HomeMy WebLinkAbout1992-05-05 Community Planning and Development Commission MinutesTOWN OF READING COMMUNITY PLANNING AND DEVELOPMENT COMMISSION MINUTES MAY 5, 1992 A meeting of the Community Planning and Development Commission of the Town of Reading was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street in Reading, Massachusetts on Tuesday, May 5, 1992. In attendance were Nancy Shipes, Chair, Jonathan Barnes, Commission Secretary, and Members William Goodrich, Richard Howard, and Thomas Stohlman. Also present were Town Planner Jonathan Edwards and Town Engineer William Robertson. The meeting was called to carder at 7:34 PM. APPROVAL OF PREVIOUS MINUTES The minutes of the Commission's meeting of March 26 and April 6, 1992 were amended and accepted. CONTINUED PUBLIC HEARING, SITE PLAN REVIEW, DUNKIN DONUTS, 151- 157 MAIN STREET At 7:45 PM Ms. Shipes opened a continued public hearing to con- sider Site Plan Review for property at 151--157 Main Street on which a Dunkin Donuts business is proposed to be developed. Mr. 0. Bradley Latham, representing the applicant, stated that the zoning issue as to legal encroachment of business use into the residential zone on the property had the day before been referred to the Building Inspector for an interpretation, and he presented a survey and deed showing two of the current lots being combined in 1942 when the Zoning By-Law was enacted. Mr. Stohlman produced a calculation showing that the majority of this combined lot was contained in the residential zoning district, thus disal- lowing the encroachment. The applicant's engineer was requested to calculate these areas and advise the Commission. Mr. Latham then outlined changes in the proposal since the last meeting and presented a sketch plan showing these: elimination of the two retail spaces, a reduced number of parking spaces, and the relocation of the site entrance to the north. Mr. Edwards pointed out that there still remained a zoning interpretation issue regarding the basis for calculating required parking due to the dual use of the property as retail and restaurant as proposed for the donut operation. Ms. Shipes read letters in opposition to the proposal from Janet Triglione and Senator Richard Tisei. Pamela Katsiris, an attor- ney representing several neighbors, presented a petition signed by approximately 304 people in opposition to the proposal and which outlined several objections to it. Mr. Goodrich noted the eed__ foran adequate sit.e_ lighting plan _and for a _safety fence on any retaining wall of significant height as previously proposed. Mr. John Perkins, a neighbor, said that traffic impacts had not yet been sufficiently addressed. After Ms. Shipes and Mr. Latham executed an ex-tension agreement for hearings to June 23rd and a decision by July 3rd, the Commis- sion voted 5:0 to approve a motion by Mr. Stohlman, seconded by Mr. Barnes, to continue the public hearing to 8:00 PM on June 22, 1992. APPROVAL-NUT-REQUIRED SUBDIVISION PLANS An Approval Not Required Plan for property on Oak Street was sub- mitted for endorsement. The Commission voted 5:0 to approve a motion made by Mr. Stohlman, seconded by Mr. Howard, to endorse an Approval Not Rewired Plan, dated April 16, 1992 revised April 30, 1992, for a lot on Oak Street, and so endorsed the plan. An Approval Not Required Plan for property at the corner of Pres- cott and West Streets was submitted. After considerable discus- sion about sufficiency of frontage and the unusual lot shapes, the Commission voted 4:1:0 (Mr. Barnes opposed) to approve a mo- tion made by Mr. Howard, seconded by Mr. Barnes, that an Approval Not Required Plan, dated March 17, 1992, on Prescott and West Streets be denied due to failure to meet the lot frontage defini- tion given in Section 2.2.13 of the Zoning By--Laws. Thereupon, the applicant revised this plan to show a 20-foot deep access easement, and the Commission voted 4:1:0 (Mr. Howard opposed) to approve a motion by Mr. Goodrich, seconded by Mr. Stohlman, to endorse an Approval Not Required Plan, dated March 17, 1992 and revised. May 5, 1992, on Prescott and West Streets, with the con- dition that an access easement for Lot 2 be provided on Lot 1 with a minimum depth of 20 feet and a length parallel to Prescott. Street frontage. OTHER BUSINESS The Commission discussed items to be reviewed with the Board of Selectmen at a meeting with that. Board scheduled for May 12, 1992. The members also discussed on-going Master Plan presenta- tions to other Boards and Commissions. ADJOURNMENT At 10:38 PM a motion was made and seconded to adjourn and the Commission voted unanimously to do so.
