HomeMy WebLinkAbout1993-01-25 Community Planning and Development Commission MinutesTOWN OF READING COMMUNITY PLANNING AND DEVELOPMENT COMMISSION MINUTES OF JANUARY 25, 1993 A meeting of the Community Planning and Development Commission of the Town of Reading was held in the Selectmen's Meeting Room of the Town. Hall, 16 Lowell Street in Reading, Massachusetts on January 25, 1993. In attendance were Jonathan Barnes, Chair; Richard Howard, Commission Secretary; and Members Nancy Shipes, William Goodrich, and `.Thomas Stohlman. Also present were Town Planner Jonathan Edwards and Town Engineer William Robertson. The meeting was called to order at. 7:36 PM. APPROVAL OF PREVIOUS MINUTES The minutes of the Commission's meeting of January 4 and 11, 1993 were amended and accepted. CONTINUED PUBLIC HEARING--DEFINITIVE SUBDIVISION PLANS: BAY STATE ROAD EXTENSION Mr. Barnes called to order a continued Public. Hearing to consider Definitive Subdivision Plans for Bay State Road Extensions Mr. Jay Corey, engineer representing the applicant, presented revised plans, featuring an increased cul-de-sac radius in order to ac- commodate a tree lawn, locations of existing trees, driveways to the existing houses, reconfiguration of lot lines, and removal of the existing cul-de-sac. Mr. Robertson presented some technical concerns. Mr. Stohlman raised the question as to whether adjoin- ing lands could be developed and if so whether the street should be continued to provide access to such lands. The Commission voted 5:0 to approve a motion made by Mr. Stohlman, ,;seconded by Ms. Shipes, to close the public hearing. CONTINUED PUBLIC HEARING--DEFINITIVE SUBDIVISION PLANS: NUGENT LANE Mr. Barnes called to order a continued Public Hearing to consider Definitive Subdivision Plans for Nugent Lane. Mr. James Nugent, applicant, together with Attorney O. Bradley Latham, requested that the hearing be continued so as to provide time to complete review of the subdivision by the Conservation Commission, which review may result in a revision of the plans. He offered to sign an extension agreement such that a decision by CPDC could be made by February 24, 1993. Thereupon, the Commission voted 5:0 to approve a motion made by Mr. Howard, seconded by Ms. Shipes, to accept the extension agreement and to continue the Public Hearing to 8:06 PM on February 22, 1993. The applicant and Mr. Barnes executed an extension agreement. The Commission then voted 5:0 to approve a motion made by Mr. Stohlman, seconded by Ms. Shipes, to approve the subdivision sub- ject to conditions as enumerated in a Notification to Town Clerk dated January 26, 1993. ADJOURNMENT At 10:07 PM a motion was made and seconded to adjourn and the Commission voted unanimously to do so. L 3 °3 DEPARTMENT OF COMMUNITY DEVELOPMENT 942-9012 TOWN OF READING MEMORANDUM bayst.rec TO: Catherine Quimby, Town Clerk FROM: Jonathan Edwards,je- Clerk t.o the Community Planning and Development Commission SUBJ: Decision--Definitive Subdivision Plans: Bay State Road Ex- tension DATE: January 26, 1993" Please be advised that at its meeting of January 25, 1993, the Community Planning and Development Commission voted to APPROVE Definitive Subdivision Plans, entitled "Bay State Road Extension", dated September 1, 1992, revised through January 1993; together with accompanying memoranda dated January 12, 1993, with the following conditions: A. General Conditions: 1. Within thirty days of the date of this decision the Ap- plicant shall submit to the Department of Community Develop- ment and to the Engineering Division, Department of Public Works, satisfactory: a. Covenant Agreement, b. Conveyance of Easements and Utilities, C. Roadway Coordinates, d. Land Traverse, e. Hydraulic Calculations, f. Plan showing limit of work and all existing 12"-calipre or larger trees within said limit of work; all such 12"-calipre or larger trees within said limit of work and all 6"-calipre or larger trees outside said limit of work, if removed or destroyed due to work, shall be replaced with 3"-calipre or 1-1/2"-calipre trees, respectively, as determined by the Tree Warden, g. Evidence as to proper safeguards for ensuring main- tenance of the landscaped island, which will not be maintained by the Town; plans showing 30'-wide paved street surrounding said cul-de-sac island, h. Acceptable planting schedule showing size and species .of plantings, i. Acceptable locus plan. 2. The requirements of the Board of Health and of the Conser- vation Commission shall be met. 3 All necessary permits and approvals shall be obtained prior to construction and occupancy, including as appropriate but not necessarily limited to: Street Opening Permit, Street Tree Removal Permit, Sewer Extension Permit, Lot Releases, Curb-Cut Permit, Building Permits, Proof of inspection.and certification of Minimum Cellar Floor Elevations, Conserva- tion Orders of Condition for the subdivision and each relevant lot. 4. No construction of any dwelling or roadway or utility im- provement shall commence, nor shad any Lot Release issue, prior to the receipt and acceptance by the Commission of satisfactory: a. Evidence that a blasting permit, if necessary, has been obtained and that all precautionary procedures required by appropriate laws and regulations, including but not limited to provisions in 527 CMR: Board of Fire Preven- tion Regulations 13.11: Blasting, as obtained from the Fire Chief, have been adhered to, and b. Evidence that applicant shall bind all assigns and agents, including contractors, subcontractors, and lot buyers and house buyers and their assigns or agents, including their contractors and subcontractors, to all applicable conditions specified herein. 5. Comments of Town Staff as contained in DPW--Engineering memoranda of December 7, 1992 and January 25, 1993 shall be addressed in full. 6. The Commission looks favorably upon the provision of under- ground utilities. 7. Construction activity shall not take place in the subdivi- sion or in any building contained therein except during the following hours: Mondays through Fridays inclusive: 7:00 AM to 8:00 PM, Saturdays: 9:00 AM to 5:00 PM Sundays and Legal Holidays: none. 7. There shall be no underground fuel storage tanks located within this subdivision. 8. The applicant shall comply in full with any and all require- ments of local and State Law and regulation regarding any presence on the site of any hazardous or other environmen- tally dangerous materials, including full compliance with the requirements of Massachusetts General Laws, Chapter 21E. 10. The applicant shall require of all lot purchasers that con- struction contractors shall maintain each lot in a clean and presentable condition satisfactory to the Building Inspec- tor, who shall require that dumpsters be used and maintained sufficiently to meet this condition. B. Other Conditions: 1. The Commission grants a waiver from Section 5. B. 4. , "Connection with Unsubdivided Adjoining Property" of the Rules and Regulations Governing the Subdivision of Land of the Town of Reading. 2. A waiver from 30 feet to not less than 24 feet roadway pave- ment width up to but not including the.cul-de-sac is granted if requested by the Applicant within thirty days of this decision, provided that,the Applicant provides compensatory sidewalk construction to the Town as approved by the Depart- ment of Public Works, and that the Applicant make every ef- fort to save existing trees within the right-of-way. 3. The Applicant shall work with Town Counsel to resolve satis- factorily any legal issues stemming from the removal of the existing cul-de-sac. 4.
