Members Absent: Leo Kenney, Harold Hulse, Consultants; Dan Thibeault, Commissioner; Will Finch, Chair. 7:04 PA1: Ms. Lloyd called the meeting to order. Minutes Mr. Goulet moved to accept the minutes of May 22, 2002, both the regular and the executive session. Mr. Greene seconded. Voted 4-0-0 in favor. St. Athanasius Church, 306 Haverhill Street - Ms. Fink reported that site plans were expected soon to address existing drainage and erosion problems. 16 Margaret Road - Mr. Berry moved that the Commission authorize the Administrator to sign off on the Certificate of Occupancy for the addition and swimming pool. Mr. Greene seconded. Voted 4-0-4 in favor. 81 Forest Street - Mr. Greene moved that the Commission authorize the Administrator to sigrr off on the Certificate of Occupancy for the addition and swimming pool. Mr. Goulet seconded. Voted 4-0-4 in favor 201 Salem Street - The Commission asked the Administrator to send a letter to the owner requesting that he remove the haybales and seed the underlying soils by June 26. The Commission will continue discussion on June 26. 294 Main Street - The Commission asked the Administrator to send a letter to Fleet requesting an explanation for missed deadlines and for attendance at the meeting on June 26. Pondview Lane - Mr. Greene moved that the Commission issue an Extension Permit to May 11, 2004. Mr. Goulet seconded. Voted 4-0-0 in favor. Mr. Greene moved that the Commission accept a revised site plan for Lot 8 as an insignificant plan change. Mr. Goulet seconded. Voted 4-0-0 in-favor. 714 Pearl Street - Ms. Fink reported that the work had been completed and the site was stable based on a recent site visit. Mr. Berry moved that the Commission close the Minor Project file for the deck. Mr. Goulet seconded. Voted 4-0-0 in favor. fines which were due on May 31. The Commission asked that she contact Town Counsel and file a complaint for contempt of court. Minutes, Conservation Commission, June 12, 2002 2 59 Forest Street -The Commission reviewed a proposed planting plan. Mr. Greene., moved that the Commission accept the plan, provided that the shrubs were at least three feet high and planted eight feet off center. Mr. Berry seconded. Voted 4-0-0 to accept. Ms. Meier arrived at 7:30 PM. 7:30 PM: Public Hearing, RGB 2002-14, 26 Harrison Street Ms. Lloyd opened the hearing. The Malinskis were present. They would like to make an addition to their current house. They have a playset next to the wetlands, but it's not a big problen]. Ms. Finl: reviewed a draft OOC and noted that DEP had not yet issued a file number. Mr. Berry made a motion to close the public hearing. Mr. Greene seconded. Voted in favor, 4-0-0. Mr. Berry made a motion to issue the OOC as drafted and amended, pending receipt of the DEP number. Mr. Goulet seconded. Voted in favor, 4-0-0. Sunset Rock Lane The Commission reviewed a letter dated 5/31/02 from Bill Bergeron and an e-mail from Billy Welch. Ms. Fink reported observations made during a site visit today. The Commission discussed the forebay design and reached a consensus not to change the requirements for this area as set forth in their letter dated May 28, 2002. Ms. Fink is going to write another letter confinning the forebay design and requesting additional work, on the boulders walls, loam, and seed on Lot 2. The Commission made no change in the requirements for Lot 4 under Order 915 of the Enforcement Order. The Commission also asked Ms. Fink to send a letter to Mr. Regnante, attorney for Mr. DeGennaro, denying a release of the bond at this point in time. (Mr. Berry stated that he had a potential conflict of interest concerning the law firm and did not participate in this portion of the discussion.) Public Comment Bruce Bridges stated that the bank had sent a foreclosure notice on Lot 4 and asked questions about the status of the lot. The Commission explained the present status but declined to predict the future status. They advised him to seek professional opinions on the existing retaining wall and the cost of replacing it, if necessary. Mr. Bridges asked whether he would become