HomeMy WebLinkAbout1994-05-23 Community Planning and Development Commission MinutesTOWN OF READING COMMUNITY PLANNING AND DEVELOPMENT COMMISSION MINUTES OF MAY 23, 1994 A meeting of the Community Planning and Development Commission of the Town of Reading was held in the Selectmen"s Meeting Room of the Town nail. 16 Lowell Street in Reading, Massachusetts on May 2:3, 1994. In attendance were Richard Howard, Chair: Thomas Baillie, Commission Secretary: and Members Nancy Shipes, William Goodrich, and Jonathan Barnes. Also present was Town Planner ionathan Edwards. The meeting was called to order at 7::38 PM. APPROVAL OF PREVIOUS MINUTES The minutes of the Commission's meeting of May 9, 1994 were amended and accented. CARRIAGE ESTATES II--ESTABLISHMENT OF BOND AMOUNT The Commission received an estimate from the Engineering Division relative to establishing a bond amount for the Carriage Estates II subdivision. Mr. Edwards reported that there have been several reported instances in which the developer has breached Condition 8 of the subdivision approval by`failing to prevent the use of Emerson Street by subdivision construction vehicles. Several neighbors in attendance attested to this breach. 'and added that visible damage to the private street was being caused. Other neighbors cited the developer's failure to remove a trailer from the site and to remove debris, which were called for in the subdivision decision. The developer, his attorney, and his sub- contractor related their points of view, stating that they have acted in good faith to try to adhere to the approval conditions. The Commission discussed several options for dealing with these matters before establishing a bond amount. The Commission. voted ').0 to approve a motion of Mr. Baillie, seconded by Mr. Barnes, to postpone the establishment of a bond amount until an action plan is submitted by the developer to CPDC and to entertain in- creasing the bond amount to cover potential damage that the developer may cause to Emerson Street. The Commission requested Mr. Edwards to ask the Engineering Division for input about these issues. PUBLIC HEARING--PRELIMINARY PRD-G PLANS: 59 FOREST STREET Mr. Howard called to order a Public Hearing to consider Prelimi- nary Planned Residential Development-General Plans for property located at 59 Forest Street. Messrs. Brad Latham and Paul Finoc- chio presented the plans. Mr. Edwards react planning and nnn^;Pr- vction comments. Two major issues presented themselves: proposed tenure of open space as part of one of the lots with easement rights to the owners of the other lots, and the distance of separation between the buildings. The Commission voted 5:0 to approve a motion of Mr. Goodrich, seconded by Mr. Barnes, to close the 3D I101JC hearing. Mr. Howard directed that the decision -,0 ti is case De= l-Dlarce _1 on the aaenaa for the ne,-cT i3 ee?.inj PUBLIC HEARING--PRELIMINARY SUBDIVISION PLANS: BEACON CIRCLE Mr. Howard called to order a Public Hearing to consider Prelimi- nary plans for the proposed Beacon Circle Subdivision. Messrs. Latham, Jack Rivers, and David Dwyer presented the plan:, re- questing waivers from the 50-foot right-of-way standards and from the requirement to provide access to adjoinin,E; undeveloped property to the north of the site. Mr. Edwards Presented plan- ning and Board of Health comments. The Commission voted 5:0 to approve a motion of Mr. Bailiie, again seconded by Mr. Barnes, to disapprove the subdivision plans in accordance with a notifica- tion to Town Clerk dated May 24, 1994. PUBLIC HEARING--SUBDIVISION REGULATIONS Mr. Howard entertained the calling to order of a Continued Public Hearing to consider amendments to the Rules and Regulations Governing the Subdivision of Land in Reading. The Commission voted 5:0 to approve a motion of Mr. Howard, seconded by Ms. Shipes, to open such Continued Public Hearing. The Commission, after some discussion, voted 5:0 to approve a motion of Ms. Shipes, seconded by Mr. Bailiie, to amend said Rules and Re.aula- tions by adding thereto language similar to that contained in the Regulations governing Site Plan Review concerning the engage- ment of and payment by applicants for review consulting services. The Commission then voted 5:0 to approve a motion of Ms. Shipes, seconded by Mr. Baillie, to continue the Public Hearing to a fu- ture date. APPROVAL-NOT-REQUIRED SUBDIVISION PLANS AND OTHER BUSINESS The Commission voted 5:0 to approve a motion of Mr. Baillie, seconded by Ms. Shipes, to establish a revised bond amount, in accordance with recommendation of the Engineering Division, for tine Ashley Woods II subdivision at $158,000, including $210,000 to cover compliance with the Tree Preservation condition of the sub- division approval. The Commission voted 5:0 that, of Mr. Baillie, secon of Land on County Road Goodrich, seconded by Mr. Haverhill Street dated May both said mans. to approve both the foilowin.g motions: led by Mr. Goodrich, to endorse a Plan dated May 51 1994; and ;that of Mr. Baillie, to endorse a Plan of Land on 18, 1994.
