Selectmen's Meeting Room, Town Hall
July 10, 2002
Present: Leo Kenney, Consultant; Karen Schneller, Doug Greene, Larry Goulet, Thad
Berry, Commissioners; Pat Lloyd, Vice-Chair; Will Finch, Chair; Kelley Meier,
Recording Secretary; Fran Fink, Administrator.
Absent: Harold Hulse, Consultant.
The Chair calls the meeting to order at 7:08 PM.
Sunset Rock Lane - Enforcement Order
Peter DeGennaro was present. He asked for and received permission to record the
discussion.
Ms. Fink passed out letters from Hayes Engineering and Peter DeGennarro dated 7/9 and
7/10. She reported site visit observations from 6/27 and discussions with Thad Berry and
Peter DeGenarro concerning the forebay berm. She mentioned that the owner of Lot 4
reported that work was being done on the driveway and she inspected it.
Mr. DeGenarro had requested a bond release in his letter. Mr. Finch said the bond would
not be released until the work was complete. Mr. DeGenarro raised questions about the
minutes from May 22, 2002. The Commission reviewed a letter sent by Ms. Fink to Mr.
DeGennaro on June 28. Mr. DeGenarro agreed to the description in the letter of the work
needed on the berm.
Ms. Lloyd moved to accept the specifications about the filter fabric in the 6.28.02 letter.
Mr. Greene seconds. Voted in favor, 6-0-0.
There was discussion about the wall on Lots 4 and 5. There was a consideration to fill in
the voids in the wall because fabric had not been set behind the wall, and earth could
move through it. The Commission asked for a specific written proposal from Mr.
DeGennaro to address the problem, including a deadline. They also asked for a similar
plan to fill the gaps in the wall on Lot 2.
Michael Gilberg (resident-48 Park Avenue), mentions that you need to have to leave a
few weep holes to allow some of the pressure to go through and not knock the wall down.
Mr. DeGennaro mentions that he could write a letter to confirm what was said at this
meeting tonight and bring it in tomorrow. He stated that there is ledge under the surface
about one foot behind the wall. Left from blasting to construct the driveway and house.
Mr. Berry said that the proximity of ledge would reduce the pressure behind the wall. He
Mr. Greene disagrees with this, he witnessed walls blow out at the ledges in Melrose.

Mr. DeGennaro brings up the bond reduction issue again and would like to get a bond
reduction. There was CPDC money that was released. The Commission repeated that
the bond would not be released until the work was complete.
Mr. DeGennaro agreed to prepare a written proposal and drop it off before the end of the
meeting.
8:10 PM - Public Hearing: Notice of Intent, 48 Park Avenue, RGB 2002-18
The Commission made a site visit on 7/8/02 to this location.
Mr. Michael Gilberg presented plans for an addition to his house. The existing gazebo is
going to be moved at a later time to be closer to the deck. Mr. Gilberg asks what he
could do about the dumping of leaves at the end of the road. Ms. Fink will talk to Public
Works to put up signs.
Mr. Berry moved to close the public hearing. Ms. Lloyd seconded. Voted in favor, 6-0-
0.
Mr. Berry moved to issue an Order of Conditions. Ms. Lloyd seconded. Voted in favor,
6-0-0. The draft Order will be considered at the Commission's next meeting.
8:23 PM - Public Hearing: Abbreviated Notice of Resource Area Delineation, 1503
Main Street, RGB 2002-19
A site visit was done on 7/8/02.
The owner of the property was not present at the hearing.
Three members of the Reading Open Land Trust were present. They own the land to the
north, Fairbanks Marsh. They wanted to make sure that the boundary line was in the
right place on the site plan, and examined the plan. They also thought that it was likely
the land included floodplains.
Ms. Fink went over the memo she had written to the commission concerning trash, an
area of dead vegetation, and history of dumping in the Commission's files from 1995 to
1998. The last file was never closed properly. The vegetation that was brown was newly
grown.
Mr. Finch mentions that a neighbor, Carol Sanders, said that there was a truck that came
in and dumped something on the property. He mentioned he thought that the piles were
at least a year old, but not sure if there was something that was put on there to make them
look so old. The Commission decided to send a letter to the applicant, asking him to
attend the next meeting and address the questions raised this evening.
Mr. Greene recommends that some one get rid of flag 10 and just go from flag 9 to 11.
The Commission decided to make a second site visit.

Public Hearing: Notice of Intent, 340 Lowell Street, RGB 2002-16
The owners are waiting for the response from Natural Heritage, so they asked for a
continuance.
Ms. Lloyd moved to continue this hearing to July 24, 2002 at 7:45 PM. Mr. Berry
seconded. Voted in favor, 6-0-0.
Public Hearing: Notice of Intent, Harvest Road, DEP 270-372, RGB 2002-17
Ms. Fink updated the Commission about this project.
Ms. Lloyd moved to continue this hearing until July 24, 2002 at 7:30 PM. Mr. Berry
seconded. Voted in favor, 6-0-0.
Ms. Fink passed out a memo concerning possible technical consultants and discussed it.
Mr. Greene requests to call the Wildlife and Fisheries Restoration and see what they have
to say and have any suggestions on whom to contact for this project.
Ms. Lloyd moved to set up a revolving fund and require a consultant fee in the amount of
$5,000. Mr. Greene seconded. Voted in favor, 6-0-0.
26 Ridge Road
Ms. Lloyd moved to accept the Minor Project permit . Mr. Greene seconded. Voted in
favor, 6-0-0.
205 Pearl Street and 115 Charles Street
Ms. Lloyd moved to accept the foundation as-builts. Mr. Greene seconded. Voted in
favor, 6-0-0.
468 West Street, Longwood Farm
A memo was sent out to Hayes Engineering and a one page was sent back to Ms. Fink.
She had sent out a memo back in return and went over it.
Ms. Lloyd moved to approve the memo that Ms. Fink had drafted. Mr. Greene seconded.
Voted in favor, 6-0-0.
10 Haverhill Street, North Reading - ANRAD
The Commission decided to sent written comments to the North Reading Conservation
Commission concerning our concerns, degree of jurisdiction, and need to establish mean
annual high water to determine RFA boundaries. The Commission will request a site
visit on Monday, July 22, at 6 PM.

Mr. DeGennaro had delivered a written proposal earlier in the evening. He did not stay.
The Commission reviewed and discussed the letter.
Mr. Berry moved to approve the letter, with additional details concerning all the
remaining work on Lots 2 and 3, no bond released until the Commission inspects and all
