC HEARING
AK announced the Environmental Impact Report was received and
communication for permission to enter the property to determine historic
significance was granted.
Steve Reislin of Baystate Survey presented newly revised drawings to the
Board, not currently in Department files. The revisions included:
1. Roadway width of twenty-four feet (241;
2. Sidewalk shown on one side of the street only;
3. Detention area re-graded;
4. Sight easement shown;
5. Curb cut opening available for adjacent lot owner;

MF asked for public comment on the project.
A resident from 385 Haverhill Road questioned the flow of drainage. It was generally
explained to him by the Project Engineer and the Town Engineer.
Virginia Adams, Chair of the Historic Commission, spoke regarding the cooperation they
have had with the applicant in accessing the site. They also want to continue discussion
on moving the driveway further from the house. She also requested the street name be
changed to Timothy Place to reflect the historic character of the area.
The applicant spoke in response the new owner of the property wants the driveway located
where it is; but they would speak to them again about it.
CPDC members and staff discussed the necessity of reviewing the newly revised and
submitted drawings for the next meeting.
RHmoved to continue the public hearing to June 14, 1999 at 8:00 PM. Seconded by NS.
All in favor.
RELEASE OF FUNDS
ANSON LANE DEFIlQTIVE SUBDIVISION
JD explained to the CPDC the remaining funds for this project covered the street tree
plantings. He recommended full release of the funds in the passbook account.
Motion made by RM
We, the Community Planning and Development Commission under the autbority of
Section 9.5 of the Subdivision Rules and Regulations in Reading, Massachusetts, upon the
request by to release the passbook account in the amount of 51500.00 currently being
held for the construction of ways and provisions of utilities and amenities for the Definitive
Subdivision known as Anson Lane, do bereby vote, to release the above noted to Dave
Jobnson. This action is based upon the recommendations by the Town Engineer dated
May 24, 1999.
Seconded by NS. All in favor.
JD circulated a memorandum, attached hereto as part of the record, regarding a design
change on the Walnut Street reconstruction project. Discussion and analysis of the scenic
road designation, by-laws and regulations ensued. RH was concerned with what process is
appropriate to review the design change. All agreed the regulations were not completely
clear as to guidance on this particular instance. CPDC reached consensus for staff to meet
with the affected property owners and with Dan Sulls to review the design change and
ascertain public acceptance. If there were concerns, staff would place the change as an
agenda item for the next meeting.
The minutes were accepted, noting minor edits to be changed by AK.
CPDC requested for Public Comment to be placed at the beginning of the meeting.
CPDC discussed process and necessity for update or re-construction of the 1991 Master
Plan. AK suggested for the CPDC, and other leading citizen groups, to read the policy
statements therein, and then:

A. If the policy statements generally reflect the current sentiment of the
community, then the Plan effort is more of a technical update, whereas AK re-
complies the data, and does some outreach to update survey information, etc.,
however,
B. If the policy statements appear to be outdated or do not reflect public sentiment,
then, the Master Plan is set aside and a new effort is commenced from the
"ground up".
AK requested CPDC members to read through the Master Plan over the summer months to
make a determination. Staff time could be dedicated to commencing any Master Plan
process starting in January 2000.
NS moved to adjourn at 9:30 PM. Seconded by RH. All in favor.
