HomeMy WebLinkAbout1994-03-28 Community Planning and Development Commission MinutesTOWN OF READING COMMUNITY PLANNING AND DEVELOPMENT COMMISSION MINUTES OF MARCH 28, 1994 A meeting of the Community Planning and Development Commission of the Town of Reading was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street in Reading, Massachusetts art March 26, 1994. In attendance were Richard Howard, Chair; and Members Nancy Shipes, William Goodrich, and Jonathan Barnes. Also present was Town Planner Jonathan Edwards. The meeting was called to order at 7:34 PM. APPROVAL OF PREVIOUS MINUTES The minutes of the Commission's meeting of March. 14, 1994 were accepted. APPROVAL-N'C'I-REQUIRED SUBDIVISION PLANS After presentation and explanation by the owner's agent, the Com- mission voted 4:0 to approve a motion made by Ms. Shipes, seconded by Mr. Goodrich, to endorse a Plan of Land, dated March 15, 1994, for Plot 19A on Haverhill Street, Land Court Case 4967 and Land Court Certification. 170943, and the Commission then so endorsed the plan. SETTLEMENT OF LITIGATION Mr. Edwards reported that Town Counsel has advised that a plan has been received from the property owner which is supposed to reflect the settlement agreed by the Commission about the litiga- tion connected with the Starr Realty property at 125-131 Main Street; the Commission voted 4:0 to approve a motion of Mr. Goodrich, seconded by Ms. Shipes, that Messrs. Howard and Edwards represent the Commission with Town Counsel to review and imple- ment this settlement. PUBLIC HEARING: ANNUAL 1994 TOWN MEETING ZONING WARRANT ARTICLES Mr. Howard called to order a Public Hearing to consider Articles on the Warrant for the Annual 1994 Town Meeting relative to the Zoning By-Laws, and the following action was taken: Articles 21 and 22: Mr. Peter Hechenbleikner, Town Manager, presented these articles concering amendment of the PRD By--Law open space provisions and the application of a PRD---G overlay di.s-- trict to property adjacent to the Batchelder Field Cemetery. Comments from the Commission and the public included that the devotion of PRD open space as cemetery expansion would negate the purposes of the PRD open space requirements and would result in a net increase in residential densities. Article 1.8: Mr. Rivers, representing the owner of this property on Mill Street, presented sketch plans illustrating intentions of developing this property as a PRD-G with approximately four houses. The Commission voted 4:0 to approve a motion of Ms. Shipes, Mr. Barnes second, to recommend this article to Town Meeting-. Mr. Baillie joined the quorum at this point. Article 1.9:. Mr. Edwards presented this article as a housekeeping measure in that the section proposed therein to be deleted from the toning By-Laws is both unnecessary and contradictory with the passage and approval of the new Sign By-saws. The Commission voted 5:0 to approve a motion of Mr. Barnes, seconded by Ms. Shipes, to recommend this article to Town Meeting. CONTINUED PUBLIC FEARING: PRELIMINARY SUBDIVISION PLANS-- PERSIMMON PLACE Mr. Howard reopened this public hearing and the plans were presented by Messrs. O. Bradley Latham and William Bergeron, at- torney and engineer, respectively, for the applicant. Mr. Ed- wards presented staff comments. Comments from the Commission and the public in attendance included desirability of installing a sidewalk along Franklin Street, proposed drainage, and whether access would be necessary to adjoining potentially developable or subdividable lands. The Commission voted 5:0 to approve a motion of Mr. Barnes, seconded by Mr. Baillie, to close the public hear- ing, and then voted 5:0 to approve a motion made by Mr. Goodrich and seconded by Ms. Shipes, to disapprove the plans for this sub- division according to a notification to Town Clerk dated March 29, 1994.