responsible for remaining work on the lot if he purchased it, and the Commission stated that he would. Billy Welch asked whether and when the Commission might take the bond and complete the remaining work. The Commission advised him not to rely on the value of the bond to protect his interests, because attempts to take the bond might be challenged by the developer and the bond might not be adequate to cover all remaining work. 20 Sunset Rock Lane Marl, DiCara, the owner, presented a plan for a third retaining wall on Lot 2. Mr. Berry moved to approve construction of the wall, section C-C only, provided that the disturbed soils on both sides of the wall be graded no steeper than 3:1 and be stabilized with loam Minutes, Conservation Commission, June 12, 2002 and seed, and provided that Mr. DiCara sends a copy of the plan to Mr. DeGerniaro. Mr. Greene seconded. Voted in favor, 4-0-0. Mr. DiCara asked about extending the wall farther across the back yard in the future. The Commission advised him to return with a proposal when he is ready to begin. 1090/1100 Main Street Mr. Berry requested that the Commission continue discussion on the site visit findings until the next meeting when Mr. Finch would be present. Ms. Fink will send a letter to them and mention that the Commission is still reviewing the dotes. The letter will offer to have an informal meeting to settle the remaining issues. Carnation Circle Ms. Fink received a phone call from some one in the area about a workman who was placing a pipe under gravel bed and doing some drainage system. She inspected and reported her findings to the Commission. The work area is in the buffer zone. The owners would like to do additional drainage work and will file an RDA. There will be a site visit done before next meeting. There is a conservation restriction on this property. MACC and Membership Mr. Berry moved to make the payment for 2003 dues. Mr. Goulet seconded. Voted in favor, 4-0-0. Transfer from Wetlands Fee Fund The money can only be spent by the Commission. Mr. Berry moved to transfer $10,000 from the Wetlands Fee Fund to the Administraotr Salary line of the operating budget. Mr. Greene seconded. Voted in favor, 4-0-0. Mr. Berry moved to transfer $2,500 from the Wetlands Fee Fund to the GIS mapping project to add the property boundaries to the data base. Mr. Greene seconded. Voted in favor, 4-0-0. 722 Pearl Street (Minor Project) The owner would like to put in an above ground pool. Mr. Berry moved to accept. Mr. Greene seconded. Voted in favor, 4-0-0. 1 Indiana Avenue (Minor Project) The owner would like to put in an above ground pool. Mr. Greene moved. Mr. Berry seconded. Voted in favor, 4-0-0. Beverly Street, Revay Well #1 (Minor Project) The Water Department would like to conduct soils and water tests near the well. Mr. Berry moved to accept the project. Mr. Greene seconded. Voted in favor, 4-0-0. 32 Estate Lane (Minor Project) The owner would like to cut down old tree and the leaning tree. Minutes, Conservation Commission, June 12, 2002 4 Mr. Bent' moved to approve. Mr. Greene seconded. Voted in favor, 4-0-0. Hunt Memorial Park (Minor Project) The softball league would like to clean up and landscape around the flagpole and fence. Mr. Berry moved to approve. Mr. Greene seconded. Voted in favor, 4-0-0. Administrator Site Visit Reports: 38 Cross Street The owners moved loam from Strockridge Road, and were screening it in the buffer zone. Soils will he moved off siie after screening. 29 Terrace Park An excavation is open where the oil tank was removed on flat part of yard. 739 Pearl Street The homeowners are putting compost in Bare Meadow, Ms. Fink spoke with them. A letter will be sent. 31 Curtis Street There needs to be a site visit done, due to a call by the neighbor. There was possibly fill in wetlands. A sump pump had been put from basement and dispatched in the swale behind the houses and other people's houses. Ms. Fink told them not to put any more fill back there, put loam and seed on the ground. Motion to adjourn made by Mr. Berry at 9:20 PM. Mr. Greene seconded. Voted in favor, 4-0-0.
